Abstract

Fulfillment of the right to legal aid for the poor is the establishment of rules that have legal consequences for Advocates or Legal Aid Organizations (OBH) to provide legal aid as a form of social and moral responsibility. Apart from that, to support the means and facilities for fair and equitable law enforcement, local governments are required to provide legal assistance so that the fulfillment of the right to legal aid for the poor is more guaranteed. Fulfillment of the right to legal aid to the poor in criminal cases is influenced by several factors, including Legal Aid Organizations (OBH), which are places of public defense. Advocates are parties who are directly involved in enforcing legal claims and professional obligations both in the field of litigation and non-litigation. The obligation to provide legal assistance is contained in the provisions of Article 22 paragraph (1) of Law Number 18 of 2003 concerning Advocates. In that article it is stated that Advocates are obliged to provide legal assistance free of charge to justice seekers who cannot afford it.

Abstract

Corporations as perpetrators of criminal acts can be criminally charged, because corporations are legal subjects and therefore can be held criminally responsible. PERMA Number 13 of 2016 dated December 21 2016 concerning Procedures for Handling Criminal Cases by Corporations, regulates matters namely corporate and management criminal liability, corporate group accountability, corporate responsibility in mergers, consolidations, separations and dissolution of corporations, corporate audit procedures, procedures for examining management, procedures for examining corporations and management, claims for compensation and restitution, handling of corporate assets, abolition of the authority to prosecute and carry out crimes, sentencing, criminal decisions, implementation of decisions and implementation of additional crimes or regulations against corporations.

Abstract

Badan peradilan di Indonesia sebagai lembaga pemerintahan yang melaksanakan kekuasaan yudikatif harus mampu mewujudkan kepastian hukum, ketertiban hukum, keadilan, dan kebenaran berdasarkan hukum dan mengindahkan norma keagamaan, kesopanan, dan kesusilaan, serta wajib menggali nilai-nilai kemanusiaan, hukum, dan keadilan yang hidup dalam masyarakat. Proses penegakan hukum harus berlandaskan pada empat asas yaitu asas persamaan di depan hukum (equality before law), asas kepastian hukum (rechtssicherkeit), asas keadilan (gerechtigkeit), dan asas kemanfaatan (zweckmasigkneit). Namun sebuah positive progress bahwa di dalam pasal 2 Perma N0. 3 Tahun 2017 selain empat asas di atas kini ditambah pula dengan asas penghargaan atas harkat dan martabat manusia, non diskriminasi dan asas kesetaraan gender. Sehingga dalam asas nondiskriminasi, hakim dilarang melakukan pembedaan, pengucilan, atau pembatasan atas dasar jenis kelamin. Hakim dilarang menunjukkan sikap atau pernyataan yang bias gender, membenarkan adanya diskriminasi terhadap perempuan dan juga larangan menanyakan riwayat seksual korban. Selain itu, hakim mempunyai hak untuk mencegah bahkan menegur para pihak, penasihat hukum, penuntut umum dan/atau kuasa hukum yang bersikap atau membuat pernyataan yang merendahkan, menyalahkan, mengintimidasi dan/atau menggunakan pengalaman atau latar belakang seksualitas perempuan berhadapan dengan hukum.

Abstract

Limited Liability Company is a legal entity. With its status as a legal entity, it means that the company is a legal subject capable of supporting its rights and obligations as with a person and has its own assets separate from the assets of its founders, shareholders and administrators, since the court pronounces the bankruptcy decision in an open session. For the general public, the debtor has the result that he loses the right to manage and control his assets (persona standy in ludicio) and the bankrupt's rights and obligations are transferred to the curator to manage and control his assets in accordance with the Bankruptcy Law. In principle, directors are fully responsible for running the company and directors are personally responsible if they violate the authority determined by law or the articles of association. ultra virres is when the action taken is beyond the company's capacity as stated in the company's aims and objectives as stated in the Articles of Association. The principle of fiduciary duty applies to company directors in carrying out their duties both in carrying out their functions as management, namely in leading the company and as representation, namely representing the company inside and outside the court. Directors are fully responsible for running the company and directors are personally responsible if they violate the authority determined by law or the Articles of Association. In the event that a Limited Liability Company is sentenced to bankruptcy, the Directors of the Limited Liability Company may not transfer its bankruptcy certificate, if this happens, the Directors of the Limited Liability Company may be subject to the crime of embezzlement.

Abstract

The application of diversion from a justice perspective focuses on achieving case resolution that focuses more on recovery and rehabilitation, especially in cases involving children. In this context, diversion acts as an alternative to prevent children from formal criminal justice processes which tend to have negative impacts, such as stigmatization or trauma. Diversion is not just a transfer of case resolution, but is also part of a restorative justice approach. Thus, the application of diversion from a justice perspective is not only seen as a diversion from the legal process, but also as an effort to restore and provide opportunities for children to correct their mistakes, as well as reduce the negative impacts of involvement in the formal criminal justice system.
