Abstract

This article describes the implementation of mursalah maslahat as an alternative source of lawIslam is related to transaction practices in the modern era that are increasingly flexible so that they canaccountable in sharia and can answer the challenges of the times. This researchusing qualitative methods and is a library research. Documentation data thatobtained from primary and secondary sources then reduced, verified and presented. ResultsThis research is: The perspective of the schools of jurisprudence, the pros and cons of the maslahah theory andthe comparison with qiyas, which turns out to only dwell in the realm of kaimat terms, becausein practice all schools use maslahah mursalah. Various forms of developmentIslamic economics, both institutional and product, shows that the role of maslahah mursalahvery significant. Like the trend of increasingly widespread Islamic banking, the emergence of Islamic credit cardswhich facilitates various transactions, updates in mudharabah transactions such as obligations,guarantee and profit sharing as profit sharing method. With the rapid development of Islamic economics,the use of maslahah mursalah will be more dominant and crucial so that Islamic law canadapt to every era and time

Abstract

Abstract. Law is a rule that regulates human life in everyday life, the purpose of law is to regulate, discipline people and create peace. Islamic law is a series of rules revealed by Allah SWT through the Al-Qur'an, Hadith and Sunnah of the Prophet, to guide humans on the right path, obeying Islamic law can create peace. Several legal principles in Islam: The principles of monotheism, justice, amar ma'ruf nahi munkar, freedom and liberty, equality, mutual help, tolerance. The source of this principle teaches us as Muslims not to discriminate between race, ethnicity and religion in doing good deeds.

Abstract

Islamic law is considered the law of God. That is, Islamic law is in the form of Allah's rules that aim to regulate the relationship between humans and God (worship) and the relationship between humans and society, the relationship between humans and daily human activities (muammalah). In Indonesia, Islamic law is adopted in the environment of Religious courts. A woman who has a case in a Religious Court needs to understand the history of its development and its legal sources. In this context, a woman may only litigate in the fields of marriage and inheritance. In this field, a woman does not find legal provisions based on equality between men and women. Instead, she finds legal provisions that are not yet appropriate. The Receptio Theory must continue to exist in the formation of new Indonesian law, because Islamic law is the main factor in the development of law in Indonesia in the form of Indonesian national law. The emergence of the Receptio A Contrario theory means that for Muslims, Islamic law applies, while customary law can apply if it does not conflict with Islamic law. In the development of Indonesian national law, religious law (Islamic Law) is the most dominant basis, where Islamic law plays a very important role in shaping the behavior of Indonesian people. Therefore, Islamic law is an absolute element for the development of Indonesian national law.

Abstract

This research is motivated by the numerous household problems that hinder the realization of a sakinah (tranquil and harmonious) family. These issues include the imbalance and lack of harmony in the mutual relationship between husband and wife, insufficient communication leading to misunderstandings, unstable family economic conditions, external conflicts from the social environment, the loss of family commitment resulting in violence and quarrels, the disappearance of mutual respect that leads to divorce, and various internal and external conflicts that negatively impact family harmony. These problems are viewed as diseases of the heart that cannot be resolved merely through intellectual intelligence but require a spiritual approach through the purification and cleansing of the heart in order to avoid sinful behaviors that can contaminate and close the heart from the truth. The objective of this research is to understand the concept of a sakinah family according to Islamic law and to explore the idea of a sakinah household from the perspective of Sympathetic Sufism within the Idrisiyyah Tariqa. The method used for data observation is qualitative research, as it is relevant to the subject matter, requiring observation, interviews, and document analysis. The approach used is a Theological-Normative one, where Sufi teachings are seen as the esoteric dimension of Islam. The results of this study reveal the presence of serenity, peace, harmony, and love experienced by each family member. The values of Sympathetic Sufism in shaping a sakinah household, particularly within the Idrisiyyah Tariqa, are maintained through consistent spiritual struggle (mujahadah) and discipline (riyadhah). It involves constantly purifying the heart and adorning it with praiseworthy traits. The heart is to be adorned with the attribute of Al-Faqru or spiritual poverty, which in Sufi terminology means a soul that constantly feels in need of Allah SWT. sabr, tawakkul, zuhud, shukr, ridha, and tawadhu.
