Abstract

Bung Hatta university has hundreds of lecturers and education personnel as well as thousands of students that can be used as wakif (the one who donated) waqf money. The results of the waqf money are used the scholarship as one of the efforts to increase the number of students and helps its operational costs to the future. This research using qualitative research methods. The source of the research data consists of primary data and secondary data. Data collection techniques conducted interviews by the respondents. And this study was analyzed by descriptive qualitative. The results of the research that the University of Bung Hatta has the potential developed waqf money (cash waqf) because it has the lecturers and education personnel as much as 446 people (99,33 %) are muslims also get a salary and fixed allowances each month of the Education Foundation of Bung Hatta, the student and his parents are muslims as much as 7.525 people (98,14%). In addition, the support of the Chairman of the Education Foundation of Bung Hatta to realize the potential of the above with a policy.

Abstract

The Surabaya District Court judge has granted the application for a permit to register an interfaith marriage between Rizal Adikara (Islam) and Eka Debora Sidauruk (Christian with decision Number: 916/Pdt.P/2022/PN.Sby. Previously, the registration of their marriage was rejected by the Population and Civil Registry Office. Civil Registry.The purpose of this research is to analyze judges' considerations in determining permission to register interfaith marriages.This type of research is library research, using a juridical normative approach.The source of data comes from primary legal materials, namely statutory regulations and legal materials secondary such as legal opinion/doctrine/theories from legal literature, research results, journals, papers, theses and websites related to research.This research is descriptive analytical in nature.Results of the research are that District Court judges have legitimized the registration of interfaith marriages with the consideration that The Marriage Law and the Law on Population Administration have provided space for the Court to render decisions and citizens have the right to defend their religious beliefs when they want to build a household. This judge has used a judicial activism approach in order to guarantee the freedom of citizens as protected by the constitution. Then this decision only granted permission to register religious marriages, not permission to carry out marriages because the applicant parties were married before the Court's decision

Abstract

Maqashid al-syariah is a number of good goals that Islamic sharia wants to achieve by allowing or prohibiting something. This research aims to analyze the benefits of converting a conventional bank operational system to a sharia bank from a sharia maqasid perspective. This research uses a type of library research and is qualitative in nature. Then the research data was analyzed descriptively-qualitatively in order to obtain a complete picture of the problems studied. The research results show that the urgency of converting conventional banks to sharia banks is because a number of ulama believe that interest is the same as usury and is haram, so Muslims must die. The benefits of converting a conventional bank into a sharia bank are in order to realize the maqashid of sharia, namely maintenance, religion, soul, mind, property and descendants.

Abstract

In 2022 there are 20 marriages in Batu Gajah Village, 11 or 55 percent of marriages are not registered and 45 percent of marriages are registered. According to the applicable laws and regulations, a marriage is valid if it is registered. Marriages for people who are Muslim are registered at the Office of Religious Affairs and for non-Muslims at the Civil Registry Office. This study aims to analyze the factors that cause marriages not to be recorded in Nagari Batu Gajah. This study uses an empirical juridical approach, which is a research approach to secondary data first and then continues to conduct primary data research in the field. Primary data was obtained through interviews with a Ninik Mamak as a community figure and 10 undocumented marriages. Then the empirical data were analyzed descriptively and qualitatively. Based on the results of the study, the factors causing marriages not to be registered in Nagari Batu Gajah were age, cost, pregnancy out of wedlock, access to the KUA office that was far away, polygamy, understanding of the rules, elopement, pregnancy out of wedlock and did not get permission from the Ninik Mamak. Then the way to deal with unregistered marriages is to socialize to the community by the Office of Religious Affairs regarding the marriage law and improve road access to the Office of Religious Affairs and the community must comply with local customary norms.Keywords: Marriage, Unregistered Marriage, Religious Affairs Office
