Abstract

Penelitian ini dilatar belakangi oleh prolifersai kewenangan Pemerintahan Daerah dalam membentuk Peraturan Daerah sangat luas tidak diiringi oleh fungsi sinkronisasi dan harmonisasi peraturan perundang-undangan yang optimal. Masing-masing pihak memiliki argumen yang kuat dalam mempertahankan suatu peraturan bernuansa agama. Akibatnya melahirkan situasi hukum yang serba multitafsir, konfliktual dan tidak taat asas yang pada ujungnya menciptakan tidak harmonisnya antara satu peraturan dan peraturan yang lain. Jenis penelitian ini adalah penelitian hukum normatif. Penelitian hukum normatif lebih mengutamakan studi pustaka (library research) dengan fokus kajiannya asas-asas hukum, sistematika hukum, sinkronisasi hukum dan sejarah hukum, penelitian ini juga bersifat deskriptif. Penelitian ini berkesimpulan bahwa, pertama, desentralisasi pengaturan kepariwisataan pasca Putusan Mahkamah Konstitusi Nomor 137/PUU-XIII/2015 memberikan kewenangan kepada pemerintahan daerah dalam membentuk produk hukum sangat luas. Kedua, Pemerintahan Daerah Provinsi Nusa Tenggara Barat kurang memperhatikan prinsip dan asas lex superior derogat legi inferiori dalam pembentukan Peraturan Daerah Provinsi Nusa Tenggara Barat Nomor 2 Tahun 2016 tentang Pariwisata Halal, hal ini terlihat dari materi yang diatur dalam Perda tersebut bernuansa agama, padahal agama adalah urusan absolut pemerintah pusat.

Abstract

Marriage is a very important institution in society. The existence of the institution is to legalize the legal relationship between a man and a woman. Marriage, according to Law Number 1 of 1974 Concerning Marriage and Islamic Law, not only seen from a purely formal aspect, but also from a religious and social aspect. In the religious aspect to determine the validity of marriage, while the formal aspect is related to administrative aspects, namely registration at the Office of Religious Affairs and civil registration. In the conception of Western civil law, marriage is seen in civil relations only. It means that the law does not interfere in ceremonies held by the church. The law only concerns "civil marriages", namely marriages that take place in the presence of a civil registry employee

Abstract

To apply the fundamentals of civil procedural law, when managing the parties' cases, the judge carries out mobile court practices in order to provide justice for the community, especially those who are legally illiterate/lawless and who are far from urban areas. The purpose of this research is first, to explain the application of the principles and principles of civil procedural law through mobile court practice; secondly, to analyze the implementation of the practice of the Giri Win religious court circuit court if it is connected to the principles and principles of civil procedural law. Research methods include empirical/socio legal research type (socio legal approach). The results of this research are that religious courts make a new breakthrough through the practice of mobile courts in accordance with PERMA No. 1 of 2015 concerning integrated services for circuit courts of district courts and religious courts/syar'iyyah courts in the context of issuing marriage certificates, marriage books and marriage certificates, and is in accordance with the principles and principles of civil procedural law as stated in HIR and Rbg. Meanwhile, the data collection technique in this research was carried out using several stages starting with secondary data collection in the form of primary legal materials and secondary legal materials related to mobile court practice which is linked to the principles and principles of civil procedural law. These legal materials were obtained through interviews with authorized officials, especially judges who handle family cases through mobile court practice, in addition to the litigants
