Abstract

Education is a human right. Everyone has the right to receive educational rights without restrictions. Everyone has the right to get the education and level of education they will attend. The government has an education equalization plan with the issuance of the Minister of Education and Culture Regulation No. 14 of 2018. The Minister of Education and Culture mentioned above applies a zoning system. The Minister of Education and Culture does not rule out the possibility of impacts for prospective students who wish to continue their education. The problem is how the impact of the PPDB zoning system on education rights in Kajen Subdistrict, Pekalongan Regency. The approach method used is a sociological juridical approach method. PPDB has positive and negative impacts. According to researchers, PPDB is not in accordance with the right to education of children, due to restrictions, the gap in the quality of learning with the same level of difficulty of the National Examination and the same curriculum that applies nationally. Abstract

The Indonesian government strives to address the surge in unemployment through innovation via the Indonesian Migrant Worker Protection Agency (BP2MI), which directs the placement of Indonesian Migrant Workers. However, the impact of becoming Indonesian Migrant Workers is not always positive, especially for those who are married, as they are susceptible to divorce. This study aims to understand the impact and Indonesia's role in dealing with the consequences of Indonesian Migrant Workers. A socio-legal approach is employed through field interviews and observations. Findings indicate that migrant labor arises from weak economy, low education, and limited job opportunities. The positives include better employment prospects, higher income, new skills, and long-term benefits through remittances. Conversely, negatives involve divorce issues due to distance, infidelity, financial mismanagement, and other relationships. Legal and social protections are necessary, along with awareness of family impacts. While the Law Number 7 of 1989 concerning Religious Courts regulates divorce, complexities persist, necessitating streamlined administration, such as power of attorney legalization without involving embassies, to avoid clandestine divorce and administrative intricacies.

Abstract

ABSTRAKKIP-K merupakan penanda penerima Program Indonesia Pintar yang diperuntukan bagi mahasiswa yang kurang mampu sesuai dengan Undang-Undang No 10 Tahun 2020 tentang Program Indonesia Pintar. Peminat yang dari tahun ke tahun semakin meningkat dan salah satu Universitas yang menjembatani program ini adalah Universitas Diponegoro. Namun, beberapa bulan terakhir terdapat unggahan yang menggemparkan dunia maya sehingga memunculkan cybercommumity dalam kasus ini. Kasus yang dimaksud adalah penyalahgunaan program KIP-K yang harusnya untuk mahasiswa yang kurang mampu namun pada lapangannya diterima oleh mahasiswa dalam kategori mampu yang dari itu dianggap oleh cybercommunity sebagai tindakan untuk hodonisme. Penyalahgunaan tersebut memunculkan suatu rumusan masalah dari model Undang-Undang yang dipakai, kuota disetiap tahunnya dari Kemendikbudristek maupun Universitas Diponegoro, dan pendekatan mazhab formal yang dipakai dalam kasus KIP-K salah sasaran tersebut dari reaksi cybercommunity. Penelitian ini juga menggunakan metode kualitatif karena bersumber dari beberapa data serta dokumen maupun buku yang menjadi landasannya. Selain itu, jenis yang digunakan dalam metode penelitian ini deskriptif kualitatif yakni menjabarkan sesuatu penelitian dari sunver yang dilakukan secara kualitatif atau dari data-data yang ada.Kata Kunci: KIP-K, Indonesia, Cybercommunity, Mazhab Formal

Abstract

A marriage is valid if it is carried out according to religion/belief and is registered, for those who are Muslim it is recorded at the Religious Affairs Office (KUA) while for non-Muslims it is recorded at the Civil Registration Office (Capil). Marriage registration as proof that the marriage has been carried out. If a person cannot prove their marriage, then the husband and wife concerned must submit a request for itsbat marriage to the Religious Court. Legal marriage also has legal consequences for the rights of the wife and children. So what about those whose parents' marriage dies? And what are the legal consequences of the application for itsbat marriage? In this research, the author uses empirical juridical research methods, with the object of research being the decision of the Kajen religious court number: 1059 Pdt.G/2022/PA Kjn and interviews with related parties. For marriages where the parents have passed away, you can still apply for a marriage itsbat to the Religious Court. Applying for a marriage certificate for parents who have died is a contentious matter. Not all applications for marriage itsbat applications will be granted, but it could be in the form of a lawsuit decision to be withdrawn, a decision to be dismissed, a verstek decision, a decision not to be accepted, and a decision to be rejected. The legal consequence of the decision being granted is that the Petitioner/Petitioners can apply for registration of the marriage of their deceased parents to the Religious Affairs Office (KUA) which is the jurisdiction of the Religious Court which examines, hears and decides the case; The applicant/petitioners can make a birth certificate stating the name of their biological father; The Applicant/Applicants have a civil relationship with their biological father and their biological father's family; The Petitioner/Petitioners have the right to their biological father's assets if their biological father dies. Meanwhile, for court decisions other than those that are granted, you do not have rights similar to the rights obtained for decisions that are granted.

Abstract

Genocide against civilians constitutes a severe infringement upon fundamental human rights, demanding a firm response from the international community. This crime not only causes immense suffering for its victims but also poses a serious threat to global stability. Legal accountabillity for perpetrators of genocide is a crucial aspect pertaining to the global framework of international law. In this articles evaluates the mechanisms of legal accountability, highlighting the effectiveness, challenges, and opportunities faced by Judicial bodies like the International Criminal Court (ICC) and temporary tribunals such as the ICTR and ICTY. By examining genocide incidents from the 20th and 21st centuries, the research highlights various shortcomings in the accountability framework, such as political interference, inconsistent legal enforcement, and insufficient international collaboration from member states in extraditing suspects. Legal and administrative obstacles, such as evidence collection and witness protection, also hinder judicial processes. Nevertheless, there are opportunities to enhance the system’s effectiveness, including strengthening the authority of international judicial bodies, improving inter-state coordination, and utilizing technology in genocide investigations. By addressing these shortcomings, the international legal system is expected to become more effective in upholding justice and preventing future acts of genocide.

Abstract

Human trafficking is a transnational crime that requires an effective legal approach. Indonesia and the United States of America have different legal systems in addressing human trafficking, particularly in regulation, law enforcement, and victim protection. Indonesia enforces Law No. 21 of 2007 on the Eradication of Human Trafficking, yet faces challenges in implementation due to weak inter-agency coordination and the involvement of corrupt officials. Meanwhile, the United States relies on the Trafficking Victims Protection Act (TVPA) of 2000, which provides a more comprehensive legal framework supported by strong law enforcement mechanisms. Although the United States of America legal system is more effective in investigating and prosecuting traffickers, strict immigration policies often deter victims from seeking help. In contrast, Indonesia struggles with weak law enforcement and inadequate victim protection measures. This study highlights the need for Indonesia to enhance coordination, transparency, and technological utilization in trafficking investigations, while the United States of America should consider revising its immigration policies to be more victim-friendly. Collaboration between both countries in information sharing and investigative strategies is essential to improving anti-trafficking efforts and strengthening victim protection.

Abstract

Tindak pidana penyebarluasan konten asusila merupakan salah satu jenis kejahatan yang semakin marak di era digital. Kejahatan ini tidak hanya mengancam privasi individu, tetapi juga dapat menimbulkan dampak sosial dan psikologis yang serius bagi korban. Dalam banyak kasus, ancaman tersebut dilakukan melalui internet atau aplikasi pesan yang memungkinkan pelaku untuk menyebarkan ancaman secara cepat lewat media massa tersebut. Undang-Undang Nomor 1 Tahun 1946 tentang Kitab Undang-Undang Hukum Pidana di Indonesia belum mengatur sanksi hukum terhadap kejahatan tersebut. Dalam menghadai tantangan perkembangan teknologi yang pesat, maka pemerintah membentuk Informasi dan Transaksi Elektronik mengatur tentang tindak pidana pengancaman melalui media elektronik yang bertujuan memberikan hukuman terhadap pelaku agar jera dan tidak mengulangi perbuatan yang dapat merugikan orang lain. Penelitian ini menggunakan metode yuridis normatif yaitu menggambarkan peristiwa seolah-olah sama dengan yang sebenarnya.

Abstract

Human trafficking is a serious and growing crime, including in Cambodia, which has become one of the countries vulnerable to this practice. This study aims to analyze the handling of human trafficking crimes in Cambodia from an international law perspective. Cambodia plays a significant role in the context of human trafficking due to its geographic location and socio-economic conditions, which influence the rate of human trafficking, whether for sexual exploitation, forced labor, or organ trafficking. This research uses a qualitative method with a literature review approach from various sources, including international conventions, reports from international organizations, and Cambodia's national regulations. The findings show that although Cambodia has adopted several laws to combat human trafficking, the implementation of these policies is often hindered by limited resources, corruption, and lack of cooperation between countries. Additionally, despite efforts from the international community, such as the Palermo Protocol, challenges in consistently applying the law remain a significant barrier. The study also finds that stricter law enforcement and better rehabilitation systems for victims are necessary to improve the situation. Therefore, further collaboration between the Cambodian government, international organizations, and non-governmental organizations is needed to comprehensively address this issue.

Abstract

The Senkaku Islands dispute involves Japan, China, and Taiwan on the basis of historical claims, international law, and strategic and economic interests. The strategic value of this region increases along with the potential of natural resources and the importance of maritime routes in the East China Sea. The main problems in this research are, first, how is the chronology of the Senkaku Islands dispute, and second, how is the analysis of international law on the sovereignty claims of each party. This research uses a qualitative approach with a descriptive-analytical method, which is based on a literature study of international legal documents, scientific journals, and various related official sources. The results show that Japan controls the Senkaku Islands de facto and strengthens its claim based on the principle of effectiveness. In contrast, China and Taiwan make claims based on the history of the Ming and Qing Dynasties but have no actual control over the territory. The dispute is further complicated by the United States' security support for Japan, as well as increased maritime and military patrol activities around the disputed area. Efforts to resolve the dispute through the International Court of Justice have been stymied by Japan's refusal to recognize the dispute and China's caution in taking the case to international law. Overall, the dispute has not only a legal dimension, but also reflects the sharp geopolitical competition in the East Asian region. Resolving this dispute requires a flexible diplomatic approach, given that formal legal channels are difficult to pursue. Multilateral dialog is the key to preventing conflict escalation that could threaten regional stability.

Abstract

The involvement of foreign companies in infrastructure development in Indonesia has increased rapidly over the last two decades, driven by growing needs for capital, technology, and advanced project management standards. However, the complexity of cross-jurisdictional issues and divergent interests among states, state-owned enterprises, investors, and contractors heightens the potential for intense legal disputes. This research examines the characteristics of disputes, their root causes, national and international regulatory frameworks, dispute resolution mechanisms, case patterns, and recommendations for strengthening project governance. Studies show that dispute roots extend beyond technical-contractual matters to include political factors, regulatory disharmony, information asymmetries, and weak contract administration. The research concludes that preventing disputes through appropriate risk allocation, regulatory transparency, and enhanced government capacity represents fundamental steps to mitigate the economic and political costs of high-value infrastructure disputes. The findings imply that, to enhance Indonesia’s attractiveness to foreign investors, policymakers should prioritize regulatory harmonization, institutionalize early dispute prevention mechanisms such as the Dispute Avoidance/Adjudication Board (DAAB), and streamline enforcement of international arbitration awards.
