Abstract

The problem raised in this research is how the open general election system is regulated in Indonesia, and what is the vote counting mechanism in the open general election system to obtain legislative seats based on the general election law? This research uses a normative legal research method or what is often called a library legal research method, which is a method used in legal research which is carried out by examining library materials related to written legal norms. This aims to discover the legal principles of written positive law in public. Based on the results of research that has been carried out, the regulation of the open general election system in Indonesia is regulated in the provisions of Article 168 paragraph (2) of Law Number 7 of 2017 concerning General Elections, while the mechanism for counting votes in the open general election system to obtain legislative seats is based on law. General elections are regulated in the provisions of Article 415 paragraphs 2 and 3 of Law Number 7 of 2017 concerning General Elections. The public is expected to play a role and participate in general elections because it is an important indicator for the success of general elections. As well as for the government to more aggressively carry out political outreach or education to the community, this aims to help the community become more skilled and knowledgeable about the political system, rights and obligations and ways for the community to participate in the political process. Keywords: Open General Election System, General Election Law Abstrak Permasalahan yang diangkat dalam penelitian ini yaitu tentang bagaimanakah pengaturan sistem pemilihan umum terbuka di Indonesia, serta bagaimanakah mekanisme penghitungan suara dalam sistem pemilihan umum terbuka untuk memperoleh kursi legislatif berdasarkan undang-undang pemilihan umum? Penelitian ini menggunakan metode penelitian hukum normatif atau yang sering disebut dengan metode penelitian hukum kepustakaan yang merupakan metode yang dipergunakan dalam penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka yang berkaitan dengan norma hukum tertulis, hal tersebut bertujuan untuk menemukan asas hukum dari hukum positif tertulis di masyarakat. Berdasarkan hasil penelitian yang telah dilaksanakan, Pengaturan sistem pemilihan umum terbuka di Indonesia diatur dalam ketentuan Pasal 168 ayat (2) Undang-Undang Nomor 7 tahun 2017 tentang Pemilihan Umum sedangkan mekanisme penghitungan suara dalam sistem pemilihan umum terbuka untuk memperoleh kursi legislatif berdasarkan undang-undang pemilihan umum diatur dalam ketentuan Pasal 415 ayat 2 dan 3 Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum. Masyarakat diharapakan dapat berperan dan berpartisipasi dalam pemilihan umum karena menjadi salah satu indikator penting bagi keberhasilan pemilihan umum. Serta kepada pemerintah agar lebih gencar melakukan sosialisasi-sosialisasi atau pendidikan politik kepada masyarakat, hal tersebut bertujuan untuk membantu masyarakat agar menjadi lebih terampil dan berpengetahuan luas tentang sistem politik, hak dan kewajiban dan cara-cara masyarakat berpartisipasi dalam proses politik. Abstract

The development of digital technology in the Industry 4.0 and Society 5.0 eras has brought significant changes in the interaction patterns between businesses and consumers. One of the rapidly developing innovations is the use of Artificial Intelligence (AI) and chatbots as a means of customer service in various sectors, including banking, e-commerce, and financial technology (fintech). Although this technology provides convenience and efficiency, its use also poses legal risks, such as misinformation, personal data leaks, and material and immaterial losses experienced by consumers. This study aims to analyze legal protection for consumers who interact with chatbot- and AI-based services through a normative legal approach with literature studies and analysis of laws and regulations. Some of the regulations reviewed include Law Number 8 of 1999 concerning Consumer Protection (UUPK), Law Number 11 of 2008 concerning Electronic Information and Transactions (UU ITE) in conjunction with Law Number 19 of 2016 Law No. 1 of 2024, Financial Services Authority (OJK) Regulation No. 6/POJK.07/2022, and the New Criminal Code (Law No. 1 of 2023). Research results show that current legal protection for consumers is still partial and does not specifically regulate the use of AI. AI is viewed merely as a tool, so responsibility remains with the business actors or corporations that operate it. The principles of strict liability and vicarious liability apply, where business actors remain fully responsible for losses incurred, even if errors occur in the AI system. Consumers have the right to compensation, personal data protection, and access to dispute resolution mechanisms, whether through negotiation, the Financial Services Authority (BPSK), the Financial Services Authority (OJK), or the courts. Specific regulations on AI are needed that address ethics, security, and clear accountability mechanisms for business actors. Thus, the development of AI technology can continue to support digital business innovation without neglecting consumer rights and protection in Indonesia's digital ecosystem.
