Abstract

Haryono No. 169 Malang e-mail: muhrzgistra@student.ub.ac.id Abstrak Hubungan pemerintah pusat dan daerah merupakan bagian penting dalam pelaksanaan pemerintahan, setiap daerah bisa melaksanakan pemerintaannya dengan efektif memperhatikan undang-undang terkait, dalam hal ini terkait Hubungan pemerintah Pusat diatur di Undang-Undang Undang-Undang Nomor 23 Tahun 2014 Tentang Pemerintah Daerah, di undang-undang ini kewenangan yang diberikan disebut kongkuren, salah satu kewenangan ialah pertanian, lebih lanjut hubungan pusat dan daerah dalam pertanian khususnya pertanian berkelanjutan diatur di Undang-Undang Nomor 22 Tahun 2019 Tentang Sistem Budi Daya Pertanian Berkelanjutan. Pada penelitian ini, penulis mengangkat permasalahan tentang hubungan pusat dan daerah dalam kewenangan pengaturan pertanian berbasis climate-neutral agriculture untuk membentuk Kota Tangguh Iklim di Kota Blitar, dimana dalam pelaksanaannya Kota Blitar mempunyai potensi kuat sebagai model Kota Tangguh Iklim karena pengaruh perubahan iklim yang kontras disana disertai pengalaman Kota Blitar sebelumnya turut serta mengikuti program yang mengurangi dampak perubahan iklim. Metode Penelitian yang digunakan adalah Yuridis Normatif, dengan Pendekatan Konseptual dan Pendekаtаn Perundаng-undаngаn. Kemudian hasil dari penelitian bahwa hingga saat ini pengaturan tentang perubahan iklim di sektor pertanian berbasis climate neutral agriculture belum ada sehingga perlu dibuat Peraturan Daerah yang mengatur tentang hal tersebut. Adapun ini dilakukan guna memberikan kepastian hukum dan juga memperbaiki kekosongan hukum dalam penyelenggaraan berbasis climate-neutral agriculture di Kota Blitar. Kata Kunci: hubungan pusat dan daerah, Blitar, pertanian netralitas iklim Abstract The relations between central and regional governments are vital to the government. Each region can effectively run its government as long as it complies with relevant laws. These relations are governed by Law Number 23 of 2014 concerning Regional Government, which mentions concurrent authority in agriculture. Furthermore, the relations between the central and regional governments in sustainable agriculture are governed by Law Number 22 of 2019 concerning Sustainable Agricultural Systems. This research studies the relations between the central and regional governments in the authority to regulate climate-neutral-based agriculture to create a climate-resilient city of Blitar. This city holds strong potential to represent climate resilience since Blitar has run a program intended to reduce the effects brought by climate change amidst extreme climate change. With a normative-juridical method, conceptual, and statutory approaches, this research has found that the regulation governing climate change in agricultural sectors based on neutral climate agriculture is absent. Thus, a new regulation concerning this matter is required. This research aims to ensure that legal certainty is provided to fill the legal loophole in climateneutral-based agriculture in Blitar City. Abstract

The business licensing reform enacted through Law Number 11 of 2020 concerning Job Creation has given rise to the Risk-Based Online Single Submission (OSS RBA) system, which relies on real-time data interoperability from various government agencies. The ratification of Law Number 27 of 2022 concerning Personal Data Protection (PDP Law) introduces a new legal regime that creates ambiguity regarding the legal status of the parties within the OSS RBA ecosystem. This research aims to analyze the legal qualification of the parties involved in personal data processing within the ecosystem, evaluate the application of the Joint Controllership concept in OSS RBA interoperability, and formulate a mechanism for allocating legal responsibility in the event of personal data protection failures. The research employs a normative juridical method with statutory and conceptual approaches. The result indicate that the relationship between the Ministry of Investment/BKPM and the data source agencies is more appropriately qualified as Joint Controllers, as they collectively determine the purposes and means of personal data processing. A legal void exists in the regulation of joint controllership within the OSS RBA. The absence of agreements or derivative technical regulations governing the allocation of responsibility creates ambiguity that can be detrimental to data subjects. Therefore, derivative regulations are necessary to stipulate in detail the joint controllership mechanism and to mandate the preparation of Data Sharing Agreements (DSAs) between agencies, which would define the responsibilities of each party in accordance with the provisions of the PDP Law.
