Abstract

Semakin pentingnya arti tanah bagi kehidupan manusia sekarang ini menyebabkan makin meningkatnya potensi untuk timbulnya konflik- konflik atau sengketa pertanahan, untuk mencegah atau paling tidak mengurangi potensi konflik atau sengketa tersebut dibutuhkan perangkat hukum dan sistem administrasi pertanahan yang teratur dan tertata rapi. Karenanya diharuskan pemindahan hak atas tanah agar bisa didaftar harus dibuktikan dengan akta PPAT. Sebagai akta otentik akta PPAT haruslah memenuhi tata cara pembuatan akta PPAT sebagaimana yang ditentukan oleh undang-undang dan peraturan-peraturan lainnya. Pembuatan akta yang tidak sesuai dengan tata cara pembuatan akta PPAT dapat menimbulkan risiko bagi kepastian hak atas tanah yang timbul atau tercatat atas dasar akta tersebut. Berdasarkan latar belakang tersebut makatesis ini penulis beri judul Akibat Hukum Dari Pembuatan Akta Jual Beli Tanah Yang Tidak Sesuai Dengan Tata Cara Pembuatan Akta PPAT. Tujuan penelitian adalah untuk mengetahui bentuk-bentuk, faktor- faktor penyebab dan akibat hukum dari pembuatan akta jual beli tanah yang tidak sesuai dengan tata cara pembuatan akta PPAT. Dipakai metode pendekatan yuridis empiris dengan spesifikasi penelitian preskriptif dan sumber data yang digunakan adalah data primer dan data sekunder. Pengumpulan datanya dilakukan dengan melakukan penelitian kepustakaan dan penelitian lapangan kemudian setelah data selesai dianalisis ditarik kesimpulandengan meggunakan metode berfikir induktif. Berdasarkan hasil penelitian ditemukan bahwa akibat hukum dari pembuatan akta jual beli tanah yang tidak sesuai dengan tata cara pembuatan akta PPAT adalah PPAT dapat diberhentikan dengan tidak hormat, akta PPAT terdegradasi kekuatan pembuktiannya menjadi akta di bawah tangan dan pihak ketiga dapat memanfaatkan hal ini untuk kepentingannya

Abstract

The problem of narcotics in Indonesia is still something that is urgent and complex. In the last decade this problem has become widespread. Evidenced by the significant increase in the number of narcotics abusers or addicts, as the disclosure of narcotics crime cases increases, the pattern is increasingly diverse and the syndicate network is increasingly massive. The Indonesian people, and even the world community, in general, are currently facing a very worrying situation due to the widespread illegal use of various types of narcotics. This concern is getting sharpened due to the rampant illicit trafficking of narcotics which has spread to all levels of society, including among the younger generation. This will greatly affect the life of the nation and state in the future. The behavior of some teenagers who have clearly ignored the values, norms and laws that apply in people's lives is one of the reasons for the rampant use of narcotics among the younger generation. In everyday life in the midst of society there are still many teenagers who still abuse narcotics.
