Abstract

ABSTRAKKondisi Masyarakat pada Kelompok Kreditur Mekar dalam pengembangan UMKM di Desa Hapesong Kecamatan Batangtoru Kabupaten Tapanuli Selatan masih terbilang lemah. Minimnya keberanian para pedagang untuk mengajukan pinjaman ke bank karena pola pikir masyarakat selama ini bahwa prosedur dan persyaratan pinjaman kredit bank itu sulit serta minimnya pengetahuan tentang pengaturan keuangan dalam usaha. Tujuan dari pengabdian masyarakat ini adalah untuk memberikan pemahaman dan pengetahuan kepada masyarakat Hapesong Kecamatan Batangtoru Kabupaten Tapanuli Selatan tentang pentingnya kegiatan Pengembangan Kapasitas Usaha Program Mba Maya (Membinan Dan Memberdaya) Kepada Masyarakat Kelompok Kreditur Mekar Dalam Pengembangan Usaha Mikro Kecil dan Menengah (UMKM). Hasil dari kegiatan ini adalah peningkatan pemahaman masyarakat desa Hapesong Kecamatan Batangtoru Kabupaten Tapanuli Selatan tentang pentingnya pentingnya kegiatan Pengembangan Kapasitas Usaha Program Mba Maya (Membinan Dan Memberdaya) Kepada Masyarakat Kelompok Kreditur Mekar Dalam Pengembangan Usaha Mikro Kecil dan Menengah (UMKM). Kata Kunci: UMKM; pengembangan; Mba Maya ABSTRACTThe condition of the community in the Mekar Creditor Group in developing MSMEs in Hapesong Village, Batangtoru District, South Tapanuli Regency is still relatively weak. The lack of courage of traders to apply for loans to banks is due to the mindset of the public so far that bank credit loan procedures and requirements are difficult and lack of knowledge about financial arrangements in business. The purpose of this community service is to provide understanding and knowledge to the people of Hapesong, Batangtoru District, South Tapanuli Regency about the importance of Mba Maya Program (Building and Empowering) Business Capacity Building activities to the community of Mekar's creditor group in the development of Micro, Small and Medium Enterprises (MSMEs). The result of this activity was an increase in the understanding of the people of Hapesong village, Batangtoru District, South Tapanuli Regency about the importance of business capacity building activities for the Mba Maya Program (Building and Empowering) to the community of Mekar's creditor group in the development of Micro, Small and Medium Enterprises (MSMEs). Keyword: MSMEs; development; Mba Maya

Abstract

This study uses a normative legal research method. Normative legal research is examining law from an internal perspective with the object of research being legal norms. This study aims to determine the Urgency of Imposing the Death Penalty on Narcotics Dealers Reviewed from a Human Rights Perspective. Discussion Results: The death penalty is one of the main punishments regulated in Article 10 of the Criminal Code. Where, the death penalty is carried out by shooting the perpetrator dead as regulated in the law. The death penalty is a form of accountability for unlawful acts and this punishment is the highest punishment of all existing punishments and is regulated in the Criminal Code. The death penalty for drug dealers is something that must be done and expedited, because the circulation of narcotics is currently increasingly rampant and the impacts it causes greatly affect the lives of the nation's next generation, as well as security and order in the nation and state today and in the future. The consideration to impose the death penalty on drug dealers is more directed towards providing a deterrent effect on the perpetrators as well as law enforcement to create a sense of justice in society. The death penalty imposed under Indonesian law still has pros and cons in some circles of society and legal observers. That the death penalty is a violation of the Human Rights to life, because basically death belongs only to God Almighty. The death penalty when associated with the Human Rights Law, then clearly violates what is formulated in the Human Rights Law Articles 4 and 9. However, in contrast to what is stated in Articles 70 and 73, that there are restrictions set by law as long as the freedom to live does not violate the provisions set by law, such as violating public order, morality, morals, or the interests of the nation. While the criminal acts committed by drug dealers have clearly violated the provisions in question, the death penalty is actually a punishment that clearly does not violate the Human Rights Law.

Abstract

The choice of fines as an alternative punishment in a criminal act regulated in legislation, but rather an inseparable part of the substance or material of the legislation itself, where judges rarely impose fines on defendants, even though fines are also a solution for the application of criminal law, this has been regulated in Article 10 of the Criminal Code, one of which mentions fines as part of a criminal act. The problem in this study is how the judge's considerations in deciding criminal fines contained in criminal cases, and how to apply criminal sanctions to perpetrators of criminal acts contained in the decision of criminal case Number: 826 / Pid.C / 2024 / PN.Rap., and the method in this study is normative juridical, with a case study approach, by drawing deductive conclusions. The results of this study are the judge's considerations in deciding criminal cases of fines contained in criminal cases, in fact the judge in making a decision has carried out legal considerations, so the judge will first draw the trial facts and is a cumulative conclusion from the statements of witnesses, the defendant's statement, and evidence submitted and examined in court, which is oriented to the dimensions of the locus and tempus delicti of the crime committed, after the trial facts are stated, in the decision the judge will consider the elements (bestenddelen) of the crime that has been charged by the prosecutor or public prosecutor which has a correlation between the facts of the crime charged and the elements of the defendant's guilt that will be sentenced to a fine, and the judge in imposing a fine through his considerations is very limited by the rules of punishment, because the judge has the freedom to determine the type of punishment as contained in Article 10 of the Criminal Code, be it imprisonment, confinement and or a fine. and the application of criminal sanctions for the defendants as in the decision of case Number: 826 / Pid.C / 2024 / PN.Rap. where the judge sentenced the defendant by applying Article 364 of the Criminal Code by adjusting to Perma Number 02 of 2012 concerning the limits of criminal law adjusted in the Criminal Code so that in fact the judge found the defendant had legally and convincingly committed the crime of minor theft as referred to in the Perma and other laws so as to impose a fine on the defendant in the form of a fine in the form of money amounting to Rp. 200,000.00 (two hundred thousand rupiah) with the provision that if the defendants cannot pay it, it will be replaced with imprisonment for 7 (seven) days since the decision was read and has permanent legal force.
