Abstract

Perkembangan perbankan syari’ah di Indonesia terus mengalami peningkatan. Bahwa faktanya adalah selain Indonesia berada di posisi pertama dan terbesar di dunia dari sisi jumlah perbankan syari’ahnya, Indonesia juga berada di posisi pertama dengan jumlah dewan pengawas syari’ah terbesar di dunia. Berbagai fatwa yang berhubungan dengan perbankan syari’ah telah dilegalisasi oleh Dewan Syari’ah Nasional Majelis ‘Ulama Indonesia (DSN-MUI). Antara lain tentang bunga dan penghimpunan dana. Identifikasi masalah dalam penelitian ini adalah : Bagaimana penerapan Fatwa Dewan Syari’ah Nasional Majelis Ulama Indonesia (DSN_MUI) terhadap Perbankan Syari’ah? Metode penelitian yang digunakan dalam penulisan hukum ini adalah yuridis normatif, yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder yang diperoleh melalui bahan pustaka. Hasil penelitian yang diperoleh yaitu dalam menetapkan fatwa, MUI tidak lepas dari pendapat imam madzhab atau ada pendapat yang sudah diungkapkan pengikut imam madzhab. Penyerapan fatwa MUI ke dalam peraturan perundang-undangan dan menempatkan MUI sebagai lembaga yang berhak menentukan kepatuhan syari’ah. Kedua, penyerapan sebagian isi dan substansial fatwa ke dalam peraturan perundang-undangan dan sama sekali belum dimasukan ke dalam undang-undang. Ketiga, fatwa tidak diserap dalam peraturan perundang-undangan, seperti fatwa tentang rekening Koran syari’ah

Abstract

The inheritance distribution for adopted children without official legal recognition from the Religious Court often leads to disputes, particularly among legitimate heirs. This study aims to analyze and understand the implementation of inheritance processes for adopted children who have not obtained formal legal status. Referring to the Compilation of Islamic Law, this research employs a normative qualitative method with a case study approach to explore the application of the testamentary obligatory mechanism. The findings reveal that the testament obligatory mechanism can be used to allocate inheritance to adopted children who lack nasabiyah (bloodline) or sababiyah (marital ties) relationships. This obligatory bequest serves as a fair legal solution to accommodate the interests of adopted children while adhering to Islamic legal principles and minimizing potential disputes among legitimate heirs.
