Abstract

In the lease agreement, it can be understood that where one party binds himself to give enjoyment of an item to another party, for a certain time with payment that the party can afford. The problem raised in this case is that the tenant is an official representing a government agency who does not pay the rent even though the deed of the lease agreement has been signed, then when the achievement has not been fulfilled, the official has been replaced. What will be discussed in this article is the responsibility for fulfilling the achievements of the Mahakam Ulu District Government. To answer these problems, normative juridical research methods are used. , this study did not use observations or interviews with respondents. When viewed from the angle of its shape, this research is a prescriptive research. Prescriptive research is research that aims to provide solutions or suggestions in overcoming a problem. First, it will discuss how the plaintiff's lawsuit does not include the Regent of Ulu Regency as the Defendant in the lease agreement, then an analysis will be carried out regarding legal protection against those who rent out defaults carried out by the Public Works and Public Housing Agency.

Abstract

Sisa bidang tanah adalah tanah yang dimiliki oleh pemilik tanah yang terkena Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum, namun tanah tersebut tidak termasuk Daerah Milik Jalan (DMJ) sehingga berpotensi tidak dapat lagi difungsikan sesuai dengan peruntukannya dan atau penggunaan awal dan atau tidak dapat digunakan lagi sebagai tanah produktif yang menghasilkan. Terhadap sisa bidang tanah tersebut, pemilik tanah dapat meminta penggantian atau pembayaran kepada pemerintah yang melaksanakan kegiatan Pengadaan Tanah agar seluruhnya dapat dibebaskan sekaligus.Tujuan dari penelitian ini adalah untuk mengkaji mengenai analisis yuridis pelaksanaan perlindungan hukum ganti rugi sisa bidang tanah dalam pengadaan tanah bagi pembangunan demi kepentingan umum.Penelitian ini menggunakan metode pendekatan yuridis empiris, spesifikasi penelitian adalah penelitian kepustakaan dan penelitian lapangan. Sumber data yang digunakan berupa data sekunder dengan studi pustaka. Analisa secara kualitatif.Hasil yang diperoleh dari penelitian ini adalah dalam hal terdapat sisa dari bidang tanah tertentu yang terkena pengadaan tanah bagi pembangunan demi kepentingan umum yang tidak lagi dapat difungsikan sesuai dengan peruntukan dan penggunaannya, pihak yang berhak dapat meminta penggantian secara utuh atas bidang tanahnya, namun undang-undang dan peraturan pelaksanaan mengenai pengadaan tanah bagi pembangunan demi kepentingan umum belum mengatur pedoman secara detail perhitungan pemberian ganti kerugian terhadap tanah sisa.

Abstract

A Notary is every person who assumes and performs duties as a public official authorized to make authentic deeds and other authorities as regulated in laws and regulations. In carrying out his authority, a notary is required to obey the rules, policies and prohibitions that are regulated explicitly in Law no. 30 of 2004 jo. UU no. 2 of 2014 (UUJN). With the enactment of Law no. 27 of 2022 concerning Protection of Personal Data (UUPDP), a review must be applied to the obligations of a notary, especially their obligations to protect and keep confidential personal data listed in the notary deed. Through doctrinal research methods or literature studies and statutory approaches, the authors found that there is some data in the notarial deed that falls into the scope of personal data. In addition, the authors also found that the sanctions regulated by the UUJN and UUPDP have similarities and also differences, so further arrangements are needed in this regard. Unlike the UUJN, criminal sanctions are regulated in detail in the UUPDP so that actions that harm the owner of personal data can be subject to criminal penalties in the form of imprisonment or fines. Thus, notaries must also pay attention to the obligations and prohibitions regulated in the UUPDP because a notary is also a Personal Data Controller based on this research.

Abstract

Pada praktiknya, dalam perjanjian kredit terkadang Kreditur dapat mencairkan pinjaman tanpa harus memastikan pengurusan jaminan hutang telah lengkap atau selesai. Kreditur akan berpegangan kepada covernote atau surat keterangan yang diterbitkan oleh Notaris sebagai jaminan bahwa Notaris akan menyelesaikan segala proses pengurusan surat ataupun dokumen hukum. Covernote bukanlah akta autentik yang diatur dalam Undang-Undang Jabatan Notaris melainkan hanya surat keterangan yang dikeluarkan oleh Notaris yang menerangkan sudah sejauh mana proses pengurusan dan yang Notaris kerjakan. Dengan tidak diaturnya covernote dalam Undang-Undang Jabatan Notaris, maka bentuk bentuk pertanggungjawaban yang berlaku ialah pertanggungjawaban umum yakni pertanggungjawaban perdata atas dasar perbuatan melawan hukum ataupun wanprestasi, ataupun dengan pertanggungjawaban administratif.
