Abstract

The infrastructure development program planned by the Joko Widodo administration in several regions, especially in Purbalingga and Tegal, displaced several waqf lands. This study analyzes the process of waqf exchange in the project from the perspective of the four madhhabs. This research uses a comparative approach by comparing several opinions of the scholars of the fiqh schools of thought on waqf swaps on the same side and, at the same time, also explaining the different sides. What is interesting in the discussion is the solution offered by replacing the waqf land with other land, even though Waqf has a primary principle in its administration, namely, the principle of Waqf must remain eternal (ta'bid al-asl). The theory of benefit becomes an analytical tool for developing a mindset regarding waqf exchange. This research yields the following conclusions. First, waqf management can change according to the public interest as long as the purpose of the Waqf is still to the expectations of the Waqf. Second, waqf exchange is the best solution when there is no other way, as long as the replacement is at least the previous Waqf.

Abstract

Perkembangan teknologi yang pesat telah membawa perubahan signifikan dalam berbagai aspek kehidupan, termasuk metrologi, yang sangat penting untuk memastikan keakuratan alat ukur dalam perdagangan, kesehatan, keselamatan publik, dan lingkungan hidup. Untuk menjaga standar dan kualitas pengukuran, diperlukan sistem pengawasan dan penyidikan yang efisien dan tepat waktu. Penelitian ini bertujuan mengembangkan aplikasi berbasis Android untuk mendukung penyidikan metrologi legal, guna meningkatkan akurasi, efisiensi, dan transparansi dalam pengelolaan data pengukuran. Studi kasus dilakukan di Kantor Bidang Kemetrologian Dinas Perdagangan dan Perindustrian Kabupaten Jombang, yang menangani standarisasi pengukuran dan pengawasan alat ukur. Aplikasi ini dirancang untuk mengatasi masalah ketidakakuratan pengukuran, frekuensi kalibrasi yang tidak memadai, dan kesalahan pencatatan hasil, serta membantu petugas metrologi mengatasi tantangan dalam proses pengukuran. Dengan menggunakan platform Android, aplikasi ini menawarkan kemudahan penggunaan dan kustomisasi, serta meningkatkan kinerja, mempercepat proses penyidikan, dan mendorong inovasi dalam bidang metrologi legal.

Abstract

This research analyzes the regulatory complexities inherent in Islamic banking contracts by adopting the framework of qawāʿid maṣrafiyyah (Islamic banking legal maxims), aiming to establish a more actionable and context-sensitive model of sharīʿah-compliant legitimacy. It critically addresses the lack of innovation in contract development, which is primarily attributed to the entrenched influence of rigid and literalist fiqh interpretations that narrowly frame legal reasoning within the dichotomy of ḥalāl and ḥarām. Through a content analysis approach combined with the methodological tools of uṣūl al-fiqh, this study endeavors to revitalize the operational relevance of legal maxims, particularly in addressing the complex realities of modern Islamic financial transactions. The ultimate goal is to broaden the interpretive framework available to Islamic legal scholars, enabling them to craft more responsive and forward-looking contractual models that align with the evolving dynamics of the global banking landscape. Key contributions of this study include: (1) the formulation of a normative and adaptable regulatory structure for Islamic banking contracts; (2) the reconfiguration of qawāʿid maṣrafiyyah as a practical and situationally attuned regulatory alternative; and (3) the inductive derivation of these maxims from the empirical challenges encountered in the Islamic banking industry.
