Abstract

The transfer of the remaining spending money to be replaced with candy has become a natural thing in current buying and selling transactions, this transaction often occurs in supermarkets or minimarkets, even in shops including Toko 51 Desa Jeron. Because of the difficulty of finding broken money, especially in loose change, business actors must look for other alternatives to be able to return the remaining money from spending to consumers. From the description above, how the practice of diverting the remaining spending money is replaced with candy at Shop 51, Jeron Village. This study aims to be able to explain the practice of buying and selling towards the transfer of the remaining money from shopping with candy that is now often happening in the community and to see from the perspective of muamalah fiqh the practice. This research is a type of field research with a qualitative approach about the practice of diverting leftover money from shopping with candy at Toko 51 Desa Jeron, the author goes directly to the field, studies a process or discovery that occurs naturally, takes notes, analyzes and reports and draws conclusions from the process. and the sources of this research are consumers, business actors and cashiers at Toko 51 Jeron Village.hBased on the results of this study that the store 51 Jeron Village in the practice of diverting the remaining money from shopping with sweets sometimes without offering it first to consumers, according to muamalah fiqh it is concluded that in this sale and purchase using the Ba'i Muathah system it is allowed to buy and sell without saying lafadz that the change is replaced with candy but must remain on the agreement of both parties. Abstrak Pengalihan uang sisa belanja digantikan dengan permen sudah menjadi hal yang wajar dalam transaksi jual beli saat ini, transaksi ini sering terjadi pada supermarket atau minimarket bahkan pada toko-toko termasuk Toko 51 Desa Jeron. Karena sulitnya mencari uang pecah khususnya pada uang receh sehingga pelaku usaha harus mencari alternatif lain untuk bisa mengembalikan uang sisa belanja kepada konsumen. Dari uraian diatas bagaimana praktik pengalihan uang sisa belanja digantikan dengan permen di Toko 51 Desa Jeron.hPenelitian ini bertujuan agar dapat menjelaskan praktik jual beli terhadap pengalihan uang sisa belanja dengan permen yang kini kerap terjadi di masyarakat serta melihat dari pandangan fiqih muamalah terhadap praktik tersebut. Penelitian ini termasuk jenis penelitian lapangan dengan pendekatan kulitatif tentang praktik pengalihan uang sisa belanja dengan permen di Toko 51 Desa Jeron, penulis turun langsung ke lapangan, mempelajari suatu proses atau penemuan yang terjadi secara alami, mencatat, menganalisis dan melaporkan serta menarik kesimpulan dari proses tersebut dan sumber dari penelitian ini adalah konsumen, pelaku usaha dan kasir Toko 51 Desa Jeron. Berdasarkan hasil penelitian ini bahwa pihak toko 51 Desa Jeron dalam praktik pengalihan uang sisa belanja dengan permen terkadang tanpa menawarkan terlebih dahulu kepada konsumen, sehingga menurut pandangan fiqih muamalah disimpulkan dalam jual beli ini menggunakan sistem Ba’i Muathah diperbolehkan jual beli tanpa mengucap lafadz bahwa uang kembaliannya diganti dengan permen namun harus tetap atas kesepakatan kedua belah pihak.

Abstract

This study examines how Constitutional Court Decision Number 18/PUU-XVII/2019 reinterprets the legal norms governing the execution of fiduciary guarantees, and how its implications affect the authority of Religious Courts in enforcing the execution of collateral in Sharia-based financing. Employing a statute-based approach, the author conducts a comparative analytical interpretation of relevant laws and regulations on fiduciary guarantee execution and contrasts them with the reinterpretations introduced by the Constitutional Court. The findings indicate that the Decision affirms the equal importance of the principles of freedom of contract, consensualism, and due process of law alongside the principle of legal certainty in contractual arrangements. Consequently, Sharia financing institutions (creditors) may execute collateral objects without the involvement of Religious Courts (parate execution) only under two cumulative conditions: (a) the creditor and debtor have mutually agreed upon clear criteria for default, and (b) the debtor voluntarily surrenders the fiduciary object. In the absence of these conditions, execution must be carried out through the Religious Court. The study concludes that, to enable the Religious Courts to perform executions more effectively and efficiently, immediate updates to procedural law and execution mechanisms are needed through regulations and policies issued by the Supreme Court of the Republic of Indonesia.
