Abstract

Abstrak Lahirnya undang-undang tentang informasi dan transaksi elektronik, tidak dapat dilepas dari semangat zaman yang bersifat global serta tuntutan kebutuhan akan perlindungan hukum bagi pengguna teknologi informasi, yang dipandang sebagai kelompok yang paling rentan terhadap kejahatan salah satunya penipuan transaksi elektronik. Hampir delapan tahun setelah undang-undang ini diberlakukan, banyak kasus penipuan menggunakan transaksi elektronik terus meningkat dan cenderung semangat pencegahan kejahatan dengan menggunakan transaksi elektronik hanya terbatas pada teks hukum tertulis tanpa ada upaya yang sistematis untuk menjadikan suatu kenyataan. Keterbatasan alat-alat khusus cyber crime yang dimiliki oleh aparat kepolisian di daerah-daerah kabupaten sampai dengan tingkat kecamatan untuk menunjang sarana prasarana penyidik dalam mengungkap tindak pidana penipuan transaksi elektronik merupakan salah satu kendala dalam menanggulangi tindak pidana penipuan transaksi elektronik di Indonesia. Kata Kunci: Penipuan, Transaksi Elektronik.

Abstract

 AbstrakIndonesia sedang memiliki beban ganda dalam menyelesaikan masalah pengelolaan sumber daya air, khususnya air tanah. Selain karena pembatalan UU No. 7/2004, juga karena pengalihan kewenangan pengelolaan dari pemerintah kabupaten/kota ke pemerintah provinsi sebagai dampak dari UU No. 23/2014. Karena proses komunikasi antara provinsi dan kabupaten/kota tidak mulus, karena berbagai alasan, akibatnya regulasi tidak kunjung dibuat. Pada akhirnya kondisi air tanah akan semakin buruk. Makalah ini mencoba mendudukkan kembali berbagai aspek pengelolaan air tanah yang telah dirumuskan sebelumnya dan masih relevan untuk dijalankan saat ini. Kemudian dipilihlah aspek konservasi dan pemberdayaan sebagai aspek yang dapat dikerjasamakan antara pemerintah provinsi dan pemerintah kabupaten/kota, karena: aspek ini lebih berkaitan dengan aspek monitoring atau pemantauan. Yang mana, pemantauan akan lebih baik dilakukan oleh pemerintah kabupaten/kota karena skala pemetaan yang lebih rinci, dibanding bila dilakukan pada skala provinsi. Selain itu instrumentasi pemantauan yang dimiliki oleh organ tingkat kabupaten/kota lebih lengkap dibanding pemerintah provinsi.Kata kunci: Regulasi, Pengelolaan Air Tanah, Cekungan Air TanahAbstractIndonesia currently has a double burden in solving the problem of water resources, particularly groundwater. In addition to the cancellation of Law No. 7/2004, as well as the transfer of management authority of district/city government to the provincial government as a result of Law No. 23/2014. Due to the communication process between the provincial and district /city is not good, for various reasons, not being made as a result of regulation. Ultimately groundwater conditions will be getting worse. This paper tries to reinstate the various aspects of groundwater management has been formulated previously and are still relevant to the current run. Then chosen aspects of conservation and empowerment as an aspect to cooperation between the provincial and district /city government, because: this aspect is more related to aspects of monitoring. Which, monitoring would be better done by the district /city for more detailed mapping scale. Besides monitoring instrumentation owned by organs of district/municipal level is more complete than the provincial government.Keywords: Regulation, Groundwater Management, Groundwater Basin

Abstract

The realization of cooperation ties between Legal Entity State Universities (PTN BH) and work partners, in practice, still has legal ties mechanisms that position PTN BH as goods/services providers. This research aims to determine the competence of PTN BH, which does not have a legal position as a goods/services provider in conducting legal ties with government and non-government partners. This renewable research was conducted to explore/understand PTN BH's competence in managing collaboration. In have rights practice, the realization of cooperation still shows that PTN BH is a provider of goods/services in carrying out cooperative relationships with Government and non-government partners. This research uses a normative doctrinal approach or normative juridical legal research, which examines the internal aspects of positive law or legislation. The data collection technique was carried out through a literature study in the form of secondary data in the form of articles that have been published in journals as basic research material. The results of this research show that there are basic principles for PTN BH in collaborating with partners, namely the non-profit principle, the tri dharma principle of higher education, and the principle of truth and justice from a Sharia perspective. Economic law following Sharia economic law principles.

Abstract

This study aims to examine the causes of the decline in groundwater resources in the perspective of the concept of Islamic economic law, through selected article sources. This research uses a normative doctrinal approach or normative juridical legal research that examines the internal aspects of law or positive regulations. Data collection techniques are carried out through literature studies in the form of secondary data in the form of published articles in journals as basic research material. The condition of the Groundwater Basin (CAT) in Bandung City is now entering a critical condition, one of the visible indications is the decline in groundwater levels by 60-80 percent each year. According to Islamic economic law, everything related to water resources management is believed to be a trust from Allah SWT that must be managed and utilized properly. Islam allows freedom for humans to utilize water resources that are public (general) on the condition that the management must be fair and balanced, not damaging and polluting the environment and natural resources.
