Haryono No. 169 Malang e-mail: bayutondy@student.ub.ac.id Abstrak Permasalahan yang diangkat dalam penelitian ini adalah bagaimana kewenangan dalam syarat pengisian dan mekanisme pemilihan Direksi BUMD mengacu kepada Peraturan Menteri Dalam Negeri Nomor 37 tahun 2018 atau POJK 55/POJK.03/2016. Penelitian ini didasari oleh adanya dua peraturan yang saling tumpang tindih atau menimbulkan kontradiksi norma yang saling bertolak belakang. Berdasarkan Peraturan Menteri Dalam Negeri dijelaskan bahwa syarat untuk dapat diangkat menjadi Direksi BUMD yaitu harus memiliki usia minimal 35 tahun dan maksimal berusia 55 tahun pada saat pendaftaran (Pasal 35 H Peraturan Menteri Dalam Negeri No 37 tahun 2018), namun disisi lain didalam peraturan OJK Nomor 33 tahun 2014 yang dapat dilihat di Pasal 4 dimana tidak mewajibkan adanya persyaratan mengenai usia direksi pada saat pendaftaran. Tujuan dari penelitian ini adalah untuk mengetahui bentuk kewenangan dalam syarat pengisian dan mekanisme pemilihan Direksi BUMD mengacu kepada Peraturan Menteri Dalam Negeri Nomor 37 tahun 2018 atau POJK 55/POJK.03/2016 dan bagaimana implikasi hukum atas pengisian direksi yang melanggar ketentuan Undang-Undang Pemerintahan Daerah dan peraturan pelaksanannya. Metode penelitian ini adalah yuridis normаtif atau penelitian hukum doktriner atau disebut juga sebagai penelitian kepustakaan atau studi dokumen, dengan pendekatan perundаng-undаngаn, pendekatan konseptual dan pendekatan kasus. Hasil penelitian ini menunjukkan bahwa PP BUMD dan Peraturan Daerah juga mengatur tentang kewajiban kepada seluruh BUMD tanpa terkecuali dan untuk menyelesaikan permasalahan tersebut, dapat dilakukan 2 langkah yaitu pertama, Gubernur sebagai pejabat berwenang untuk melantik dan mengeluarkan Surat Keputusan pengangkatan Direksi terdahulu, dapat mencabut atau menganulir dengan Surat Keputusan baru yang menyatakan Surat Keputusan pengangkatan direksi terdahulu tidak berlaku. Kata Kunci: direksi, BUMD, regulasi Abstract This research studies the authority in the requirement and mechanism of the selection of the Director to fill the position in a Regional-Owned Enterprise (BUMD) that refers to the Regulation of the Minister of Home Affairs Number 37 of 2018 or the Regulation of Financial Services Authority (POJK) Number 55/POJK 55.03/2016. This research is based on two overlapping regulations, which sparks conflicting norms. The Regulation of the Minister of Home Affairs implies that the position of director of BUMD should at least be 35 years old and not be older than 55 during the time of registration (Article 35 H of the Regulation of the Minister of Home Affairs Number 37 of 2018). On the other hand, the POJK Number 33 of 2014 in Article 4 does not require a certain age to fulfill the position of director. This research aims to study the authority in the requirement of the fulfillment and the mechanism of a position as a director in BUMD that refers to the Regulation of the Minister of Home Affairs Number 37 of 2018 or POJK 55/POJK.03/2016 and the implication of law regarding the matter that may violate regional regulations and the delegated regulations. This research employed normative-juridical methods and doctrines/library research or the study of documents. It employed statutory, conceptual, and case approaches. The research results show that the Government Regulation of BUMD and Regional Regulation also govern the obligation carried out by all BUMD to tackle the issues. This obligation involves the following conditions: the Governor is authorized to hold an inauguration or issue a decree of the appointment of a director, revoke or annul a new decree declaring a decree of an appointment of a director that is no longer effective.
