Abstract

This study aims to analyze the characteristics of laws and regulations that are good and just for society, to discuss in depth legal remedies against laws that do not fulfill justice for society. This type of research is normative in nature with a descriptive-analytical approach, exploring existing legal symptoms and problems and testing them based on statutory regulations and legal norms. The results of this study indicate that the characteristics of laws that are good and just for the community are regulations that are harmonious, do not overlap with other laws and regulations and their substance accommodates the interests of the community. A good law must have the character of predictability, stability and fairness. Legal remedies against laws whose contents do not satisfy a sense of justice for the people can be carried out through a judicial review to the Constitutional Court, in addition there is also a legislative review, namely periodic reviews by the DPR as legislators as an effort to realize good management of law production.

Abstract

This study aims to examine the elements of criminal acts of decency on social media, as well as comprehensively discuss policies and law enforcement against perpetrators of criminal acts of decency. This type of research is normative juridical with a descriptive-analytical approach discussing existing legal symptoms and problems, and testing them aware of laws and legal norms. The results of this study show that the elements of criminal acts of decency on social media as regulated by Article 281 of the Criminal Code are: whoever, intentionally, in public, distributes, distributes or transmits content that violates decency refers to the object of action in the Pornography Law. Policies and law enforcement against perpetrators of criminal acts of decency include penal policies regulated in Law Number 19 of 2016 concerning Electronic Information and Transactions, Law Number: 44 of 2008 concerning Pornography, and criminal acts of decency regulated by the Criminal Code. Non-penalty policy: supervision of sites or content on social media that contain moral content, understanding religious values from an early age, increasing healthy internet understanding, and parental supervision of minors in using social media/internet

Abstract

This study aims to comprehensively discuss legal sanctions for construction accidents and building failures in construction services law, as well as discuss in depth efforts to overcome disparities and criminal law vacancies for building failures in construction services law. This type of research is normative juridical with a descriptive-analytical approach, discusses existing legal symptoms and problems and tests them aware of laws and legal norms. The results of this study show that legal sanctions for construction accidents and building failures in the construction services law are divided into two, namely administrative sanctions (written warnings, administrative fines, temporary suspension of construction service activities, inclusion in the blacklist, suspension of permits and/or revocation of permits) and civil sanctions (compensation), Meanwhile, criminal sanctions are regulated in laws outside construction services such as the Building Law and the Housing/Settlement Law, namely (imprisonment and fines). Efforts to overcome disparities and vacancies in criminal law for construction accidents and building failures are through codification or  legal reconstruction,  namely: rearranging criminal sanctions for building failure in the construction services law and establishing or combining several provisions of related laws in the field of construction, especially regulating building failures and construct accidents regulated in Law Number : 28 of 2002 concerning Building and Law Number : 1 of 2011 concerning Housing and Settlement Areas.

Abstract

Penelitian ini bertujuan untuk membahas secara mendalam faktor penyebab terjadinya sengketa dalam pekerjaan konstruksi dan mengkaji secara komperhensif mekanisme penyelesaian sengketa konstruksi yang diakibatkan oleh kegagalan bangunan. Jenis penelitian bersifat normatif law dengan pendekatan deskritif-analitis, membasa gejala dan permasalahan hukum yang ada serta mengujinya bersadarkan peraturan perundang-undangan maupun norma norma hukum. Hasil penelitian ini menunjukkan bahwa sengketa dalam pekerjaan konstruksi dikarenakan adanya konflik kepentingan para pihak, kesalahan dalam menerjemahkan kontrak kerja dan keterlambatan pembayaran. Mekanisme penyelesaian sengketa konstruksi dapat dilakukan melalui musyawarah mufakat, litigasi (pengadilan) dan non-litigasi sesuai ketentuan perundang-undangan yang berlaku.

Abstract

River empowerment for tourism and sustainable agriculture has a positive impact on environmental sustainability and community welfare. However, these positive benefits have not been fully felt by the community in Sei Ular River, North Sumatra. Increasingly rampant illegal mining activities have deprived the community of their social rights, especially for a good and healthy environment. Government policies and existing legal instruments have not been optimal in solving the problem due to inconsistencies in law enforcement, lack of coordination between authorities, and low public awareness to protect river ecosystems. The research conducted is normative juridical, namely analyzing written law, jurisprudence, and norms that live in society. The descriptive-analytical approach aims to retrieve data systematically, factually, and accurately on a problem based on applicable laws and legal norms. The results of this study indicate that regulations and legal protection for the community due to illegal mining in Sei Ular River have been regulated starting from laws, government regulations, to regional regulations, but these legal instruments have not been effective enough in protecting the community from the impact of illegal mining activities, as a result, there have been violations of fundamental rights that affect community welfare. Empowerment of the Sei Ular River for tourism and sustainable agriculture and its concrete benefits, namely, involving the community in the management of tourist destinations in the river area, building dams and irrigation channels for farmers, socialization, strict action (sanctions) against illegal mining actors, actively collaborating with various parties in conducting surveillance to protect the Sei Ular River ecosystem. In addition, the government also requires illegal mining actors who pollute the Sei Ular River to compensate affected communities and restore the environmental damage caused.
