Abstract

This paper aims to examine the presidential threshold in relation to the simultaneous general elections 2019. After the decision of the Constitutional Court Number 14/PUU-XI/ 2013 which mandates the general election simultaneously raises the pros and cons of setting the presidential threshold. In the constitutional perspective, using or not using the presidential threshold is not contrary to the constitution, because the presidential threshold is an open legal policy of the legislator. The legislators need to rethink the provisions of the presidential threshold especially in relation to the simultaneous elections, taking into account the advantages and disadvantages of applying or abolishing the presidential threshold, in order for the purpose of strengthening the presidential system to be achieved. The existence of simultaneous general elections has substantially eliminated the provisions of the presidential threshold, so the threshold requirement to nominate the President and Vice President becomes irrelevant. However, if the legislators demand presidential threshold, the middle path that can be selected is to apply the presidential threshold by using the legislative election 2014 with a record of institutionalizing the coalition.

Abstract

In the system of government of the Republic of Indonesia, the President holds the highest governmental authority in carrying out its obligations assisted by a Vice President. The 1945 Constitution of the Republic of Indonesia, article 4 is said "In performing duties, the President is assisted by a Vice President". Constitutionally this article shows the position and duties of the Vice President as assistant to the President. Presenting the system of government by the constitution is intended to determine a position of the Vice President in related with the President in terms of responsibility. Based on normative juridical approach in this research, it is concluded that the presence of 1945 Constitution Amendment increasingly clarifies that the Vice President responsibility is to the President. It is based on the position of the Vice President interpretation in the Indonesian system that is not equal. This unequal position shows that the presidency as an organizer of the government administration is singular (single executive). However, to avoid the impression of the Vice President as a "spare tire", the Vice President should be given a clear constitutionally duties by delegating or sharing ofduties and not through delegating or sharing of the power

Abstract

This articel aim for examine reformation and optimalisation of law enforcement at law enforcerment institution in terms of progresive law perspective. the law face in Indonesia today  is faced a complex problem on law enforcement process. Yet, Reformation on law enforcement is the answer to how the law in Indonesia is actuated within frame work of estabilishment an aspired state of law. Law enforcement reformation ideally must be done through legal system approach, that covered legal substance sub system, legal structure sub system, and legal culture subsystem.  in the context of  law enforcement institution reformation, institution reformation ideally based on three main orientation, which is democration principal, rule of law, and human rights. That institution reformation must be done with changing paradigm from the way of textual legal thinking to progresive legal thinking. It can be formed if reformation of law enforcement institution, consistent in bringing about changing cultural aspect that comes from changing structural aspect and instrumental aspect.

Abstract

This paper aims to determine the limits of the use of discretion in governance and its responsibility when there is a deviation of the law. As a welfare state, the principle of legality alone is not enough to be actively involved in serving the interests of the community. This discretion emerged as an alternative to fill the shortcomings and weaknesses in the application of the principle of legality (wetmatigheid van bestuur). The use of discretionary powers by government officials can only be done in certain cases where the legislation in force does not set or because the existing regulations governing something is not clear, and it is done in an emergency / urgent in the interest of public. Bounds in the use of discretion is the General Principles of Good Governance (AUPB). While responsibility for discretionary decisions is divided into two, (1) as the responsibilities of office and (2) as a personal responsibility. As the responsibilities of office, when acting for and on behalf of the office (ambtshalve) in which there is no matter of maladministration. As a personal responsibility, if the use ofthese powers are matters of maladministration.

Abstract

Abstrak Pembentukan kabinet selalu menghadirkan persoalan yang rumit secara politik. Kerumitan itu ditengarai bersumber dari sistem multi partai yang digunakan di Indonesia di tengah penggunaan sistem presidensial yang berimbas pada efektifitas kabinet pemerintahan. Penelitian ini untuk menjawab persoalan bagaimana membentuk kabinet yang efektif di tengah sistem presidensial multi partai di Indonesia. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan kasus dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa pembentukan kabinet harus diorientasikan pada penguatan posisi presiden di parlemen dan efektifitas kinerja kabinet. Untuk itu dapat dilakukan penataan kabinet dengan mempertimbangkan aspek politik, aspek strategis, aspek teknokratik, dan aspek publik dengan pendekatan proporsionalitas. Penataan kabinet juga perlu dibarengi dengan penataan desain koalisi dengan perhatian pada tiga sektor utama, yaitu penguatan basis koalisi, pengaturan kelembagaan koalisi, dan kontrak politik beserta pengaturan mekanisme internal koalisi. Koalisi yang ideal di tengah sistem presidensial multi partai adalah koalisi yang berbasiskan pada ideologi, cita dan visi untuk membangun bangsa dan negara dalam jangka panjang, sehingga dapat menguatkan sistem presidensial dan berkontribusi positif pada efektifitas dan stabilitas pemerintahan yang pada gilirannya dapat mendorong efektifitas kerja kabinet. Abstract

The enactment of a Government Regulations in Lieu of Laws during states of emergency raises problems. This is evident so in the enactment of Government Regulation in Lieu of Law No. 1 of 2020 which was formed based on an emergency but used the framework of normal legal regime. Such has led to legal uncertainty and is hence vulnerable to abuse. This research was conducted to answer the problems regarding: the application of emergency laws in Indonesia and the government regulations in Lieu of Laws during states of emergency. This paper used normative legal research conducted by means of statutory, case study, and conceptual approaches. The study concludes that there have been some developments in the application of emergency law in Indonesia, since the status of the current public health emergency s is categorized as an emergency that must be responded to by legal regime in a state of emergency. From the aspect of legal regulation, it is apparent that there are various forms of emergency laws in Indonesia, and each of these legal forms has a different impact on the regulation and its legal binding power. However, the diverse arrangements of emergency laws are not supported by the standard concepts of the state of emergency and these arrangements tend to overlap which has caused ambiguity in the arrangement of emergency law in Indonesia. government regulations in lieu of laws that are stipulated the states of emergency bear the status of emergency regulations. Therefore, the issuance of a government regulations in lieu of Las in the state of emergency must comply with the legal principles of the state of emergency. On this basis, the issuance of government regulations in lieu of laws in the state of emergency must firmly determine the period of its validity as a way to ensure that the existence of the government regulations in lieu of laws does not create legal uncertainty.Keywords: government regulations in lieu of laws, state of emergency, emergency law. Peraturan Sebagai Pengganti Statuta Dalam Keadaan Darurat Di Indonesia Abstrak Pemberlakuan Peraturan Pemerintah Pengganti Undang-Undang pada saat keadaan darurat menimbulkan permasalahan. Hal ini terlihat dari lahirnya Peraturan Pemerintah Pengganti Undang-Undang Nomor 1 Tahun 2020 yang dibentuk berdasarkan keadaan darurat tetapi menggunakan kerangka rezim hukum yang normal. Hal tersebut telah menyebabkan ketidakpastian hukum dan karenanya rentan terhadap penyalahgunaan. Penelitian ini dilakukan untuk menjawab permasalahan mengenai: penerapan undang-undang darurat di Indonesia dan peraturan pemerintah pengganti undang-undang pada saat keadaan darurat. Tulisan ini menggunakan penelitian hukum normatif yang dilakukan melalui pendekatan perundang-undangan, studi kasus, dan konseptual. Kajian menyimpulkan bahwa telah terjadi beberapa perkembangan dalam penerapan hukum kedaruratan di Indonesia, karena status kedaruratan kesehatan masyarakat saat ini dikategorikan sebagai kedaruratan yang harus ditanggapi oleh rezim hukum dalam keadaan darurat. Dari aspek pengaturan hukum, terlihat bahwa ada berbagai bentuk hukum darurat di Indonesia, dan masing-masing bentuk hukum tersebut memiliki dampak yang berbeda terhadap pengaturan dan kekuatan mengikat hukumnya. Namun, pengaturan undang-undang darurat yang beragam tidak didukung oleh konsep standar keadaan darurat dan pengaturan ini cenderung tumpang tindih yang menyebabkan ambiguitas dalam pengaturan undang-undang darurat di Indonesia. peraturan pemerintah pengganti undang-undang yang mengatur keadaan darurat berstatus peraturan darurat. Oleh karena itu, penerbitan peraturan pemerintah pengganti Las dalam keadaan darurat harus sesuai dengan asas-asas hukum keadaan darurat. Atas dasar itu, penerbitan peraturan pemerintah pengganti undang-undang dalam keadaan darurat harus secara tegas menentukan masa berlakunya sebagai upaya untuk memastikan bahwa keberadaan peraturan pemerintah pengganti undang-undang tidak menimbulkan ketidakpastian hukum.Kata kunci: peraturan pemerintah pengganti undang-undang, keadaan darurat, hukum darurat.

Abstract

The presence of state policies amidst the presidential system has sparked controversies and raised glitches in state administration because these policies and the practice of parliamentarism intersect. On the other hand, fundamental issues arise from the national development planning system, calling for systemic maintenance to reinforce the direction and certainty of development in Indonesia. This article seeks to explore the compatibility of the state policies with the presidential system in Indonesia, mainly focusing on the urgency of the state policies and the form of the policies compatible with the presidential system in Indonesia. This research employed a normative method supported by statutory, historical, and conceptual approaches. To examine the urgency and the compatibility of the policies to the constitutional system in Indonesia, the policies need to be further investigated. The research results show that the urgency of the state policies can be viewed from the need to lead the directions, and policies, and set the certainty of the state development. The presence of these policies is expected to improve the shortcomings of the national development planning system, encompassing improvement of the political aspect of the development plan, constitutional design aspect, and ideological aspect. The compatibility of these policies with the presidential system represents the policies that leave no harm to the standard of the presidential system unless they (i) weaken the position of the president in connection with the parliament, and (ii) require the president to be responsible under the MPR (People’s Consultative Assembly). The compatibility of these policies can be formulated in three models: (i) the DPSP model; (ii) the parent law model as the state policies; and (iii) setting the policies by the MPR by adjusting to the principles of presidentialism.
