Abstract

A sphere of multilateralism is often construed as a prerequisite for a like-minded middle power partnership. It reflects the very nature of middle power partnerships. This paper seeks to explore Indonesia’s middle power foreign policy in advancing multilateralism through its MIKTA (Mexico, Indonesia, South Korea, Turkey, and Australia) chairmanship in 2023. This paper thus collects relevant data from MIKTA’s resources and documents to further scrutinize its middle power agenda. It should be noted that MIKTA’s flexibility in organizing its agenda is an indispensable part of itself. Thus, this paper provides in-depth research on geopolitical trends of a middle powers partnership that is like-minded in nature. It then concludes how such trends influence Indonesia’s chairmanship in MIKTA. This paper is structured to understand and interpret Indonesia’s 2023 MIKTA chairmanship from the perspective of like-mindedness in foreign policy analysis. For such, the paper will use a foreign policy action analysis with a primary focus on actions conducted by and/or in relation to MIKTA. This paper shows that Indonesia’s 2023 chairmanship in MIKTA is a quest to demonstrate Indonesia’s middle power foreign policy. This paper recommends for Indonesia’s 2023 MIKTA chairmanship to critically transform MIKTA’s minilateralism approach in order to produce concrete deliverables by starting to utilize multilateralism as a means to fulfill Indonesia’s interests as a middle power and MIKTA’s institutional purposes as a norm- builder in addressing major global issues.

Abstract

Treaty governance in Indonesia is central to both the promotion of rule of law through diplomacy and the advancement of predictability in international relations, particularly through diplomacy conducted by Indonesia. By integrating domestic treaty governance with international legal standards, Indonesia enhances global legal stability and certainty. This approach highlights Indonesia’s commitment to maintaining legal principles, reinforcing its role as a key player in global diplomacy and international governance. This article hopes to thoroughly research on the practices considered norm-shaping as seen through Indonesia’s diplomacy and treaty governance laws, with a particular focus on the Minister of Foreign Affairs Regulation No. 4 of 2023 on the Governance of International Treaty Documents and other related regulations. In addition, this article seeks to identify the key norms regulating treaty governance in Indonesia as further established through Indonesia’s engagements in the international community. This article argues that treaty governance should not merely be seen as a monitoring mechanism but as a tool for shaping norms, promoting predictability in alignment with Indonesia’s national interests. This article then proposes a takeaway for Indonesia to identify its national laws in order to explicitly locate the treaty governance norms, in which Indonesia’s diplomacy must refer to. This strategic approach allows Indonesia to promote consistency and legal certainty globally while aligning international norms with its domestic priorities.

Abstract

Postur norma internasional kerap kali dianggap asing di mana eksistensinya yang kental dengan karakter eksternal mengharuskan adanya kompromi politik yang alot. Pada konteks norma hukum lingkungan internasional, beberapa perkembangannya tercatat memiliki kontribusi positif bagi pembangunan internasional sehingga memengaruhi rezim hukum lingkungan di tingkat nasional, termasuk Indonesia. Namun, proses penyesuaian di Indonesia masih bertumpu pada mekanisme ratifikasi dan belum sepenuhnya mampu menerjemahkan kedudukan hukum kebiasaan internasional. Penelitian ini menelusuri kontribusi hukum kebiasaan internasional pada pembentukan norma hukum lingkungan nasional dan bagaimana Indonesia dapat mengutilisasi hal tersebut untuk mempercepat penguatan tata kelola lingkungan hidup. Penelitian ini berargumen bahwa proyeksi diplomasi lingkungan Indonesia perlu mulai menyentuh diskursus hukum kebiasaan internasional pada pembentukan norma hukum lingkungan nasional. Tulisan ini menawarkan dua strategi utilisasi: (1) mengarusutamakan dasar kedudukan hukum kebiasaan internasional dalam pembentukan norma hukum lingkungan nasional; dan (2) mengonstatir pembagian kewenangan pelaksanaan diplomasi lingkungan Indonesia, dengan mengutilisasi hukum kebiasaan internasional

Abstract

Sustainable development is a colossal narrative of state elites to institutionalize the right to development which, instead of being oriented towards harmonization of development efforts with efforts to protect the environment, is actually based on human interests. The inherent causality of this effort has an impact on systemic environmental damage in various countries. When the environment is no longer able to recover itself according to the timeline of meeting the needs of human civilization, an ambitious approach such as ecocentrism needs to be used as a counter-narrative to the anthropocentrism approach which tends to be relative: it looks useful, but in fact it is not. This study argues that sustainable development no longer shows its relevance when the earth's situation has entered a crisis stage: the environment is no longer able to keep up with the destructive demands of human fulfillment and continues to increase at an accelerating pace. Furthermore, the focus of this research is thus to question the relevance of sustainable development which was sparked by an a priori narrative, namely a narrative centered on the presupposition that environmental protection is aimed at fulfilling the interests of the development of human civilization. In the condition of the earth that has experienced the current crisis, setting standards that are higher than the status quo for mitigating and adapting to climate change may still be lacking in preventing crises on earth. Reflecting on the above, this research seeks to offer a new paradigm in transforming an ecocentric approach by reflecting on state practices that are recognized at the international level. With this paradigm transformation, the anthropocentric approach can be overhauled in order to accommodate the current earth crisis situation.

Abstract

Transformation from a customary law community unit (kesatuan masyarakat hukum adat) in Indonesia into a customary village (desa adat) indicates a move enacted by the government of Indonesia to promote asymmetric decentralization. The problem that arises therein is the loss of self-governing community autonomy when the autonomy is combined with local self-government functions, especially when the supervision from the central government to local units in each local government becomes too excessive. As such, the study aims to examine how asymmetric decentralization affects the paradigm of recognition of government functions (local self-government) in customary law community units turned customary villages. The focus of this research is on the recognition of the Baduy tribe in Kanekes Village, Leuwidamar District, Lebak Regency, Banten Province as a customary village. The output of this research is to know the consequences of adopting asymmetric decentralization to the paradigm of local self-government in customary law community units that become customary villages.
