Abstract

Anak merupakan pilar utama dalam membangun masa depan suatu bangsa sehingga harus dilindungi dengan berbagai aturan yang menjamin hak serta kesejahteraan mereka. Namun, pada kenyataannya, anak-anak juga dapat terlibat dalam perilaku yang melanggar hukum. Salah satunya adalah tindakan penganiayaan yang berakibat pada kematian yang terjadi dalam Putusan Pengadilan Negeri Jakarta Pusat Nomor 9/Pid.Sus Anak/2021/PN Jkt. Dalam perkara tersebut, Majelis Hakim menetapkan hukuman kumulatif berupa pidana penjara dan denda. Hal ini menimbulkan pertanyaan mengingat apabila suatu tindakan pidana yang diancam pidana kumulatif berupa penjara dan denda maka pidana denda diganti dengan pelatihan kerja. Penelitian ini menggunakan pendekatan yuridis normatif yang berfokus pada studi dan analisis literatur melalui teknik penelusuran data library research. Berdasarkan hasil penelitian mengenai Putusan Pengadilan Negeri Jakarta Pusat Nomor 9/Pid.Sus Anak/2021/PN Jkt.Pst, terdapat kecenderungan dimana putusan tersebut tidak sepenuhnya mengikuti ketentuan yang terdapat dalam Undang-Undang Sistem Peradilan Pidana Anak. Majelis Hakim tidak memperhatikan ketentuan Pasal 71 ayat (3) Undang-Undang Sistem Peradilan Pidana Anak yang mengamanatkan bahwa jika suatu tindakan melanggar hukum yang diancam dengan hukuman pidana penjara dan denda, maka hukuman denda tersebut harus diganti dengan pelatihan kerja. Sebab Majelis Hakim dalam perkara ini menetapkan hukuman kumulatif berupa pidana penjara dan denda, meskipun sudah jelas diatur bahwa jika terdakwa tidak mampu membayar denda, maka hukuman tersebut harus diganti dengan pelatihan kerja. Ketika seorang anak dijatuhi hukuman denda, hal ini tidak selaras dengan tujuan rehabilitasi yang seharusnya menjadi fokus dalam sistem peradilan anak, dimana pemidanaan seharusnya disertai dengan upaya pemulihan agar anak dapat kembali diintegrasikan ke dalam masyarakat.

Abstract

Recently, the public was shocked by the news of a data breach involving 240 million entries from the permanent voter list. This data was leaked from the official website of the General Elections Commission of the Republic of Indonesia by a hacker using the pseudonym “Jimbo”. The data was sold online on BreachForums for USD 74,000. This incident has raised serious concerns among the public due to its broad potential impact on the confidentiality of citizens' personal information and has prompted new questions regarding the accountability of the General Elections Commission of the Republic of Indonesia as the election organizer. In this research, the researcher employs a normative juridical approach by reviewing secondary data collected through library research and using a case and regulatory approach. Based on the research findings, the protection of personal data by the General Elections Commission of the Republic of Indonesia is not yet optimal, as the regulations held by the General Elections Commission of the Republic of Indonesia are only internally applicable and do not have the legal strength equivalent to laws. These the General Elections Commission of the Republic of Indonesia regulations are only applicable to regional head elections and general elections. Furthermore, it is necessary to enhance literacy on the importance of data so that all members of the General Elections Commission of the Republic of Indonesia understand the mechanisms of data processing, inputting, and processing. The General Elections Commission of the Republic of Indonesia members must determine the types of data that can be published and those that should not be exposed to the public, thus enabling the General Elections Commission of the Republic of Indonesia to fulfill its obligations to protect and be accountable for the data obtained from the public.

Abstract

Issues related to employment seem to have become an issue that is always hotly discussed, especially related to the widespread phenomenon of unilateral termination of employment by employers who then invited the author to discuss the decision 76/Pdt.Sus-PHI/2023/PN Jkt Pst, where PKWTT workers did not receive their wages at all from September 2016 to February 2021 and were terminated without official information. This issue is interesting to discuss, especially regarding the form of protection for PKWTT who experience Termination of Employment Relations and reflecting this with the judge's consideration of the a quo decision in terms of the Employment Law which in its development was revised with the Job Creation Law and gave birth to implementing regulations PP Number 35 of 2021 and PP Number 36 of 2021. In this research, the author uses normative juridical research methods using literature studies and a legal approach. The research results show that PKWTT who experience layoffs are entitled to severance pay, UPMK, and separation pay as well as other benefits required by the government such as THR. PKWTT who feel aggrieved also have the right to submit non-litigation legal remedies as a priority for settlement, then if this is not achieved, they can submit litigation legal remedies. In essence, the judge's considerations in handing down the a quo decision were appropriate in referring to the formulation of severance pay calculations in accordance with applicable regulations. The government needs to aggressively continue to carry out outreach regarding labor regulations and routinely open communication spaces with workers and employers to then adjust existing labor regulations.
