Abstract

Haryono No. 169 Malang e-mail: renatadian@student.ub.ac.id Abstrak Penelitian ini mengangkat permasalahan pertanggungjawaban pihak aplikator dalam transaksi sewa menyewa kamar hotel melalui aplikasi booking online. Penulis memilih tema tersebut dilatar belakangi tentang apakah jika terjadi masalah yang muncul akibat dari kemudahan melakukan transaksi melalui aplikasi booking online ini pihak ketiga yaitu, pihak aplikator dapat dimintai pertanggungjawabannya. Mengenai pertanggungjawabannya dari pihak aplikator ini apakah dapat didasarkan pada wanprestasi. Berdasarkan hal tersebut penelitian ini mengangkat rumusan masalah : (1) Bagaimana kedudukan hukum aplikator dalam transaksi sewa menyewa kamar hotel melalui aplikasi booking online? (2) Bagaimana pertanggungjawaban aplikator dalam transaksi sewa menyewa kamar hotel melalui aplikasi booking online? Penelitian ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan dan pendekatan kasus. Bahan hukum dianalisis menggunakan teknik interpretasi gramatikal yaitu, cara menafsirkan istilah dalam undang-undang sesuai dengan kaidah bahasa hukum. Hasil penelitian dengan metode diatas, Penulis memperoleh jawaban bahwa kedudukan hukum aplikator dalam transaksi sewa menyewa kamar hotel melalui aplikasi booking online ini adalah memiliki kedudukan sebagai pihak penengah atau pihak mediator yang memiliki dua cabang kaki. Maksudnya adalah aplikator memiliki kedudukan hukum sebagai penyedia layanan jasa dan sebagai payment gateway. Selain itu, pertanggungjawaban aplikator dalam transaksi sewa menyewa kamar hotel melalui aplikasi booking online dapat diselesaikan berdasarkan pada isi klausa perjanjian antara pihak aplikator, pihak pelaku usaha dalam hal ini adalah pelaku usaha perhotelan, dan pihak konsumen; Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen; dan Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Kata Kunci: pertanggungjawaban,aplikator,sewa menyewa,aplikasi booking online Abstract This research investigates the responsibility held by an applicator in hotel room transactions on an online booking app. This research topic departed from the issue arising from the ease of transaction offered by an online booking app, especially related to the third party. In this case, the applicator can be held responsible according to the breach of contract committed. Departing from this issue, this research investigates (1) the standing of the application in hotel room transactions on an online booking app and (2) the responsibility of the applicator concerned in the transaction performed on the app. This research employed a normative-juridical method and a case approach. Legal data were analyzed using grammatical interpretation; the terms in related laws were interpreted according to the standard of legal terms. The research result reveals that the applicator serves as a mediator that holds two standing as a service provider and payment gateway. Furthermore, the responsibility held by the applicator concerned regarding hotel room transactions on an online booking app can be settled according to the agreement clause between applicators, hotel business actors, and consumers. The Materials studied involve Law Number 8 of 1999 concerning Consumer Protection and Law Number 11 of 2008 concerning Electronic Information and Transactions. Abstract

This study aims to determine the relationship between low self-acceptance and the level of self-efficacy in prisoners, as well as its implications on social life after prisoners are released from punishment. The systematic review method is used with the SPIDER approach to formulate research questions and select relevant articles. The search was conducted through the Publish or Perish, Google Scholar, and Scopus databases with keywords related to self-acceptance, self-efficacy, and inmates. Of the 100 articles identified, 13 studies met the inclusion criteria. The results of the review showed that low self-acceptance was consistently negatively associated with self-efficacy in prisoners, which had an impact on low self-confidence to face social challenges, reintegration, and overcome societal stigma. Psychological factors such as guilt, anxiety, depression, and insecurity can exacerbate low self-acceptance, especially in female inmates. In addition, social support from family, the environment, and psychological interventions have been shown to play an important role in improving self-acceptance and self-efficacy. Interventions such as expressive art therapy, psychoeducation, counseling, skills training, and religious activities have shown effectiveness in improving psychological well-being. These findings underscore the importance of systematic efforts to improve self-acceptance and self-efficacy to support the successful social reintegration of prisoners.
