Haryono No. 169 Malang e-mail: neiskapalvanka@student.ub.ac.id Abstrak Ketentuan Pasal 13 Peraturan Daerah Kabupaten Kediri mewajibkan adanya Perpustakaan, Taman Baca atau Pojok Baca di Kabupaten Kediri. Namun, Lokasi pariwisata yang ada di Kabupaten Kediri belum memenuhi ketentuan tersebut. Berdasarkan fenomena tersebut penelitian ini berusaha menggali mengenai efektivitas penerapan Pasal 13 Perda Perpustakaan dan hambatan dalam penerapannya dari sudut pandang Pemerintah Daerah dan Pengelola lokasi. Pertanyaan utama dalam tulisan ini berusaha mencari penyebab belum di implementasikannya penyediaan perpustakaan pada tempat wisata dengan pendekatan sosiologis empiris dengan analisa utama menggunakan teori efektifitas hukum. Hasil penelitian menunjukkan penyebab utama belum dilaksanakannya kewajiban tersebut adalah belum adanya sosialisasi sehingga pengelola lokasi wisata tidak mengetahui adanya kewajiban, ketiadaan sosialisasi diakui oleh Dinas Perpustakaan sehingga proses penegakan Perda belum dilaksanakan. Sedangkan,factor penghambat implementasi Pasal 13 yaitu pada faktor Penegak telah ada Dinas yang menaungi pelaksanaan namun tidak berjalan efektif, faktor sarana dan prasarana yang diperlukan menunjukkan kekurangan, serta faktor kebudayaan yang pada dasarnya terdapat kesadaran dan budaya membaca di Kabupaten Kediri namun belum terfasilitasi dengan baik karena kurangnya sarana dan prasarana dari Pemerintah Daerah. Kata Kunci: efektivitas, peraturan daerah, perpustakaan Abstract The provision of Article 13 of Regional Regulation of the Regency of Kediri requires the establishment of a Library, Reading Space, or Reading Corner in the Regency of Kediri. However, the location in this regency has not met these criteria. Departing from this issue, this research aims to delve into the implementation of Article 13 of the Regional Regulation concerning Libraries and the hindering factors in the implementation seen from the perspective of the Regional Regulation and location manager. The question raised in this study is intended to reveal the causing factor of the absence of libraries in tourist spots. With a socio-empirical approach and the theory of effectiveness of law as the instrument of analysis, this research shows that this absence is mainly caused by a lack of introduction to society, and it leaves the tourist spot manager not aware of the obligation of providing the library or reading space. Another hindering issue is that the agency concerned is not working effectively, and despite reading awareness and culture in the regency of Kediri, they are not well accommodated.
