Abstract

Social media has become part important in life modern society , but also gives rise to challenge law new , like pollution Name good , speech hatred , and the spread of information lie . This research aim analyze level awareness and compliance law public in use of social media in Indonesia and role law as tool controller social . The approach used is juridical-sociological , which studies law No only as rule written but also as phenomenon social . Abstract

Indonesia holds a democratic celebration, namely general elections, every four years. Indonesia held its first simultaneous general elections in 2019. The 2019 Simultaneous General Elections apparently had an impact. health to the ad hoc committee and supervisors assigned to the Simultaneous General Election, as many as 840 member KPPS die world And 11,239 member KPPS experiencing pain. Many member KPPS Which die world due to height burden Work During the 2019 Simultaneous General Elections, excessive working hours resulted in mass fatigue, leading to unavoidable health impacts, including illness and even death. Legislation governing elections and regional elections currently does not regulate health insurance for ad hoc committee members and supervisors. The election organizers have proposed health insurance for ad hoc committee members and supervisors, but it has not yet been approved. Currently, the Ministry of Finance issued Letter No. S-647/MK.02/2022, dated August 5, 2022, concerning Other Input Cost Units (SBML) for General Election Stages. And Stages Election, However Letter Ministry Finance Law Number S-647/MK.02/2022 focuses solely on occupational accident insurance, while occupational accident insurance regulates a different subject than health insurance. This study aims to propose a concept regarding health insurance for the committee and supervisors of the 2024 simultaneous general and regional head elections, supported by a normative legal research method with a sociological approach.

Abstract

This study aims to examine and analyze the legal responsibilities of the Curator in settlement of the assets of bankrupt debtors against the workers' creditors' claims at PT Persero . The issues raised is b how implementation not quite enough answer Curator in bankruptcy moment carry out settlement treasure debtor bankruptcy of PT Persero against bill creditors workers to achieve justice . Research This use method research socio- legal which is approach interdisciplinary combine all aspect perspective discipline science , science social and science law , to be a approach single . Abstract

Wiretapping is one of the most effective methods for uncovering crimes, especially those committed in an organized, transnational manner, and utilizing information technology. However, on the other hand, wiretapping is a form of restriction on the right to privacy because it is carried out secretly and allows the state to gain complete access to a person's private communications. The regulation of wiretapping in the New Criminal Procedure Code (KUHAP) through Article 136 is an important development in Indonesian criminal procedure law because it is the first time that wiretapping is recognized as a coercive measure in general criminal procedure law. However, this regulation is still vague and leaves further regulation to separate laws, thus giving rise to various legal problems. This study aims to analyze the legal problems of the regulation of wiretapping in the New KUHAP and formulate a concept for an ideal regulation of wiretapping based on the principles of due process of law and protection of the right to privacy. This study uses a normative legal research method with a statutory approach, a conceptual approach, and a comparative approach. The research results show that Article 136 of the New Criminal Procedure Code still leaves gaps in norms regarding procedures, licensing mechanisms, oversight, the use of wiretapping results, the destruction of irrelevant information, and compensation mechanisms. Therefore, comprehensive wiretapping regulations are needed to achieve a balance between law enforcement and human rights protection.

Abstract

Outsourcing refers to work that is not directly related to a company's core business activities, where such work is delegated to another party or company. Generally, outsourcing can be carried out when an agreement has been signed between the labor service provider and the labor service user. However, in practice, outsourcing often leads to issues that disadvantage outsourced workers or laborers. There are companies that fail to uphold workers' rights as specified by labor laws and regulations, thus neglecting their obligations to provide all the rights of outsourced employees. As a result, even though legal provisions regulate various aspects of employment relations, they do not guarantee that companies will comply with these regulations. Problems arising from outsourcing include job insecurity and wage discrimination, both of which clearly violate the provisions set forth in labor legislation. In addition to violating the law, the issues of employment uncertainty and wage discrimination also have severe economic consequences for outsourced workers, as they struggle to achieve a decent standard of living.

Abstract

This study is motivated by the increasing number of traffic accidents caused by vehicle technical failures , primarily due to the ineffective implementation of periodic vehicle inspections . Periodic testing serves as a strategic legal instrument to ensure the roadworthiness of freight vehicles in terms of safety , operational efficiency , and environmental protection . However , the effectiveness of such regulations remains problematic , both in terms of normative quality and practical implementation . This research aims to analyze the legal framework governing periodic testing of freight vehicles and to evaluate its regulatory quality based on the standards of good legislation . This study employs a normative juridical method with statutory and conceptual approaches . The findings indicate that although several regulations exist , fundamental weaknesses remain in procedural provisions , supervision , authority , and sanctions that failed to provide deterrent effects . The novelty of this research lies in its comprehensive evaluation of legal norms using clarity of law and adequacy indicators , linked to legal effectiveness in practice . This study concludes that legal policy reform is required through stronger sanction mechanisms , improved supervisory systems , and institutional harmonization to enhance compliance and reduce traffic accidents .

Abstract

Digital technology has created non-conventional employment through platform applications, exemplified by platform-based drivers in Indonesia. Their relationship with App Provider Companies is governed by partnership agreements, resulting in unclear legal status and limited labour protection. This study examines the legal vacuum that leaves drivers without social security and workers’ rights, despite fulfilling employment elements; work, wages, and control. Using a juridical normative approach, it finds that partnership agreements may disguise employment to evade employer obligations. The UK Uber case supports recognising drivers as workers entitled to protection. Special regulations are needed to formalise their status and safeguard rights and welfare in the digital economy.

Abstract

Penelitian ini membahas bagaimana pengelolaan sumber daya manusia dilakukan pada usaha konveksi kecil, dengan mengambil contoh Elhasna Hijab Indonesia di Kabupaten Bandung. Penelitian dilakukan secara kualitatif melalui wawancara, observasi, dan pengumpulan dokumen. Hasil penelitian menunjukkan bahwa perekrutan tenaga kerja masih mengandalkan kerabat dan lingkungan sekitar, sementara pelatihan dilakukan secara mandiri tanpa dukungan dari pihak luar. Pembagian kerja sudah cukup jelas, namun tetap fleksibel sesuai kebutuhan produksi. Sistem pengupahan menggunakan dua cara, yaitu borongan untuk bagian tertentu dan gaji bulanan untuk bagian lainnya. Tantangan utama muncul dalam hal kedisiplinan pekerja karena sebagian besar berasal dari keluarga dan tetangga. Untuk mengatasinya, pemilik usaha menerapkan sistem peringatan serta penghargaan. Dari sisi hukum ketenagakerjaan, praktik yang dijalankan umumnya sudah sesuai aturan, meskipun masih ada hal-hal yang perlu diperhatikan seperti standar upah minimum dan pengaturan jam kerja. Penelitian ini menekankan bahwa dukungan pelatihan serta kebijakan pemerintah sangat dibutuhkan agar pengelolaan tenaga kerja di konveksi mikro bisa lebih profesional.

Abstract

Penelitian ini menganalisis legal consciousness atau kesadaran hukum publik terhadap putusan pengadilan pidana melalui media daring TikTok. Pendekatan yuridis empiris dengan metode kualitatif deskriptif digunakan untuk memahami bagaimana masyarakat, khususnya generasi Z, membentuk persepsi hukum secara kolektif di ruang digital. Data penelitian diperoleh melalui observasi daring terhadap konten TikTok yang membahas putusan pengadilan pidana serta studi literatur terarah terhadap jurnal nasional yang relevan dengan kesadaran hukum, media sosial, dan opini publik. Data dianalisis melalui analisis konten dengan tahapan reduksi data, kategorisasi tema, dan interpretasi sosiologis. Hasil penelitian menunjukkan bahwa TikTok berperan signifikan dalam membentuk opini publik melalui video pendek, kolom komentar, dan interaksi sosial antar pengguna. Fenomena “No Viral No Justice” memperlihatkan bahwa viralitas mempengaruhi persepsi publik terhadap legitimasi putusan pengadilan. Namun demikian, penggunaan TikTok sebagai ruang diskursus hukum juga menghadirkan tantangan, seperti penyebaran hoaks, simplifikasi hukum, dan dominasi bias emosional dalam penilaian publik. Penelitian ini menegaskan bahwa partisipasi publik di TikTok mencerminkan evolusi kesadaran hukum dalam masyarakat modern yang dipengaruhi oleh interaksi digital, moral kolektif, dan budaya partisipatif.

Abstract

Indonesia secara konstitusional menegaskan dirinya sebagai negara hukum yang menjunjung kepastian hukum, keadilan, dan perlindungan hak asasi manusia. Namun, realitas sosial menunjukkan bahwa banyak komunitas masih beroperasi dengan pola hubungan komunal bercirikan solidaritas mekanis sebagaimana dijelaskan Émile Durkheim. Dalam masyarakat dengan solidaritas mekanis, nilai adat, ikatan kolektif, dan otoritas tokoh lokal seringkali lebih dominan dibandingkan mekanisme hukum formal. Akibatnya, penyelesaian persoalan melalui adat, musyawarah damai, tekanan kelompok terhadap korban atau pelaku, hingga tindakan main hakim sendiri masih menjadi praktik umum yang menggeser peran institusi hukum negara. Dominasi mekanisme komunal ini menimbulkan dilema serius: di satu sisi memperkuat identitas budaya lokal, namun di sisi lain berpotensi melemahkan supremasi hukum, mengabaikan hak individu, dan menciptakan ketidakpastian hukum. Ketegangan antara keadilan sosial versi komunitas dan keadilan legal versi negara memperlihatkan adanya ketidaksinkronan struktural antara ideal negara hukum dan realitas masyarakat komunal. Oleh karena itu, kajian terhadap solidaritas mekanis menjadi penting untuk memahami tantangan dalam mewujudkan negara hukum yang efektif di Indonesia.
