Abstract

Haryono No. 169 Malang e-mail: sarahrizkyr@student.ub.ac.id Abstrak Penelitian ini dilatarbelakangi oleh ketidaklengkapan hukum dalam Undang-Undang Nomor 27 Tahun 2022 tentang perlindungan data pribadi mengenai prinsip perlindungan data pribadi khususnya prinsip Right To Erasure (RTE) yang bertentangan dengan karakteristik kekekalan (immutability) pada jaringan blockchain pada Non Fungible Token serta kekosongan data controller pada Non fungible token. Kemudian untuk menjawab permasalahan yang ada, penulis menggunakan jenis penelitian yuridis normatif dengan metode pendekatan perundang-undangan (statue approach), pendekatan konsep (conceptual approach), dan pendekatan perbandingan (comparative approach). Bahan hukum primer, sekunder, dan tersier akan penulis analisis menggunakan penafsiran gramatikal, penafsiran sistematis, serta penafsiran komparatif, dengan rumusan masalah: 1. Bagaimana analisis yuridis perlindungan data pribadi dengan konsep Immutability dalam jaringan blockchain Non Fungible Token (NFT), dan 2. Bagaimana analisis yuridis kekosongan data controller dalam Non Fungible Token (NFT) yang berbasis jaringan blockchain? Hasil penelitian ini menunjukan bahwa Peraturan perlindungan data pribadi di Indonesia belum dapat melindungi data pribadi pada bidang teknologi informasi yang lebih spesifik seperti jaringan blockchain pada Non Fungible Token (NFT). Ditemukannya bahwa jaringan blockchain pada Non Fungible Token memiliki karakteristik yang terdesentralisasi sehingga tidak memiliki pengendali data dan memiliki karakteristik kekekalan (immutability) sehingga bertentangan baik terhadap Undang-Undang Nomor 27 Tahun 2022 tentang perlindungan data pribadi maupun General Data Protection Regulations (GDPR). Adapun penelitian ini juga menemukan bahwa General Data Protection Regulations (GDPR) oleh Eropa juga belum mengatur mengenai jaringan blockchain secara umum. Kata Kunci: perlindungan data pribadi, non fungible token (NFT), blockchain Abstract This research departs from the incompleteness of Law Number 27 of 2022 concerning Personal Data Protection regarding the Principle of Personal Data, particularly the Right to Erasure (RTE) contravening the nature of immutability in blockchain in Non-Fungible Tokens and the absence of controller in Non-Fungible Tokens. This research employs a normative-juridical method and statutory, conceptual, and comparative approaches. The primary, secondary, and tertiary data were analyzed using grammatical, systematic, and comparative interpretation to investigate the juridical analysis of personal data protection with immutability concept in blockchain in Non-Fungible Tokens (NFTs) and the juridical analysis of the absence of controller data in Non-Fungible tokens (NFTs) based on blockchain networks. The research results reveal that the regulation regarding data protection in Indonesia cannot protect personal data in the domain of information technology more specifically such as in blockchain in Non-Fungible Tokens (NFTs). This research has found that blockchain networks in Non-Fungible Tokens show a decentralized nature with the absence of data controller and immutability. Thus, it contravenes the Law Number 27 of 2022 concerning Personal Data Protection and General Data Protection Regulation (GDPR). Abstract

Covernote is a certificate from a notary that becomes an important requirement in the disbursement of murabahah financing, especially when the customer has not met the complete requirements, such as the unfinished collateral checking process or the status of the land that still does not have a certificate of ownership. Although it does not have legal force, the Covernote serves as a guideline for Islamic banks in disbursing financing, with the notary responsible for completing the collateral checking process until the issuance of the Deed of Granting Mortgage. Although notaries have the authority to make authentic deeds or deeds under hand, Covernote is not included. This research is important to understand the law related to notary Covernote, the urgency of legal protection for banks in the case of notaries who do not fulfill their obligations, and analysis of legal remedies that can be taken by banks against non-performing loans due to notary negligence in Covernote. The research method used is empirical juridical research, which is a research conducted on the real situation that occurs in the application of legal practice in society and analyzes the actions of legal institutions related to these problems which aim to provide legal certainty. The conclusion obtained is that the quality of financing is the main indicator in assessing the financial health and risks faced by an Islamic bank. The category of financing, ranging from current to non-performing, illustrates the customer's ability to pay obligations in accordance with the agreed contract. Effective monitoring and management of financing is necessary to identify and address risks in a timely manner, minimize financial risks, and maintain the continuity of bank operations
