Abstract

Criminal law as one of the laws that contains various provisions relating to sentencing certainly intends to provide a deterrent effect by giving suffering. One form of punishment that exists and is applied in Indonesia is the death penalty. Since the Dutch East Indies Criminal Code was used in Indonesia, death penalty has also been regulated and used as a sentencing option that can be chosen by a panel of judges in various appropriate cases. The provisions relating to capital punishment are also regulated again in Law Number 1 of 2023 concerning the Criminal Code which is a new regulation relating to criminal law in force in Indonesia. Even though it is regulated again in the new regulation, it is known that there have been several changes and adjustments in Law Number 1 of 2023 concerning the Criminal Code relating to death penalty so it is necessary to pay attention and further scrutiny.

Abstract

As a constitutional state, of course the constitution is the basis for a state in carrying out state administration. This is also something that is happening in Indonesia considering that Indonesia is a constitutional state. In order for a constitution to move and function as it should, of course there needs to be constitutionalism which becomes a principle that can animate the constitution. This causes constitution and constitutionalism to be closely related. What's more, its implementation in Indonesia is very clear, namely with the restrictions on power that occur in Indonesia.

Abstract

Intellectual property rights are one of the most important things in the business world. One of the striking parts of intellectual property rights is patents related to inventions in technological developments which are very important nowadays considering the existence of strong technological developments. In relation to patents, what is striking is the protection of patents currently in effect in Indonesia. Basically, this has been regulated in Law Number 13 of 2016 concerning Patents.

Abstract

Digitalization occurs in all kinds of areas of life. In this study, the digitization in question is digitization in the field of digital payments. Digital payments, which are being intensively worked on by the government, are of interest to many traders and buyers in making transactions. In interviews with traders around Tarumanagara University, it was found that the majority of buyers used digital payments when buying their wares, so the traders asked to make Qris. These digital payments are not entirely good. Therefore, not all traders around Tarumanagara University provide digital payment options, due to the relatively small trading capital. Particularly for Qris, the disbursement of funds only occurs after 24 hours after the transaction takes place, so that traders find it difficult to get their trading money back. In the view of buyers, 94.2% of Tarumanegara University community buyers have completely switched to digital payments. They feel that conventional or cash payments are no longer relevant to the way they transact. Easy culture and communication ethics are the basis of what is considered contemporary. Moreover, every digital payment has been protected by law in Indonesia. In the process, these transaction activities are protected by Law No. 11 of 2008 concerning Information and Electronic Transactions, from consumers, producers to third parties, each has their own duties and obligations. The interest of the Tarumanagara University community's buyers is higher in merchants who provide digital payments or Qris which, from the seller's point of view, are influential in their income. Digitalisasi terjadi di segala macam bidang kehidupan. Pada penelitian ini digitalisasi yang dimaksud adalah digitalisasi pada bidang pembayaran digital. Pembayaran digital yang sedang gencar–gencarnya digarapkan oleh pemerintah menjadi minat banyak pedagang dan pembeli dalam melakukan transaksi. Dalam wawancara dengan pedagang di sekitar Universitas Tarumanagara, ditemukan bahwa mayoritas pembeli menggunakan pembayaran digital saat membeli dagangannya, sehingga pedagang mengajukan pembuatan QRIS. Pembayaran digital ini tidak sepenuhnya memberi dampak yang baik. Oleh sebab itu tidak semua pedagang di sekitar Universitas Tarumanegara memberi opsi pembayaran digital, dikarenakan modal dagang yang tidak terlalu besar. Khususnya QRIS, pencairan dana baru terjadi setelah 24 jam setelah transaksi berlangsung, sehingga pedagang kesulitan untuk memutar uang dagangannya kembali. Dalam pandangan pembeli, 94,2% pembeli mahasiswa Universitas Tarumanagara telah beralih sepenuhnya ke pembayaran digital. Mereka merasa bahwa pembayaran konvensional sudah tidak relevan terhadap cara bertransaksi. Budaya serba mudah dan etika berkomunikasi menjadi dasar yang dianggap kekinian. Dalam prosesnya kegiatan transaksi ini dilindungi oleh UU No 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, mulai dari konsumen, produsen hingga pihak ketiga memiliki tugasnya masing masing dan kewajibannya masing masing untuk menjaga kesepakatan yang disepakati oleh unsur-unsur itu, contohnya pada pasal 21 ayat 3 dijelaskan bahwa jika terjadi malfungsi yang kemudian menyebabkan kerugian pada produsen dan konsumen maka yang bertanggung jawab atas kerugian tersebut adalah pihak ketiga sebagai pelayan transaksi digital. Minat pembeli mahasiswa Universitas Tarumanegara lebih tinggi pada pedagang yang menyediakan pembayaran digital atau QRIS yang pada sudut pandang penjual menjadi hal yang berpengaruh dalam pendapatan mereka.
