Abstract

Penelitian jni bertujuan mengidentifikasi pengaruh garar terhadap keabsahan akad dan menganalisis beberapa potensi garar dalam akad jual beli kontemporer. Penelitian ini menggunakan pendekatan kualitatif. Metode analisis yang digunakan adalah deskriptif kualitatif yang menganalisis jenis garar berdasarkan pendapat ulama Hanafiah, Malikiah, Syafiiah, dan Hanabilah lalu mendiskusikan pengaruhnya terhadap kesahihan akad termasuk di dalamnya akad kontemporer. Penelitian ini berkesimpulan bahwa ada tiga jenis garar dan garar kasir adalah yang paling utama, karena bisa merugikan salah seorang dan sangat  berpotensi menimbulkan konflik di masa depan. Oleh karena itu garar kasir sangat memungkinkan menyebabkan kerusakan akad. Berdasarkan pendapat ulama Hanafiah, akad yang rusak masih dianggap sah. Sementara itu berdasarkan jumhur ulama, karena tidak ada perbedaan yang pasti antara akad yang rusak dan yang ditangguhkan, maka akad yang rusak dikategorikan tidak sah. Penelitian ini pula menunjukkan bahwa ada potensi garar dalam akad jual beli online dan asuransi.

Abstract

The validity of khiar rukyat (inspection option) according to Imam Abu Hanifah is considered absolute. However, the khiar rukyat he proposed is similar to bai al-gharar. The purpose of this research is to understand khiar rukyat according to Imam Abu Hanifah, the legal evidence, and its implementation in contemporary commercial contracts. This research falls under the category of normative Islamic legal research within the realm of doctrine (thought) using a conceptual approach. The data collection technique involves document analysis. The analysis utilizes prescriptive analysis of primary sources from the Hanafi school of thought, such as "Al-Mabsut" by al-Sarkhasi, "Tuhfat al-Fuqaha" by Alaudin al-Samarqandi, "Badai al-Sanai fi Tartib al-Sanai" by Alaudin al-Kasani, and others. This is supplemented by a review of previous research. The research findings indicate that the concept of khiar rukyat according to Imam Abu Hanifah is flexible because the connotation of rukyat is not only interpreted by observing the object of goods but also connotes that the object of goods can be touched and smelled. The evidence used by Imam Abu Hanifah regarding khiar rukyat includes hadith narrations from al-Baihaki from Makhul and from al-Daruqutni from Abu Hurairah. Additionally, there is a hadith narration from al-Baihaki from Abu Mulaikah concerning the right of khiar rukyat for the buyer only. Furthermore, the implementation of khiar rukyat in contemporary commercial contracts, such as online buying and selling, is difficult to execute due to customary practices (urf)Keywords: Khiar rukyat, Imam Abu Hanifah, Legal Evidence, Implementation.

Abstract

In the context of Industry 4.0, the practice of religious moderation in preaching has emerged as a pivotal necessity. This study explores the ways in which digital technologies are reshaping the landscape of religious discourse and the responsibilities of religious leaders. With the proliferation of social media platforms and online communities, preachers have unprecedented opportunities to convey messages of tolerance, understanding, and inclusivity to diverse audiences. The research highlights the significant role of digital tools in countering extremist ideologies that often find a foothold online. By utilizing innovative communication strategies, religious leaders can engage with followers in meaningful ways, fostering an environment that promotes interfaith dialogue and cooperation. This approach not only strengthens community bonds but also mitigates the risks associated with radicalization. Moreover, the study emphasizes the importance of adaptability in religious teachings to meet the demands of a rapidly changing digital landscape. By integrating modern technology into their preaching methods, religious figures can enhance their outreach and relevance, ensuring that messages of moderation resonate with younger generations. Ultimately, the findings suggest that embracing technological advancements is vital for promoting religious moderation in contemporary society.

Abstract

The legal maxims of the ba'i contract are inductive Islamic legal reasoning, so their implementation has a static and dynamic character. Apart from al-Arabi, attention to two characters in one theme of fiqh (Islamic Jurisprudence) rules is rarely discussed by Islamic jurists. It is one of the reasons for the failure to dynamize the theory and practice of Islamic economic law, resulting in various criticisms. This research discussed the legal maxims of the ba'i contract of al-Arabi in Al-Masalik fi Syarh Muwatta Malik and their relevance to contemporary muamalah maliah issues to provide complete answers to various criticisms in contemporary Islamic legal theory and practice. The research method used normative Islamic law with a conceptual, philosophical, and historical approach. The data collection technique used a document study of Ibn al-Arabi's work "Al-Masalik fi Syarh Muwatta Malik" related to the fiqh rule on the Ba'i contract. The analysis technique was prescriptive analysis with logic and inductive legal reasoning. The research results show the ten fiqh rules of the ba'i contract developed by al-Arabi that have static characters, namely usury, garar or jahalah, consuming wealth in vanity, and deceit (gasysi). Besides, those with dynamic characters are urf, emergency, and maqasid al-syariah/sadd al-zariah. The rule fiqh is relevant to contemporary muamalah maliah contract issues, such as cashback systems, dropship systems in online buying and selling, stock sales, pre-order systems, and electronic transactions (e-money). Therefore, these rules can be used as an ‘illat (ratio legis) for resolving problems in the contemporary muamalah maliah contract.

Abstract

This research aims to determine the existence and urgency of induction in the methodology of Islamic law of the four schools of jurisprudence and its relevance to the transformation of Sharia economic law in Indonesia. This study falls under the category of normative Islamic legal research using a conceptual and philosophical approach. Primary data is sourced from the foundational books of Islamic jurisprudence of the four schools: "al-Mahsul" by Al-Razi (Shafi'i), "Syarh Tanqih al-Fusul" and "al-Furuq" by Al-Qurafi (Maliki), "Taqrib al-Usul" by Ibn Juzay (Hanbali), and "Al-Muwafaqat" by Al-Shatibi (Maliki). The data is analyzed comparatively and prescriptively using inductive logic and reasoning. The research demonstrates that the existence of induction in the methodology of Islamic law among the four schools is most prominent as Islamic legal inference (istidlal). The urgency of induction as a methodology in Islamic law is relevant to efforts to transform Sharia economic law within Indonesian law. There are four principles of jurisprudence as products of Islamic thought influenced by inductive logic, which legitimize the fatwas of the National Sharia Board of the Indonesian Ulema Council (DSN-MUI), such as Fatwa No. 135/DSN-MUI/V/2020 on Shares, Fatwa No. 116/DSN-MUI/IX/2017 on Sharia Electronic Money, Law No. 41 of 2004 on Endowments, Article 16 paragraph (3) concerning endowed property such as money, and Supreme Court Regulation No. 2 of 2008 on the Compilation of Sharia Economic Law, Articles 112-115 (Book II) regulating Bai al-Wafa. This research can enhance understanding of inductive logic in Islamic law within Islamic higher education institutions as well as for Sharia Courts and the fatwas of the DSN-MUI.
