Haryono No. 169 Malang e-mail: dhana.dani88@gmail.com Abstrak Penelitian ini bertujuan untuk mengetahui efektifitas, hambatan yang dihadapi dan upaya yang dilakukan Pemerintah Kota Kendari juga upaya hukum perlindungan konsumen dalam penerapan pasal 24 juncto pasal 8 ayat (3) Perda Kendari No. 3 Tahun 2015. Penelitian ini adalah penelitian yuridis empiris dengan pendekatan penelitian sosiologis. Berdasarkan hasil penelitian, penerapan pasal 24 jo. pasal 8 ayat (3) Perda Kendari No. 3 tahun 2015 belum efektif. Hambatan yang dihadapi oleh Pemerintah Kota Kendari, sebagai berikut : (a) Substansi Hukum, dalam Perda No. 3 tahun 2015 tentang retribusi izin tempat penjualan minuman beralkohol pasal 24 terdapat kekaburan norma karena tidak adanya penjelasan tentang Walikota dan sistem pengawasan terhadap minuman beralkohol tradisional. (b) Struktur hukum, penegakan hukum dan pengawasan tidak melakukan pengawasan dan pengendalian terhadap minuman beralkohol tradisional. (c) Budaya hukum, tradisi ini sudah dikenal dan menjadi kebiasaan yang hidup di masyarakat. Upaya yang dilakukan Pemerintah Kota Kendari dalam mengendalikan minuman pongasi ini, sebagai berikut : (1) Menerbitkan peraturan untuk membentuk tim pengendalian minuman beralkohol, (2) melakukan razia dan menghimbau masyarakat untuk memberikan informasi, (3) menaikkan biaya izin usaha tempat penjualan minuman beralkohol. Kata Kunci: efektivitas, minuman alkohol tradisional, pengawasan, distribusi, penjualan Abstract This research aims to find out the effectiveness, hampering factors, and efforts taken by the Local Government of Kendari in the implementation of Article 24 in conjunction with Article 8 paragraph (3) of Kendari Number 3 of 2015. This research employed empirical-juridical methods with a sociological approach. The research results indicate that the implementation of Article 24 in conjunction with Article 8 of Regional Regulation Number 3 of 2015 has not been effective. Moreover, several hindrances faced by the local government of Kendari city are (1), the substantive law, there has been the vagueness of norm in Article 24 the Regional Regulation Number 3 of 2015 concerning permit levy for a venue where alcoholic drinks are sold since there is no elucidation about Mayor and supervisory system of the traditional alcoholic drinks. There should be an additional elucidation to avert the likelihood of misinterpretation; (2) the legal structure, law enforcement and supervision, but the traditional alcoholic drinks are not appropriately supervised and controlled; (3) the legal culture, this tradition is common and becomes the habit in the community. Some measures have been taken by the local government of Kendari city such as (1) issuing a regulation that requires the formation of a supervisory team to control these traditional alcoholic drinks, (2) conducting an inspection or issuing a warning to the people to encourage them to take part in submitting information, (3) raising the cost of permit that allows people to set up alcoholic drink businesses.
