Abstract

This research addresses the legal framework of business contracts under the Civil Code, focusing on the effectiveness of such contracts in business activities and the consequences of defaults by parties involved. The urgency of this study arises from the increasing complexity and frequency of legal disputes in business transactions, particularly regarding contract breaches. The primary objective is to analyze the legal effectiveness of the Civil Code in resolving defaults and protecting the rights of the involved parties, as well as to evaluate its role in enhancing legal certainty and business trust. The research employs a qualitative descriptive methodology, utilizing document analysis to assess relevant legal provisions and case studies. The findings reveal that the Civil Code provides clear guidelines for the interpretation of contracts, ensuring legal certainty and protection for parties. However, challenges such as cost and time limitations in dispute resolution are evident. In conclusion, the Civil Code plays a crucial role in business contract enforcement, although improvements in flexibility and efficiency are recommended to further support business growth and legal fairness.

Abstract

This study aims to analyze the regulation and enforcement of unfair business competition law in Indonesia and to examine its conformity with the principles of Islamic law. The research employs a normative legal method using statutory and conceptual approaches, involving an analysis of Law No. 5 of 1999, relevant legal literature, and Islamic legal sources. The findings indicate that Indonesian positive law and Islamic law share substantial alignment in prohibiting market manipulation and economic exploitation. Moreover, Islamic law provides a more comprehensive ethical foundation through the prohibition of ihtikar, tadlis, and najasy, emphasizing moral and ethical values in economic activities. Therefore, the integration of Islamic business ethics can serve as a moral complement to positive legal regulations and enhance the effectiveness of competition law enforcement, contributing to the creation of a fair, transparent, and socially just business environment.

Abstract

Penelitian ini membahas perlindungan hukum yang diberikan kepada nasabah bank sebagai korban tindak pidana penipuan di Indonesia. Penipuan adalah kejahatan yang umum terjadi dan menimbulkan risiko signifikan bagi nasabah bank serta merusak kepercayaan terhadap sistem perbankan. Tujuan utama dari makalah ini adalah untuk menganalisis kerangka hukum yang ada dan mengidentifikasi langkah-langkah yang diperlukan untuk memperkuat perlindungan hukum bagi nasabah bank yang menjadi korban penipuan. Menggunakan metode penelitian hukum normatif, makalah ini mengumpulkan data dari berbagai undang-undang dan peraturan terkait perlindungan nasabah bank dan penipuan di Indonesia. Temuan menunjukkan bahwa meskipun terdapat kerangka hukum untuk melindungi nasabah bank, beberapa tantangan menghambat perlindungan yang efektif. Tantangan utama meliputi rendahnya kesadaran nasabah tentang risiko penipuan, kompleksitas proses hukum, dan sumber daya yang terbatas untuk penegakan hukum. Oleh karena itu, dibutuhkan upaya bersama untuk meningkatkan kesadaran nasabah tentang risiko penipuan, menyederhanakan prosedur hukum, dan mendorong kolaborasi antara bank, lembaga penegak hukum, dan regulator. Makalah ini mengusulkan langkah-langkah konkret untuk memperkuat perlindungan hukum bagi nasabah bank, termasuk meningkatkan pendidikan nasabah dan literasi keuangan, memperbaiki pengawasan dan regulasi terhadap lembaga keuangan, serta memperluas akses keadilan bagi korban penipuan. Melalui makalah ini, diharapkan dapat memberikan pemahaman yang lebih baik tentang isu perlindungan hukum yang khusus ditujukan kepada nasabah bank yang sering menjadi korban kegiatan penipuan di Indonesia. Selain itu, diharapkan dapat memberikan wawasan berharga bagi pemangku kepentingan terkait dalam meningkatkan jaminan hukum bagi nasabah bank.

Abstract

This research aims to analyze legal aspects related to material and immaterial compensation lawsuits for damage to goods in the delivery process by cargo companies and the falsification of insurance payment receipts. This problem is important because it concerns legal protection for consumers and the responsibility of business actors in goods transportation activities. The research method used is quantitative with a legislative approach and a conceptual approach, supported by a literature study of various primary and secondary legal sources. The results of the study show that cargo companies are in principle responsible for damage to goods that occur during the delivery process, unless it can be proven that there are compelling circumstances. However, in the case of falsification of proof of insurance payment, there is an element of unlawful acts that strengthen the basis of a lawsuit for the aggrieved party. Material damages can be sued based on actual losses suffered, while immaterial damages relate to non-economic losses such as inconvenience and psychological losses. In addition, such acts of counterfeiting have the potential to have criminal legal consequences that have an impact on civil liability. In conclusion, legal protection for shipping service users needs to be strengthened through the enforcement of cargo company liability and supervision of insurance practices in the transportation of goods. This research is expected to contribute to the development of civil law, especially in the aspects of consumer accountability and protection
