Abstract

Di dunia Illegal Fishing sudah menjadi permasalahan yang khusus dan sering terjadi di negara-negara berkembang ataupun di negara yang sebagian besar wilayahnya terdiri dari perairan laut yang luas. Pengaturan Hukum Internasional yang mengatur tentang laut terdapat di dalam United Nation Convention On The Law Of The Sea (UNCLOS 1982). Penenggelaman dilakukan oleh Indonesia untuk memberikan efek jera kepada kapal asing yang melakukan Illegal Fishing di perairan Indonesi. Tujuan dari penelitian ini untuk mengetahui bentuk-bentuk Illegal Fishing dalam Hukum Internasional.Penelitian yang dilakukan adalah penelitian hukum normatif dengan sifat penelitian deskriptif yang diambil dari data sekunder dengan pengolahan data dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Berdasarkan hasil penelitian dipahami bahwa penerapan sanksi Illegal Fishing Terhadap Penenggelaman Kapal Asing Di Indonesia Menurut Hukum Internasional tidak diatur secara khusus didalam hukum internasional mengenai penenggelaman kapal asing illegal fishing. Penenggelaman kapal asing illegal fishing tidak bertentangan dengan hukum internasional karena tidak ada yang mengatur secara jelas mengenai penenggelaman kapal asing. Hanya saja praktiknya penenggelaman di Indonesia yang bertentangan dengan Pasal 73 UNCLOS 1982 yaitu Indonesia melakukan penenggelaman dengan 2 mekanisme pertama melalui proses pengadilan yang kedua tidak melalui proses pengadilan atau penenggelaman yang dilakukan berdasarkan bukti permulaan yang cukup. Mekanisme yang tidak melalui proses pengadilan inilah yang tidak sejalan dengan hukum internasional

Abstract

Paragraph 2 of Article 32 of the United Nations Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances mandates that member states implement necessary measures to penalize adequately serious criminal offenses related to drug trafficking. The paragraph explicitly states in the UN Convention on Narcotics that measures must be taken by each state party to ensure the imposition of penalties for such offenses. The present study employs normative research methods, which encompass various terminologies such as legal, positive legal, doctrinal legal, and pure legal research methods. Focused on written laws (laws in books) or societal customs, normative legal research typically utilizes secondary data, which includes primary, secondary, and tertiary legal materials. Narcotics and psychotropic substances, often produced through agricultural or chemical methods, are frequently processed illegally in concealed laboratories or isolated locations. Trafficking in these prohibited substances involves their illegal production, distribution, and sale, adversely affecting both individual health and societal welfare. Furthermore, the Convention on Narcotics, specifically Article 32 Paragraph 2, has significantly enhanced international cooperation in combating the trafficking of drugs and psychotropic substances in Indonesia. Through strict law enforcement, intelligence sharing, and cross-border operational cooperation, Indonesia can more effectively counter drug trafficking syndicates.
