Haryono No. 169 Malang e-mail: Iqianlanov@gmail.com Abstrak Dalam skripsi ini, mengangkat permasalahan mengenai efektivitas Pasal 40 ayat (1) huruf e Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta terhadap Seni Tari Rancak Malangan yang belum didaftarkan ke Direktorat Jendral HAKI. Latar belakang penelitian ini adalah bangkitnya klaim sepihak baik antara daerah dan negara yang berhubungan dengan seni tari. Dalam hal ini, masyarakat dan pemerintah harus menyadari hal-hal kecil seperti hak cipta. Berdasarkan penjelasan tentang masalah-masalah di atas, formulasi masalah yang diajukan oleh penulis adalah: 1. Bagaimana efektivitas Pasal 40 ayat (1) huruf e Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta terhadap Seni Tari Rancak Malangan? 2. Apa faktor penghambat dalam efektivitas Pasal 40 ayat (1) huruf e Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta terhadap Seni Tari Rancak Malangan? 3. Bagaimana upaya untuk mengatasi hambatan dalam efektivitas Pasal ayat (1) huruf e Undang-Undang No 28 Tahun 2014 Tentang Hak Cipta terhadap Seni Tari Rancak Malangan? Dari hasil penelitian yang dilakukan oleh penulis menggunakan metode ini, penulis mendapatkan jawaban mengenai dalam efektivitas Pasal ayat (1) huruf e Undang-Undang No 28 Tahun 2014 Tentang Hak Cipta untuk Tari Rancak Malangan yang diteliti oleh penulis belum efektif di Kabupaten Malang. Kata Kunci: tarian, hak cipta, tari rancak malarangan, duta wisata Abstract This research studies the issue regarding the effectiveness of Article 40 Paragraph (1) letter e of Law Number 28 of 2014 concerning the Copyright of Rancak Dance of Malang that has not been registered to the Directorate General of Intellectual Property Rights. This research topic departed from escalating claims over dance as art. When this is the case, both public and the local government should be aware of copyright. Unilateral claims, as mentioned, have been taking place between the region and the state. Departing from this issue, this research aims to investigate 1. The effectiveness of Article 40 Paragraph (1) letter e of Law Number 28 of 2014 concerning Copyright over Rancak Dance of Malang, 2. Factors hampering the effectiveness of Article 40 Paragraph (1) letter e of Law Number 28 of 2014 concerning Copyright of Rancak dance, 3. Measures taken to tackle the hampering factors in the effectiveness of Article 40 Paragraph (1) letter e of Law Number 28 of 2014 concerning Copyright of Rancak Dance of Malang. The research result reveals that the implementation of Article 40 Paragraph (1) letter e of Law Number 28 of 2014 concerning the Copyright for Rancak Dance of Malang has not been effective.
