Haryono No. 169 Malang e-mail: krishnawidyarsa@student.ub.ac.id Abstrak Tulisan ini mengangkat isu yang berawal dari adanya dualisme pengaturan yang terjadi antara Kemendagri dan KemendesPDTT. Kedua kementerian tersebut sama-sama membuat aturan terkait penataan kewenangan Desa berdasarkan hak asal usul dan kewenangan lokal berskala Desa, dan saling bertentangan satu sama lain. Kemendagri melalui Permendagri No. 44 Tahun 2016 tentang Kewenangan Desa dan KemendesPDTT melalui melalui PermendesPDTT No. 1 Tahun 2015 tentang Pedoman Kewenangan Berdasarkan Hak Asal Usul dan Kewenangan Lokal Berskala Desa. Sehingga perlu dilakukan harmonisasi hukum terhadap penataan kewenangan Desa. tujuan tulisan ini adalah untuk mengetahui urgensi harmonisasi hukum dan merumuskan konsep harmonisasi hukum terhadap penataan kewenangan Desa. Tulisan ini merupakan penelitian yuridis normatif dengan metode pendekatan perundang-undangan, konseptual, dan historis. Hasilnya terdapat dualisme pengaturan yang menyebabkan tumpang tindih kewenangan antara kedua kementerian sehingga terjadi disharmonisasi yang berujung pada konflik hukum. Dualisme yang terjadi mengenai detail daftar rincian kewenangan Desa berdasarkan hak asal usul dan kewenangan lokal berskala Desa, kemudian mekanisme penataan kewenangan Desa berdasarkan hak asal usul dan kewenangan lokal berskala Desa oleh bupati dan/atau walikota serta mengenai pungutan Desa. Dualisme pengaturan ini menimbulkan berbagai permasalahan pada tataran implementasinya. Berdasarkan hal tersebut penting untuk dilakukan harmonisasi hukum terhadap penataan kewenangan Desa. Penulis menawarkan beberapa konsep yang dapat dilakukan dalam rangka harmonisasi hukum terhadap penataan Kewenangan Desa, diantaranya melalui harmonisasi kelembagaan, harmonisasi keuangan, harmonisasi peraturan perundang-undangan (regulasi), serta harmonisasi sumber daya manusia. Kata Kunci: Kemendagri, KemendesPDTT, daerah tertinggal dan transmigrasi, penataan kewenangan desa Abstract This research departed from the dualism issue in the regulations of the Ministry of Home Affairs (Kemendagri) and the Ministry of Village, Underdeveloped Regions, and Transmigration (KemendesPDTT). These two ministries set the regulations regarding village authority according to the rights of origin and local authority at a rural scale, while the regulation contravenes the other. The Kemendagri stipulated the Regulation of Kemendagri Number 44 of 2016 concerning the Village Authority and KemendesPDTT stipulated the Regulation of KemendesPDTT Number 1 of 2015 concerning the Guidelines of the Authority According to the Rights of Origin and the Local Authority at a rural scale. These two regulations need harmonization in the management of village authority. This research, therefore, aims to investigate the urgency of the harmonization of law and formulate the concept of the harmonization of law regarding the management of village authority by employing normative-juridical methods and statutory, conceptual, and historical approaches. The research results reveal that there is a dualism of regulations, causing overlapping authorities, and this situation leads further to legal conflict. This dualism falls on the details of village authorities according to the rights of origin and the local authorities at a rural scale and also the mechanism of the management of village authority according to the rights of origin and local authorities at a rural scale by regents and/or mayors and matters regarding levies imposed on the village. This dualism has brought about a conflict in the implementation. Therefore, it is essential to start harmonization of law regarding the management of village authority. This research offers several concepts to support this harmonization in this case. These measures may involve institutional, financial, and statutory (regulatory) harmonization, and the harmonization of human resources.
