Abstract

Objective: This article aims to discuss moral boundaries in the Law According to Von Savigny and moral limits in the Law According to the Legal Concept Principles of “Barenti Lako Syara’ Tradition, syara barenti ko kitabullah”Methodology: The methodology used in this study is normative juridical research. This study uses a philosophical approach by exploring the philosophical basis of Law by linking legal science with the concept of customary Law.Findings: Von Savigny does not limit the moral meaning in Law whether good or bad, wrong or right, depends on morals in the habits of society that are not separate from morals and facts. Meanwhile, tau samawa based on the legal concept of “barenti lako syara’ tradition, sara barenti lako Kitabullah” means moral boundaries in Law, morals can be accepted into Law after the validation process with the book.Application of the Study: Customary Law has an indicator of moral constraints, so that applicable Law in general can also have indicators of moral limitations as customary Law.Originality/Novelty: Syara’ becomes a verification tool for morals in the customary Law of tau samawa and the book of Allah becomes a moral detector in the syara’ Keywords: Moral, Law, tradition, syara’

Abstract

Receptie theory of Snouck Hurgonje's thought requires that Islam be valid if it has been perceived by customary law. The perception of a starting point between Islamic law and customary law was mediated by Syahrial Abbas with his split bamboo theory. However, the concept of "Adat Barenti Lako Syara’, Syara Barenti Lako Kitabullah" requires that customary law be valid or accepted if it has been validated by Islamic law. Employing a normative method and a philosophical approach, this paper examined the effect of the receptie theory on the legal concept of "Barenti Lako Syara', Syara Barenti Lako Kitabullah". This paper concluded that the receptie theory could not influence the legal concept of "Adat Barenti Lako Syara’, Syara Barenti Lako Kitabullah" because customary law can be applied if it has been verified by Islamic law.

Abstract

Penelitian ini dilatarbelakangi adanya dualisme bentuk penetapan pengakuan masyarakat adat di Indonesia. Penelitian ini menggunakan metode normative dengan pendekatan konseptual dan pendekatan peraturan perundang-undangan dengan tujuan penelitian ini adalah agar menjadi referensi pemegang kebijakan dalam membuat regulasi agar memperhatikan asas-asas hokum. Hasil penelitian bahwa ada dualisme kewenangan Pemerintah Daerah dalam memberikan pengakuan dan perlindungan masyarakat adat baik yang bersifat pengaturan maupun bersifat penetapan seperti yang diatur dalam Pasal 67 (3) Undang-Undang Nomor 41 Tahun 1999 Tentang Kehutanan Jo. Peraturan Menteri Agraria/Kepala Badan Pertanahan Nasional Nomor 5 Tahun 1999 tentang Pedoman Penyelesaian Permasalahan Tanah Ulayat Masyarakat Hukum Adat Jo. Permenhut Nomor 62 /Menhut-II/2013 Tentang Perubahan Atas Peraturan Menteri Kehutanan Nomor P.44/Menhut-II/2012 Tentang Pengukuhan Kawasan Hutan menghendaki dibuatnya Peraturan Daerah untuk melaksanakan lebih lanjut mengenai penetapan hak ulayat kesatuan masyarakat hukum adat. Menteri Dalam Negeri di sisi yang lain, mengeluarkan Permendagri Nomor 52 Tahun 2014 Tentang Pedoman Pengakuan dan Perlindungan Hak-Hak Masyarakat Hukum Adat. Dalam Permendagri tersebut, ditegaskan bahwa Kepala Daerah mempunyai kewenangan untuk menetapkan keberadaan masyarakat hukum adat melalui Surat Keputusan Bupati, seperti sebagaimana dijelaskan dalam pasal 6 ayat (2) Bupati/Walikota melakukan penetapan pengakuan dan perlindungan masyarakat hukum adat berdasarkan rekomendasi panitia masyarakat hukum adat dengan Surat Keputusan Kepala Daerah. Dualisme bentuk pengakuan dan perlindungan masyarakat adat terlihat ada konflik antar peraturan perundangan-undangan sehingga akan menimbulkan akibat hukum yang mana wilayah adat berupa hutan adat tidak diakui oleh pihak kehutanan apabila masyarakat adat dikukuhkan dengan Surat Keputusan Kepala Daerah karena amanat Undang-Undang kehutanan Masyarakat adat harus dikukuhkan dengan Peraturan Daerah.

Abstract

The election of village heads is a form of popular sovereignty. However, the village head election process cannot be separated from disputes, so a dispute resolution scheme is needed that provides justice. This research is normative research with a conceptual approach, statutory approach and case approach. The case that is the focus of this research is the case of the interim village head election in Labangka Satu Village, Labangka District, Sumbawa Regency, where in the village head election process the village head election supervisory committee was not appointed as the institution that resolves village head election disputes. In the absence of a supervisory committee for Village head elections, parties who object to the results of the Village head election report to the Regent, but regulations at the regional level do not regulate the Regent's authority to resolve disputes over Village head elections. The results of this research are (1) Settlement of interim village election disputes in Sumbawa Regency is the same as the mechanism for resolving village election disputes simultaneously through a supervisory committee but is not regulated in regional regulations or other regulations regarding the Regent's obligation to resolve village election disputes as mandated in article 37 paragraph (6) of the Law. number 6 of 2014 concerning Villages. (2) The legal consequences if the Regent appoints an elected village head without first resolving the dispute is that the regent's decision is null and void because resolving the dispute is an obligation which is an absolute requirement in the village head election process. The conclusion of this research shows that legally there is no regulated scheme for resolving disputes over interim village elections so that the legal consequences if the Regent appoints an elected village head without first resolving the village election dispute is that the Sumbawa Regent's decision is null and void. This research suggests (1) the Regional Government of Sumbawa Regency needs to regulate the obligations of the Regent to resolve village head election disputes, (2) the Regent of Sumbawa can form a special team to resolve village election disputes to carry out its obligations to resolve village election disputes.
