Abstract

Amisan marriage is a marriage performed by a couple who are still cousins. Cousin marriage which is commonly called amisan marriage in Kalijering Village is a marriage ban that has existed since ancient times, where the marriage is still running today and there is a tradition that must be carried out by the bride and groom if they continue to have a fishy wedding. This research uses qualitative research methods with the principle of understanding the object under study in depth and conducting research directly into the field (field research). In addition, this study uses inductive thinking patterns based on concrete experiences which are then used to review the practice of fishy marriage which is prohibited in Kalijering Village. As for data collection in this study, conducting interviews with fisherman marriage actors and several communities. In analyzing the author uses qualitative analysis based on Islamic law which can be concluded that fish-to-toe marriage is not prohibited and permissible, even though in Islam there is a recommendation to marry someone who is not a close relative such as a cousin. In addition, this amisan marriage is a valid 'urf and in carrying out this marriage does not look at it from the perspective of kafaah.

Abstract

In the current global economic context, the idea of promises (wa'ad), in business and financial dealings that are Islamic has become increasingly important amidst ongoing uncertainty and market dynamics. The global economy is under significant pressure due to geopolitical tensions, high inflation, and currency fluctuations, posing new challenges in financial transactions. This situation demands greater certainty and transparency to protect all parties involved, with Sharia principles playing a crucial role in ensuring that transactions are conducted fairly and in accordance with Sharia. Despite the clear guidelines provided by the DSN-MUI fatwa on wa'ad, practical challenges remain in implementing wisdom principles such as maslahah (public interest), justice, ease, benefit, and freedom. This study employs a qualitative library research method to see how these ideas are applied in the DSN-MUI fatwa. Primary data is sourced from DSN-MUI fatwa documents, while secondary data includes academic literature and previous studies. Data collection involves documentation and content analysis, with validity ensured through data triangulation. According to the results, the DSN-MUI fatwa effectively integrates wisdom principles, promoting justice, benefit, and Sharia compliance in transactions. The fatwa guidelines enhance the implementation of wa'ad, ensuring alignment with core Sharia values and making a positive contribution to the Islamic financial system.

Abstract

This research examines the thoughts of Sheikh Abdul Qodir Al Jailani's order as contained in the book Al Mukhtasor fi Ulumiddin. This book is an important work that describes the principles of Sufism and Islamic religious teachings from the perspective of Sheikh Abdul Qodir. Through in-depth analysis of the text, this research aims to identify the main concepts in his thinking, including the relationship between sharia and nature, as well as the role of the tarekat in achieving closeness to God. The research results show that Sheikh Abdul Qodir's thoughts are not only relevant in a spiritual context, but also make a significant contribution to the development of Islamic thought as a whole.
