Abstract

The use system of Press the Agree Button (clickwrap agreements) in online commerce has become a common practice in line with the development of information technology. While making it easier for consumers to conduct transactions online, the use of clickwrap agreements often leads to misunderstanding of the terms and conditions, resulting in serious impacts on consumer rights. Legal protection in clickwrap agreements in Indonesia aims to safeguard the rights and interests of consumers and promote safe and fair online commerce. Despite their convenience, consumers often simply click "Agree" without understanding the terms and conditions, leading to the risk of high cancellation fees, loss of refund rights, and less transparent use of personal data. Legal protection in Indonesia aims to safeguard consumer rights and promote fair online trade. Consumers need to understand their rights, read terms carefully, and report violations to ensure legal protection. Regulations emphasize transparency and clear notice to consumers, with service providers required to provide easy access to pre-transaction terms and notice of the consequences of clicking "Agree" as well as the right to withdraw consent. The importance of consumers understanding their rights, reading terms and conditions carefully, and reporting violations is key to ensuring their legal protection in online transactions. Regulations and laws governing online commerce emphasize the importance of transparency and providing clear notices to consumers. Service providers are required to provide easy access to terms and conditions before a transaction is made, and clear notice must be given to consumers regarding the consequences of clicking "Agree" as well as consumers' rights regarding withdrawal of consent or cancellation of the transaction. Thus, stronger legal protection can be ensured through the implementation of rules that emphasize transparency, provide clear information to consumers, and provide easy access to terms and conditions. In this context, strengthening regulations can maintain a balance between the ease of online transactions and the protection of consumer rights.
