Abstract

AbstrakDalam pemborongan pekerjaan umum dilakukan oleh instansi pemerintah, direksi lazim ditunjuk dari instansi yang berwenang, biasanya dari instansi pekerjaan umum atas dasar penugasan ataupun perjajian kerja. Bagaimanakah implementasi dari asas keseimbangan dalam perjanjian jasa pemborongan, Bagaimanakah perlindungan hukum terhadap pemborong dan pemerintah sebagai pejabat pembuat komitmen dalam perjanjian pemborongan. Penelitian yang digunakan tergolong penelitian hukum normatif. Implementasi dari asas keseimbangan dalam perjanjian jasa pemborongan sangat diperlukan untuk mewujudkan perjanjian yang saling menguntungkan satu sama lain. Para pihak harus melaksanakan kewajibannya masing-masing, jika ada penyedia wanprestasi dalam hal terlambat menyelesaikan pekerjaan maka penyedia tersebut harus dikenakan denda yang akan dipotong dari pencairan dana proyek yang terakhir. apabila pihak pejabat pembuat komitmen melakukan wanprestasi diharapkan penyedia jasa konstruksi melakukan gugatan ke pengadilan negeri guna menuntut haknya yang belum pasti, tanpa harus mengkhawatirkan hal tersebut akan berpengaruh di kemudian hari Kata Kunci : Perlindungan, Implementasi, Perjanjian, Pemborongan AbstractIn chartering public works carried out by government agencies, directors are usually appointed from the competent authority, usually from public works agencies on the basis of assignments or work agreements. The research used is classified as normative legal research. The parties must carry out their respective obligations, if there is a default provider in terms of being late in completing the work, the provider must be subject to a fine which will be deducted from the last disbursement of project funds. if the official who makes the commitment commits a default, it is hoped that the construction service provider will file a lawsuit with the district court to claim their uncertain rights, without having to worry that this will have an effect in the future Keywords: Protection, Implementation, Agreement, Contracting

Abstract
