Abstract

Penelitian ini bertujuan untuk menganalisis secara yuridis terkait pidana kebiri kimia (chemical castration) berdasarkan perspektif Konvensi Menentang Penyiksaan Dan Perlakuan Atau Penghukuman Lain Yang Kejam, Tidak Manusiawi Dan Merendahkan Martabat Manusia. Penelitian ini bersifat deskriptif dengan jenis yuridis normatif. Bahan hukum yang digunakan adalah peraturan perundang-undangan, buku dan artikel yang berkaitan dengan kebiri kimia (chemical castration), melalui pendekatan perundang-undangan, kemudian dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa masih terdapat beberapa persoalan dalam Peraturan Pemerintah Republik Indonesia Nomor 70 Tahun 2020 tentang Tata Cara Pelaksanaan Tindakan Kebiri Kimia, Pemasangan Alat Pendeteksi Elektronik, Rehabilitasi khususnya mengenai tahap kesimpulan dan pelaksanaan kebiri kimia serta pidana kebiri kimia yang dimaksudkan untuk mengurangi perilaku seksual dan untuk mencegah pelanggaran seksual tidaklah efektif dan  bertentangan dengan Pasal 11  Konvensi Menentang Penyiksaan Dan Perlakuan Atau Penghukuman Lain Yang Kejam, Tidak Manusiawi Dan Merendahkan Martabat Manusia

Abstract

This article examines the disclosure of the identity of Children in Conflict with the Law (CCL) by the press in reporting on the internet media. The research method used is normative juridical with a prescriptive research type that is literature study. The type of data used is secondary data. The research results show that the disclosure of identities by the press has violated the provisions of Article 5 of the Journalistic Code of Ethics and the Regulation of the Press Council Number 1/PERATURAN-DP/II/2019. The disclosure of photographs in such cases can be reported to the Press Council by filing a complaint against the journalistic work. The concealment of the identity of children in conflict with the law aims to ensure that CCL can be accepted in society, as if the identity of CCL is revealed, there is a fear that the child will have difficulty being accepted by society, as they may be labeled as "criminal perpetrators."

Abstract

Indonesia has updated its Criminal Code through Law Number 1 of 2023, making a legal breakthrough by criminalizing cohabitation. Prior to this legislation, cohabitation was legally permitted but often considered contrary to social norms. In several Indonesian regions, cohabitants caught by local communities have been subjected to vigilante justice. Conversely, cohabitation can be viewed through the lens of human rights, where individuals possess the fundamental right to choose their life partners within or outside marriage. Consequently, the state is obligated to respect and protect this right from potential interference by other societal actors. This research examines whether the criminalization of cohabitation constitutes a human rights violation. Utilizing a doctrinal research methodology with a statutory approach, the study argues that the criminalization represents a nuanced compromise reflecting the current social and legal landscape in Indonesia.
