Abstract

Challenges in establishing customary forests in Indonesia are caused by complicated bureaucracy, lack of synchronization between central and local bureaucracy, and the politics of citizen struggle using the identity of indigenous peoples. In the face of changes to Areal Penggunaan Lain (APL), there needs to be a careful approach and close collaboration between the local government, the central government, and indigenous peoples to achieve a balance between economic development, environmental preservation, and the rights of indigenous peoples. The research specification used in this research is descriptive analytical, which seeks to describe or describe events and events without conducting hypotheses and statistical calculations. Also normative juridical, namely research based on Ministerial regulations, books, and decrees of the Regent of North Tapanuli. The central and local governments have taken significant steps in recognizing and protecting the traditional and cultural rights of indigenous peoples. Changes in the Areal Penggunaan Lain (APL) can have serious impacts, requiring a cautious approach and close collaboration to maintain a balance between economic development, environmental preservation and the rights of indigenous peoples. Suggestions are made that local and central governments improve collaboration, concretely empower indigenous peoples, and integrate sustainable measures in policies to achieve a sustainable balance.

Abstract

Pertanggungjawaban peserta Pendidikan dokter spesialis dalam pelayanan Kesehatan menimbulkan kompleksitas dalam Undang-undang Kesehatan. Meskipun mendukung pendidikan medis memunculkan ketidakjelasan dalam tanggungjawab hukum, pengawasan praktik medis dan penyelesaian sengketa termasuk melalui majelis disiplin profesi. Digunakan pendekatan kualitatif dengan analisis data dari bahan hukum seperti konsep, teori, doktrin dan pendapat ahli. Dalam sistem penyelesaian sengketa medis, Undang-undang Kesehatan menimbulkan kompleksitas karena ketentuan mengenai kerjasama rumah sakit pendidikan dan perguruan tinggi dalam pendidikan medis serta tanggungjawab peserta didik dalam praktik medis berpotensi membingungkan dalam proses penyelesaian sengketa. Seperti kasus Siska Makatey menunjukkan pentingnya pengawasan ketat untuk mencegah malpraktik oleh peserta didik diluar kompetensinya

Abstract

Mediation as an alternative dispute resolution outside the court has its own uniqueness in resolving various customary disputes. Generally, when a dispute arises between parties, the community tends to be more familiar with resolving disputes through customary means, or what they refer to as mediation. Mediation is a term commonly used by the community when disputes occur. Thus, mediation as an alternative dispute resolution holds a unique position among the people, particularly in Simalungun Regency, in resolving various customary disputes without the involvement of the courts. This article will further discuss the uniqueness of mediation in resolving customary disputes, the advantages and disadvantages of applying mediation as an alternative dispute resolution outside the court in Simalungun Regency. The importance of establishing mediation as an effective method for alternative dispute resolution outside the court for various customary disputes lies in its easy procedures, active involvement of the disputing parties, and respect for customary values and norms in maintaining social harmony and prioritizing win-win solutions. Moreover, mediation not only provides a practical and efficient solution but also helps to strengthen social relationships and preserve local cultural continuity. Therefore, mediation is considered a suitable and beneficial means for resolving customary disputes, offering a more familial approach compared to court resolution processes.

Abstract

Legal certainty is a fundamental element in the legal system that aims to create justice, order, and predictability in society. However, in practice, the existence of the Electronic Information and Transaction Law (UU ITE) often causes polemics due to multiple interpretations and inconsistent application. This study aims to examine the aspects of legal certainty in the ITE Law by highlighting articles that are in the public spotlight, such as related to insult and defamation, as well as their technical implementation in the field. The research method used is juridical-normative with an analytical approach to the text of the law and juridical-empirical through case studies and interviews with legal practitioners. The results of the study show that legal uncertainty in the ITE Law is caused by the lack of harmonization between the ITE Law and other laws, weak public understanding of regulations, and uneven implementation by law enforcement officials. To create better legal certainty, revisions to articles with multiple interpretations, capacity building for law enforcement officials, and comprehensive public education about the ITE Law are needed. This research is expected to make a theoretical contribution to the development of legal studies in Indonesia as well as a basis for recommendations for policymakers in improving the quality of legislation.
