Abstract

Juridically in the context of Indonesian law, there are two perspectives that can be used to discuss the need for LGBT legal regulations, namely the customary law perspective and the Islamic law perspective. Lesbian, Gay, Bisexual and Transgender (LGBT) groups in Indonesia have received significant attention. This research uses normative legal research techniques as its methodology. This research further examines the need for clear legal regulations regarding LGBT. Considering the fact that Indonesia is a legal country where people respect each other's customs and religious beliefs, it can be said that the legalization of LGBT people is not justified. Thus, it is hoped that this research can answer problems that are of concern to the Indonesian people. As well as, it can open insight that legal regulations regarding LGBT in Indonesia are very necessary to achieve benefits, certainty and legal justice.

Abstract

Artikel ini membahas mengenai perubahan signifikan dalam sistem hukum yang disebabkan oleh kemajuan teknologi informasi, khususnya dalam penggunaan bukti elektronik dalam peradilan. Penulis menekankan pada kekuatan bukti elektronik dalam menjamin keadilan hukum yang lebih terjamin, sekaligus mengidentifikasi tantangan yang muncul dalam penggunaannya. Tujuan dari artikel ini adalah untuk melihat bagaimana kekuatan alat bukti elektronik dalam mewujudkan kepastian hukum yang berbasis keadilan, dan untuk mengetahui urgensi reformasi hukum dalam mengatur kriteria alat bukti elektronik yang sah. Dengan menggunakan metode penelitian melalui pendekatan yuridis normatif dan teknik pengumpulan data sekunder, dengan merujuk pada UU ITE dan Putusan Mahkamah Konstitusi, pengakuan terhadap alat bukti elektronik ditegaskan dengan tegas. Namun, artikel ini juga menggarisbawahi otentikasi, integritas, dan kendala regulasi sebagai perhatian utama, mengadvokasi penerapan standar prosedural yang ketat, perlindungan privasi yang lebih baik, dan peningkatan akses teknologi sebagai langkah penting dalam memastikan keadilan dan kepastian hukum di era digital.

Abstract

This research analyzes the legal provisions regarding the obligation to pay overtime wages and legal options for workers if the company fails to provide overtime compensation. Overtime wages are the right of workers regulated in Law No. 13 of 2003 concerning Manpower which has been amended by Law No. 6 of 2023 and Government Regulation No. 35 of 2021. This study uses a case analysis of PT X in Semarang, which was accused of not paying overtime wages in full to its employees. The findings show that despite clear legal regulations, implementation faces various obstacles, such as inadequate supervision and lack of legal awareness. Employees whose rights are not met can pursue out-of-court (e.g. bipartite negotiation, mediation, conciliation, arbitration) and court channels through the labor court. Non-compliance with regulations on overtime pay not only impacts the economic situation of employees, but also causes imbalances in labor relations. This research recommends strengthening the labor inspection system, increasing transparency in the handling of working hours, increasing legal awareness among employees, and developing a more accurate time recording system to ensure the fulfillment of employee rights according to the applicable regulations.
