Abstract

ABSTRAK Tesis ini membahas tentang pertanggungjawaban Pengurus Koperasi Kredit Bina Masyarakat (BIMA) Sintang dalam pengembangan jasa keuangan guna menghadapi persaingan bisnis dalam upaya mensejahterakan anggotanya. Di samping itu juga mempunyai tujuan yaitu untuk mengungkapkan dan menganalisis sebab-sebab Pengurus Koperasi Kredit Bina Masyarakat (BIMA) Sintang sebagai pengelola jasa keuangan belum mendatangkan kesejahteraan bagi anggotanya secara maksimal, kendala-kendala dan solusi yang timbul dalam melakukan pengelolaan Koperasi Kredit Bina Masyarakat (BIMA) Sintang sebagai jasa keuangan, serta pertanggungjawaban Pengurus Koperasi Kredit Bina Masyarakat (BIMA) Sintang sebagai pengelola jasa keuangan dalam mengembangkan usahanya guna menghadapi persaingan bisnis. Melalui studi kepustakaan dengan menggunakan metode penelitian yuridis normatif diperoleh kesimpulan, bahwa penyebab pengelolaan Koperasi Kredit Bina Masyarakat (BIMA) Sintang sebagai jasa keuangan belum mendatangkan kesejahteraan bagi anggotanya secara maksimal dikarenakan menurunnya pembagian Sisa Hasil Usaha (SHU) bagi Anggota Koperasi Kredit BIMA Sintang. Pembagian Sisa Hasil Usaha (SHU) bagi Anggota Koperasi Kredit BIMA Sintang pada tahun 2015 dan tahun 2016 mengalami penurunan yang sangat signifikan atau tidak mencapai target yang telah ditentukan. Pembagian Sisa Hasil Usaha (SHU) bagi Anggota Koperasi Kredit BIMA Sintang pada tahun 2015 hanya sebesar Rp. 1.654.836.928,- (28,08%) dari yang ditargetkan sebesar Rp. 5.892.671.535,-. Sedangkan pembagian Sisa Hasil Usaha (SHU) bagi Anggota Koperasi Kredit BIMA Sintang pada tahun 2016 hanya sebesar Rp. 640.155.767,- (24,09%) dari yang ditargetkan sebesar Rp. 2.656.957.820,-. Tolak ukur kesejahteraan anggota koperasi kredit tergantung dari pembagian Sisa Hasil Usaha (SHU) melalui target yang ditentukan, apabila mencapai target maka semakin besar pembagian Sisa Hasil Usaha (SHU) yang diperoleh anggotanya dan otomatis dapat mensejahterakan anggota dari Koperasi Kredit BIMA Sintang. Kendalakendala yang timbul dan solusi dalam melakukan pengelolaan Koperasi Kredit Bina Masyarakat (BIMA) Sintang sebagai pengelola jasa keuangan adalah: (a) Kinerja Pengurus Koperasi Kredit Bina Masyarakat (BIMA) Sintang yang masih asal-asalan; (b) Pengurus Koperasi Kredit Bina Masyarakat (BIMA) Sintang memang belum mampu melakukan pemasaran dan persiapan persediaan produk-produk dalam cara pengelolaan lembaga yang ada; (c) Penyelenggaraan Rapat Anggota Tahunan (RAT) koperasi masih belum dapat dilakukan secara tepat waktu; (d) Kinerja antar Manajer yang masih mengedepankan sikap ego sektoral; (e) Minimnya penyelenggaraan pelatihan dan bimbingan teknis (bimtek) bagi Pengurus maupun anggota koperasi kredit; (f) Anggota belum menyadari hak dan kewajiban mereka sebagai anggota; dan (g) Kurangnya partisipasi para anggota dalam kegiatan organisasi koperasi. Berkaitan dengan solusi solusi dalam melakukan pengelolaan Koperasi Kredit Bina Masyarakat (BIMA) Sintang sebagai pengelola jasa keuangan, antara lain: (a) Melakukan mekanisme pemilihan pengurus yang profesional; (b) Meningkatkan kualitas Sumber Daya Manusia (SDM); (c) Meningkatkan koordinasi antara pengurus dan manajer; (d) Meningkatkan penyelenggaraan pelatihan dan bimbingan teknis (bimtek) bagi Pengurus maupun anggota koperasi kredit; dan (e) Meningkatkan partisipasi para anggota dalam kegiatan organisasi koperasi kredit. Pertanggungjawaban Pengurus Koperasi Kredit Bina Masyarakat (BIMA) Sintang sebagai pengelola jasa keuangan dalam mengembangkan usahanya guna menghadapi persaingan bisnis, maka Pengurus Koperasi Kredit Bina Masyarakat (BIMA) Sintang sudah melaksanakan Rapat Anggota Tahunan (RAT). Namun dalam pelaksanaan Rapat Anggota Tahunan (RAT) pada tahun 2015 dan tahun 2016 sebagian besar anggota Koperasi Kredit Bina Masyarakat (BIMA) Sintang tidak hadir. Hal ini disebabkan karena domisili dari anggota Koperasi Kredit Bina Masyarakat (BIMA) Sintang yang jauh, kurang pedulinya para anggota Koperasi Kredit Bina Masyarakat (BIMA) Sintang dalam mengikuti Rapat Anggota Tahunan (RAT) dan Pengurus hanya mengundang para perwakilan anggota saja. Dengan demikian, pertanggungjawaban Pengurus Koperasi Kredit Bina Masyarakat (BIMA) Sintang sebagai pengelola jasa keuangan dalam Rapat Anggota Tahunan (RAT) hanya di hadapan beberapa perwakilan anggota saja.                 ABSTRACT This thesis discusses the accountability of the Sintang Community Branch Manager (BIMA) Sintang in the development of financial services in order to face business competition in the effort of prospering its members. In addition it also has a purpose that is to disclose and analyze the causes of Sintang Community Credit Co-operative (BIMA) as a manager of financial services has not brought prosperity to its members maximally, constraints and solutions that arise in managing Credit Cooperatives Community Development (Bina Kredit Bina Masyarakat) BIMA) Sintang as a financial service, as well as the responsibility of the Sintang Community Branch Manager (BIMA) as a financial services manager in developing its business to face business competition. Through literature study using normative juridical research method, it is concluded that the cause of management of Sintang Community Bina Cooperative (BIMA) as a financial service has not brought welfare to its members maximally due to the declining share of Business Result (SHU) for BIMA Sintang Credit Cooperative Members. Shares Remaining of Business Result (SHU) for BIMA Sintang Credit Cooperative Members in 2015 and 2016 experienced a significant decrease or did not reach the target that has been determined. Shares Remaining of Business Result (SHU) for BIMA Sintang Credit Cooperative Members in 2015 is only Rp. 1.654.836.928,- (28.08%) of the targeted Rp. 5.892.671.535,-. While the division of Business Result (SHU) for BIMA Sintang Credit Cooperative Members in 2016 is only Rp. 640.155.767,- (24.09%) of the targeted Rp. 2.656.957.820,-. The measure of the welfare of the members of the credit cooperative depends on the distribution of Time Outcome of the Business (SHU) through the specified target, when it reaches the target, the greater the share of Business Result (SHU) obtained by its members and automatically able to welfare the members of the BIMA Sintang Credit Cooperative. The obstacles that arise and the solution in managing the Sintang Community Credit Cooperative (BIMA) Sintang as the manager of financial services are: (a) The performance of the Sintang Community Balance Cooperative (BIMA) which is still at random; (b) Sintang Community Branch Manager (BIMA) has not been able to do the marketing and preparation of inventory of products in the way the management of existing institutions; (c) The holding of the Annual Meeting of Members (RAT) of the cooperative is still not timely; (d) Performance among Managers who still prioritize sectoral ego attitudes; (e) lack of training and technical guidance (bimtek) for the Board or members of credit cooperatives; (f) Members are not aware of their rights and obligations as members; And (g) Lack of participation of members in the activities of cooperative organizations. Related to solution solution in managing Sintang Community Balance Cooperative (BIMA) as manager of financial services, among others: (a) To conduct professional management election mechanism; (b) Improving the quality of Human Resources (HR); (c) Improve coordination between management and managers; (d) Improving training and technical guidance (bimtek) for the Board and members of credit cooperatives; And (e) Increasing the participation of members in the activities of credit cooperative organizations. Accountability of Sintang Community Branch Manager (BIMA) Sintang as a financial services manager in developing its business in order to face business competition, the Sintang Community Credit Cooperative Board (BIMA) Sintang has conducted Annual Members Meeting (RAT). However, in the implementation of the Annual Members Meeting (RAT) in 2015 and 2016 most members of Koperasi Kredit Bina Masyarakat (BIMA) Sintang did not attend. This is due to the domicile of the distant Sintang Community Branch (BIMA) members, the lack of care of the members of the Sintang Community Branch Cooperative (BIMA) in following the Annual Members Meeting (RAT) and the Board only invites representatives of the members only. Thus, the responsibility of the Sintang Community Branch Manager (BIMA) as the manager of financial services in the Annual Members Meeting (RAT) only in the presence of several representative members only.

Abstract

In steering a cooperative-work or business affiliation in the field of lease a building, whereas for the case of this research is a house store, it is certainly every single business actor should create rules of the game as outlined in the form of an agreement between the parties covered in order to evade legal problems that occur in the future. The parties must construct an agreement used as a legal base which obeyed by the parties covered. The approach used in this research is a Sociological Juridical Method. The approach is defined as problem analysis through legal research of factual facts in institution concerned or toward the community which covered as problems handled in the research. This research is designed in form of descriptive analysis which identifies the whole systematic object of the research problem. Furthermore, if the agreement that have been agreed upon by the parties concerned are not properly applied, as a consequences one of the parties can prosecute for compensation due to carelessness or it may also clarify in legalterms one of the parties defaults on the lease agreements that have been mutually approved. As result, In the implementation of the rental agreement of rent a house store between a lessor and the lessee on Sido Mulyo avenue, Nanga Pinoh District, Melawi Regency, it is implemented properly with the phases accomplish by the parties as follows: arising fromnegotiationstosigningtheleaseagreement letter and it should be as responsibilities of the all parties in accomplishing it properly as decided on the the agrreement of rent a house store on the sidomulyo avenue, Nanga pinoh district, Melawi regency. Moreover, in each cancellation of the agreement, all the risk of the lease will be as a responsibility of the lessee if it is canceled. Thus, the agreement must be implemented in good trust on the rights and obligations attached for each party. It also the contents of the agreement must be regulated complete with presence of sanctions. If there is negligence in adhering to the contents of the agreement, a legal formal should provide an appropriate settlement. Along with it, the design of the contents of the agreement is accomplished in a meticulous and decisive. Thus, the responsibilities of the parties toward the rights and obligations of each party immediately accomplished.

Abstract

Earth is god’s gift of earth. The Land is a vital for human being as sources of human welfare, life and happiness. The rupiah rose to Rp.9,310/9,329 per dollar in the Jakarta interbank spot market on Tuesday morning as investors bought the local unit. It creates a wide range of needs both in individual and in group, both for offices or institutions, provide fertility in the economic needs of food and clothing. People should live in land and building. Therefor, land ownership is important aspect as means to create an ownership of land certificate. the legality of land ownership is necessary in the light of a valid evidence. The only way to prove land ownership of every society is using land certificate. This study is designed in the form of juridical sociological approach. The nature of this study is a descriptive analysis that describes thoroughly the systematic objects of the subject matter. Abstract

Transporting services is a vital means or activity in people’s lives. It shows a variety of factors. Transportation services often require treaties, such as transportation agreements. Agreements are used asa basis for the morning laws of those who have committed themselves to the alliance. Losing a passenger item was not immediately a passenger responsibility. In the transport of tickets that became the basis for the implementation of the agreement. Of course there are rights and obligations to be noticed and properly fulfilled. In this study, researchers used normative-empirical law research methods. This was necessary if the scientific writing did not deviate from the matter at hand. The research methodology is the study of frameworks carrying out research. The company is expected to be able to minimize damage or accidents to the delivery by inspecting the delivery beforehand in order to make sure that the delivery is safe and comfortable.
