Abstract

Cases of domestic violence are crimes committed by husbands against members of their family. Domestic violence (KDRT) often befalls women as wives. There are several forms or types of domestic violence including physical, psychological, sexual and economic violence. All forms of violence that occur in the household are caused by several factors such as the economy, education, socio-culture and infidelity. The act of domestic violence in some circles of society is considered normal in the household. While the impact of domestic violence can result in disruption of women's reproductive health, mental disturbance of children, divorce and also legal sanctions for the perpetrators. Domestic violence cases can be resolved through mediation. Mediation is an alternative in solving domestic violence cases. The litigants choose mediation because they think mediation can maintain confidentiality, there are no winners and losers, can fulfill a sense of justice, the process is faster and more concerned with the future of the household, family and children's future. The path of mediation in solving domestic violence cases must always be pursued by the litigants as well as by law enforcement.

Abstract

Kajian ini menganalisis apakah capaian pembangunan manusia, serta infrastruktur yang ada memberi pengaruh pada tumbuhnya ekonomi di Kalimantan Tengah selama periode 2014-2023 dengan menggunakan analisis data deret waktu regresi berganda. Penelitian menunjukkan temuan bahwa ada signifikansi pengaruh berarah positif pembangunan manusia pada tumbuhnya ekonomi Kalimantan Tengah. Infrastruktur, khususnya listrik, ditemukan berkaitan tidak signifikan dengan arah positif. Selain itu, untuk panjang jalan didapatkan kaitan dengan arah negatif akan tetapi tidak memiliki signifikansi pengaruh bagi tumbuhnya ekonomi Kalimantan Tengah. Koefisien determinasi (R²) ditemukan nilai 0,989230 berarti 98,92% variasi dari tumbuhnya ekonomi provinsi ini bisa dijelaskan oleh variabel kajian. Temuan ini mengindikasikan bahwa para pembuat kebijakan perlu fokus pada program pembangunan manusia dengan maksimalisasi kualitas dan jangkauan pendidikan serta kesehatan, sekaligus memperbaiki infrastruktur untuk mempertahankan pertumbuhan ekonomi Kalimantan Tengah agar mampu berkembang lebih baik.

Abstract

Domestic violence (DV) is a very serious form of human rights violation, considering the physical, psychological, and social impacts it has on victims. Although various legal efforts have been made to provide protection for victims of domestic violence, there are still many obstacles in the implementation of effective legal protection. The purpose of this study is to analyze legal protection for victims of domestic violence from a Human Rights (HAM) perspective, by highlighting the extent to which the Indonesian legal system provides adequate protection in accordance with international human rights standards. The method used in this study is a normative approach with a literature review of laws, related regulations, and relevant literature. The results of the study indicate that although there are several regulations that provide legal protection, such as Law Number 23 of 2004 concerning the Elimination of Domestic Violence, the implementation of protection is still limited. Several factors that hinder effective protection include the lack of legal awareness in the community, obstacles in law enforcement, and minimal psychosocial support for victims. Therefore, further efforts are needed to increase legal awareness, strengthen law enforcement, and provide more comprehensive services for victims of domestic violence so that victims' human rights can be optimally protected.
