Haryono No. 169 Malang e-mail: fariznugraha@student.ub.ac.id Abstrak Jaminan sosial merupakan bagian dari upaya negara dalam memberikan perlindungan sosial sebagai pemenuhan hak dasar hidup yang layak bagi masyarakat. Pemenuhan serta penyelenggaraan jaminan sosial di Indonesia merupakan amanah konstitusi yang diatur dalam Undang- Undang No. 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional. Keberadaan undang – undang ini memberikan implikasi atas lahirnya beberapa jenis program jaminan sosial di Indonesia. Lebih lanjut perkembangan jaminan sosial senantiasa dipengaruhi oleh politik hukum serta dinamika sosial masyarakat. Lahirnya Undang- Undang No 11 Tahun 2020 tentang Cipta Kerja telah memberikan perluasan jaminan sosial melalui penambahan program Jaminan Kehilangan Pekerjaan. Pada penelitian ini, penulis mengangkat permasalahan mengenai analisis yuridis terhadap kebijakan rekomposisi iuran jaminan sosial ketenagakerjaan pada program Jaminan Kehilangan Pekerjaan melalui tinjauan prinsip manajemen pengelolaan dana pada Undang- Undang No. 40 Tahun 2004 tentang SJSN. Metode Penelitian yang digunakan adalah Yuridis Normatif, dengan Pendekatan Analisis (analytical approach) dan Pendekаtаn Perundаng - undаngаn (stаtue аpproаch). Adapun hasil penelitian menunjukan bahwa terdapat kesamaan unsur perbuatan/tindakan larangan praktek subsidi silang dengan mekanisme skema rekomposisi iuran program JKP. Kebijakan rekomposisi iuran dinilai belum memenuhi komponen prinsip manajemen pengelolaan dana sistem jaminan sosial nasional. Rekomendasi penulis mengerucut kepada perlunya harmonisasi serta pengadaan konsep pengaturan hukum khusus berkaitan dengan pengelolaan serta pengembangan aset dana JKP guna memberikan kepastian hukum serta perlindungan bagi para pihak dalam hal meminimalisir resiko kerugian. Kata Kunci: jaminan kehilangan pekerjaan, prinsip manajemen pengelolaan dana, rekomposisi iuran, sistem jaminan sosial nasional Abstract Social security is part of the measures taken by the state aiming to provide social protection to fulfill decent basic rights for people. The fulfillment and administration of social security represent the completion of the constitution as governed in law Number 40 of 2004 concerning the National Social Security System. The existence of the law has triggered the emergence of new social security programs in Indonesia. Furthermore, the development of social security is often affected by legal politics and the social dynamic of the people. Law Number 11 of 2020 concerning Job Creation has widened the extent of social security through the addition of another security program for job loss. This research studies the juridical analysis of the re-composition of social security fees for employment in the program of social security for job loss with the review of the fund management principle in Law Number 40 of 2004 concerning the National Social Security System. With normative-juridical methods and analytical and statutory approaches, this research has found that there are similar actions in bans on cross-subsidizing practices under the mechanism of re-composition of the fee for job loss. This policy, however, is deemed to fail to meet the components of the fund management principle of national social security. This research, therefore, implies that harmonization of the concept of regulation specifically governing the management and development of assets for job loss security is necessary to ensure legal certainty and protection for all parties to help minimize loss risk.
