Abstract

ABSTRAKPerkembangan digitilasisasi yang semakin maju di Indonesia juga berdampak pada perkembangan peraturan perundang-undangan. Banyak peraturan-peraturan yang tergolong baru di Indonesia. Berlakunya Peraturan Pemerintah Republik Indonesia Nomor 24 Tahun 2022 tentang Pelaksanaan Undang-Undang Nomor 24 Tahun 2019 tentang Ekonomi Kreatif. Peraturan tersebut di dalamnya menyatakan bahwa suatu hak cipta berupa konten youtube yang dibuat oleh kreator dapat dibebani dengan jaminan fidusia. Jaminan fidusia tersebut dapat dijaminkan baik pada Lembaga keuangan perbankan maupun Lembaga keuangan non bank. Berdasarkan hal tersebut terdapat beberapa hasil dari penelitian ini yaitu konten youtube yang telah beriklan dapat dikatakan telah memiliki hak cipta meskipun tidak atau belum didaftarkan tetapi sulit untuk dibuktikan apabila dikemudian hari terjadi sengketa. Bahwa konten youtube yang telah beriklan dapat dibebani dengan jaminan fidusia atas dasar bahwa konten tersebut telah memiliki hak cipta. Metode yang digunakan dalam penelitian ini menggunakan metode penelitian yuridis normatif. Pendekatan yang digunakan yaitu pendekatan konseptual dan pendekatan perundang-undangan. Kerangka pemikiran yang digunakan menggunakan kerangka pemikiran deduktif, kerangka berpikir dari hal yang umum ke hal yang bersifat khusus Kata Kunci : Jaminan Fidusia, Hak Cipta, Youtube   Abstract The development of digitization that is increasingly advanced in Indonesia also has an impact on the development of laws and regulations. Many regulations are relatively new in Indonesia. The enactment of the Government Regulation of the Republic of Indonesia Number 24 of 2022 concerning the Implementation of Law Number 24 of 2019 concerning the Creative Economy. The regulation states that a copyright in the form of youtube content created by a creator can be burdened with fiduciary guarantees. The fiduciary guarantee can be pledged to both banking financial institutions and non-bank financial institutions. Based on this, there are several results from this research, namely Youtube content that has advertised can be said to have owned copyright even though it is not or has not been registered but it is difficult to prove if there is a dispute in the future. That youtube content that has advertised can be burdened with fiduciary guarantees on the basis that the content is copyrighted. The method used in this study uses normative juridical research methods. The approach used is a conceptual approach and a statutory approach. The frame of thought used uses a deductive frame of mind, a frame of thinking from a general thing to a special thing. Keywords : Fiduciary Guarantee, Copyright, Youtube

Abstract

The objects of debt collateral are generally objects that have a exists for (tangible asset) such as land, buildings, vehicles and so on. However, in Law concerning the Creative Economy, precisely in Article 16, it is explained that the government facilitates intellectual property-based financing schemes that have economic value for creative economy business actors which will be further regulated in a government regulation. In terms of supporting the use of intellectual property as collateral objects to obtain credit, the government issued Government Regulation no. 24 of 2019 concerning Implementing Regulations of Law concerning the Creative Economy. So that creative economy actors in this case can take advantage of these facilities to develop their potential. Based on this background, the author formulates two problem formulations, namely: how are intellectual property rights (IPR) regulated for creative economy businesses as objects of debt collateral? What are the resolution efforts if a dispute occurs due to default by creative economy business actors? This thesis research uses normative juridical methods with a statutory approach (statue approach) and conceptual approaches. The legal materials used are primary legal materials and secondary legal materials using the library study method of collecting legal materials with research analysis using deductive methods.
