Abstract

Renewable energy has emerged as a pivotal aspect in addressing both energy security and climate change concerns. Iceland stands out as a notable exemplar in effectively harnessing renewable energy, with nearly 100% of its electricity demands met through renewable sources by 2023. In contrast, Indonesia is in the process of capitalizing on its abundant renewable energy potential, with renewables constituting only 12.5% of its electricity generation in the same year. This study undertakes a comparative analysis of the regulatory frameworks governing renewable energy utilization in Iceland and Indonesia, focusing on legal dimensions. Employing a comparative methodology with a normative juridical approach, data were gathered through literature review and examination of pertinent legal documentation. The findings underscore Iceland's robust and coherent regulatory structure supporting renewable energy utilization, characterized by clearly defined policies, incentivizing mechanisms, and efficient institutional frameworks. Conversely, Indonesia's regulatory landscape reveals a need for greater cohesion and harmonization, marked by fragmented policies, limited incentives, and suboptimal institutional arrangements. Noteworthy disparities between the two countries are attributed to factors such as political commitment, geographical considerations, and technological capacities. The research highlights the potential for Indonesia to draw valuable lessons from Iceland's experiences in formulating conducive regulations for renewable energy utilization. Key areas for improvement include bolstering policy frameworks, enhancing incentivization measures, and streamlining institutional mechanisms. By contributing insights into renewable energy regulations, this study offers guidance for policymakers in Indonesia towards optimizing the utilization of renewable energy resources.

Abstract

Menurut penelitian, Mata uang kripto tidak memenuhi kriteria untuk dianggap uang secara teori. Selain itu, penting untuk dicatat bahwa mata uang legal di Indonesia hanya mengakui rupiah sebagai alat pembayaran yang sah. Jadi, menurut hukum, mata uang kripto tidak diklasifikasikan sebagai uang atau uang elektronik. Terlepas dari pembatasan Indonesia dalam menggunakan Mata uang kripto dan mata uang virtual lainnya untuk pembayaran, Mata uang kripto telah mendapatkan pengakuan sebagai komoditas yang diperdagangkan di bursa masa depan. Regulasi di Indonesia memprioritaskan pengakuan pelanggan sebagai sarana untuk memerangi kejahatan melalui penggunaan Mata uang kripto dan mata uang virtual. Namun demikian, ada hambatan yang harus diatasi ketika datang ke nama samaran dan desentralisasi Mata uang kripto, yang dapat mempersulit pelacakan penjahat. Ini menambah kompleksitas pada masalah tanggung jawab pidana seputar Mata uang kripto.

Abstract

This research analyzes the regulation and application of criminal sanctions in Law Number 32 of 2009 concerning Environmental Protection and Management (PPLH Law) as an instrument of environmental law enforcement in Indonesia. By using the normative juridical research method, this research examines the regulation of criminal sanctions in the PPLH Law, its application in environmental cases, and its effectiveness in realizing environmental protection and management. The results show that the PPLH Law has provided a strong legal basis for the application of criminal sanctions. However, in practice, it still faces various obstacles, such as the complexity of proof, the limited capacity of law enforcement, and conflicts of interest. The effectiveness of the application of criminal sanctions is also not optimal because various factors, such as the quality of investigations, inter-agency coordination, and resource support, influence it. This research recommends the improvement of criminal sanction arrangements in the PPLH Law, strengthening law enforcement institutions and resources, increasing community participation, and applying the principle of restorative justice in the settlement of environmental criminal cases. These efforts are expected to strengthen environmental law enforcement and realize sustainable development in Indonesia.

Abstract

The author discusses the effects of annulment of prenuptial agreements in mixed marriages and how it affects the ownership of flats on land acquired after the marriage. Marriages between individuals of different nationalities often involve complex legal aspects, especially in the context of the annulment of prenuptial agreements. This research aims to investigate the legal consequences of annulment of prenuptial agreements in marriages between individuals of different nationalities. The text utilizes a normative legal approach conducted through literary research and a legislative approach. The study demonstrates the consequences of nullifying a prenuptial agreement in a mixed marriage, leading to joint ownership of assets acquired during the marriage and potentially affecting the ownership rights of apartment units on freehold land. Indonesian residents may lose their rights to an apartment unit (sarusun) in a freehold property if a prenuptial agreement was not made in a mixed marriage, as per domestic rules. After invalidating the prenuptial agreement, the Court should provide provisions to legally protect Indonesian citizens (WNI) regarding the ownership of apartment units on land with property rights status.
