Abstract

pisuke. This study aims to find out or analyze how the pisuke tradition in traditional marriages of Lombok people in Ranggagata Village, Praya Barat Daya District, Central Lombok Regency, Islamic Law perspective. This research uses qualitative methods and qualitative descriptive design. Data collection was carried out using field observation techniques, interviews, and documentation. Data analysis techniques used include data collection, data presentation, and data verification. Analysis of research data, the results of the research are as follows: 1) Pisuke tradition processes, starting to involve village heads and local traditional leaders as representatives of both parties to discuss the number of pisuke that will be distributed by the male side for the female side, in determining the number of pisuke there are certain categories that support the high or low number of pisuke, namely the education level of women and the economic level of men but things This is not absolute as a reference because it goes back to the deliberative decision of both parties in determining the number of pisuke. 2) Pisuke is a custom or habit that is carried out for generations. Pisuke is one of the customs used for the settlement of Lombok customary nikhan, although pisuke is not contained in Islamic law but pisuke has become a tradition that is considered good to be applied among the community because it does not violate nash or syara If it is related to living, in this case pisuke has no relationship at all with living because there are several points that make it cannot be equated with living, That is the gift of pisuke which is sometimes given after the contract and before the contract

Abstract

Traditional wedding receptions in Indonesia are very diverse, it feels incomplete if a wedding celebration does not use the traditions or customs that apply in the area, such as the Sebarin Dui' tradition that applies in the middle of Pramuka Island Community, Seribu Islands Regency, Jakarta. This unique tradition is very interesting to discuss because the Sebarin Dui' tradition originates from a mixture of customs from other regions which then merged into the traditions and customs of the Thousand Islands Community. This research aims to find out how the Sebarin Dui' tradition is at the traditional wedding of the Thousand Islands Community, and to find out how Islamic Law views the Sebarin Dui' tradition at the traditional wedding reception of the Thousand Islands Community. This research uses qualitative or descriptive research, with data collection techniques using field research, namely through observation and interviews with research subjects or informants. The results of this research are that the Sebarin Dui' tradition at community wedding receptions on Pramuka Island, Panggang Island Village, Seribu Islands Regency, Jakarta is the Sebarin Dui' tradition which aims to express gratitude and share good fortune with local residents and to entertain the guests present. So the Sebarin Dui' tradition carried out by the people of Pramuka Island, Panggang Island Village, Seribu Islands Regency has fulfilled the requirements to become a tradition or 'Sahih Urf' (does not violate Islamic law or Sharia law).

Abstract

Dalam tata kehidupan masyarakat Bali, upacara adat mepamit merupakan salah satu upacara memohon izin atau berpamitan kepada para leluhur karena ingin berpindah agama atau keluar dari agama Hindu. Prosesi ini akan dilakukan oleh kedua belah pihak calon mempelai laki-laki dan calon mempelai perempuan. Prosesi ini akan saksikan oleh tokoh adat, mangku adat, dan masyarakat sekitar. Dari latar belakang diatas peneli ingin meneliti (1) Bagaimana upacara adat mepamit dalam perkawinan adat masyarakat Bali di Desa Lembongan Kecamatan Nusa Penida Kabupaten Klungkung, (2) Bagaimana perspektif maqasid al-shari’ah Jasser Auda terhadap upacara adat mepamit dalam perkawinan adat masyarakat Bali di Desa Lembongan Kecamatan Nusa Penida Kabupaten Klungkung. metode penelitian menggunakan metode pendekatan studi kasus dan menggunakan metode kualitatif interpretative atau penelitian lapangan untuk menelaah studi kasus dan fenomena-fenomena yang ada di masyarakat sekitar. Peneliti juga menggunakan teknik wawancara secara langsung dalam pengumpulan data. Hasil dari penelitian ditemukan bahwa upacara adat mepamit adalah upacara meminta izin kepada leluhur untuk pindah agama atau keluar dari agama Hindu yang mana upacara tersebut akan dilakukan juga oleh calon mempelai laki-laki yang beragama Islam. Ditinjau dari maqasid al-shari’ah Jasser Auda teori sistem haruslah bersifat universal agar hukum Islam bisa diterima kapan saja dengan tujuan untuk kebaikan bersama.
