Abstract

Child Protection in Indonesian Islamic Family Law. This article examines the provisions of Indonesian marriage laws concerning a child's maintenance rights, the sources of child neglect, and the necessary solutions to safeguard these entitlements. From the conducted study, the author delineates 5 (five) solutions to ensure and protect a child's caregiving rights, namely:(1) Enhancing judges' awareness of the significance of child protection issues.(2) Continual socialization of marriage regulations within the community.(3) The Supreme Court of the Republic of Indonesia issuing a directive mandating judges in Religious Courts to consistently utilize ex officio rights in resolving divorce cases. (4) Spouses voluntarily purchasing education insurance for children or as per state directives.(5) Mandatory registration for Pre-Marital and/or Bridal Courses (Suscatim) for all engaged individuals to learn to navigate family life together.
