Abstract

Waqf-based forests can conserve the forest ecosystem by applying waqf principles. This initiative has been implemented in several places in Indonesia. The limited funds available for waqf-based forest development require nazhir to carefully choose the best location so that the asset can function optimally. However, no specific research has been conducted to guide the selection of the best location for this purpose. This study aimed to identify potential criteria to help determine the best site for developing a waqf-based forest. Several methods were used to collect the necessary data, including literature reviews, in-depth interviews, field observations, and focus group discussions. This study identifies four crucial criteria when selecting the best locations: a) legal, b) physical and biophysical, c) high conservation value and benefits, and d) management. In addition, each criterion has sub-criteria. Among all, legal issues receive the highest highlight as unresolved regulations can affect a forest's ownership and function. This study was the first to discuss these criteria. Future research should quantify the criteria suggested using GIS and conduct more field observations in existing waqf-based forests in Indonesia.

Abstract

Waqf-based forest is developed on waqf land and is now being developed in Indonesia. It combines Islamic principles with environmental conservation, as being waqf assets, a forest is prohibited from being sold, given, or inherited. An effective management strategy is crucial to ensure waqf-based forest productivity and sustainability. Some research has already been conducted, but the specific dimension remains unexplored. This study aims to identify essential aspects and effective management strategies to escalate waqf-based forest benefits. Using a comprehensive approach, this study combines a literature study, in-depth interviews, and a study case in Bogor Waqf Forest, Bogor Regency, Indonesia. The findings were analyzed using the Analytic Hierarchy Process (AHP), followed by Focus Group Discussion (FGD) and further in-depth interviews as the validation process. There are six important considerations to optimize waqf-based forest management: legal, ecological, Islamic, economical, social, and aesthetic. The land’s legal status as waqf assets is recognized as the most crucial aspect to avoid possible conflict and sustainability in the future. Then, the following considerations are improved ecological and Islamic activities aspects, economic strategies, and social and aesthetic consecutively. This research is expected to provide a deeper investigation of the future management strategies for waqf-based forests. Abstract

Waqf (Islamic endowment) is considered one of the alternative solutions to environmental problems in Indonesia. One of the examples is through the establishment of a waqf forest, a conservation initiative in the form of developing forests on waqf land. The development of waqf forests needs to pay attention to the legal side in accordance with the laws and regulations of Indonesia. Previous studies discussed the process of legalizing waqf land in Indonesia, but research about the legalization of waqf forest land is still scarce. This study aims to determine the process of legalizing waqf forests on the basis of Indonesian laws and regulations. On the basis of the results of literature studies and expert interviews that were analyzed descriptively, the process of legalizing waqf forest is one of the main tasks of a nazir (waqf manager). The process involves at least three government agencies: the Ministry of Religion, the Ministry of Agrarian Affairs and Spatial Planning (National Land Agency), and the Ministry of Environment and Forestry. The waqf forest legalization process begins with making a waqf pledge deed at the local Office of Religious Affairs, followed by creating a waqf land certificate at the local Land Offices. A crucial step is to clarify that the represented land must be located outside the forest area through a statement from the Ministry of Environment and Forestry. The legalization of waqf forests will guarantee the sustainability of the forest because this process makes waqf forest legal under Islamic law and the law of the Republic of Indonesia.
