Abstract

Introduction: State Regulations are written regulations stipulated by the head of the state government after being discussed and agreed upon with the state officials as the legal basis for implementing government at the state level, including in Hila State. To form a good state regulation that can apply effectively in society, a system of formation is needed that can support its formation from the preparation and program development stage, the design stage, discussion to promulgation, to the enforcement or implementation stage in society. In reality, this condition has not been able to be realized well in the countries in Central Maluku district, including in Hila Country, Leihitu District, Central Maluku Regency, so in this trial the following problems were identified: (1) To what extent is the understanding of the State Government and Saniri of Hila Country in forming State Regulations. (2) Factors that influence the State and Saniri governments of Hila State in forming State regulations?.Purposes of Devotion: The aim of this service is to transfer knowledge through training in drafting State Regulations to the State Government, Saniri State and the people of Hila State.. Method of Devotion: The service method is empirical, with the initial approach carried out through coordination with the State Government and Saniri Negeri for the service team to carry out the process of introducing the activities to be carried out and their correlation with government administrators in the State.Results of the Devotion: The results of the trial show that the State Government and Saniri of Hila State do not yet understand the exercise of authority in forming State Regulations as the legal basis governing the exercise of state authority, both authority based on rights of origin and local scale authority of the country, as well as government affairs assigned by the government or regional government. There are three important factors that are the main reasons why the state government and saniri of Hila state have not been able to form their own state regulations. The factors referred to are First, the Human Resources factor, the absence of assistance by the regional government, or government agencies, including universities, is a factor in determining the program.

Abstract

Law Number 6 of 2014 concerning Villages has become a comprehensive regulation regarding villages. In contrast to Law Number 32 of 2004, the regulation on BUMDe in the new Village Law is more comprehensive. BUMDes is still positioned as a village economic organization that has an important role in achieving the welfare of the community, villages, and village governments. The purpose of this study is to study and analyze the Legalization of Village-Owned Enterprises as a Means of Improving the People's Economy in Central Maluku Regency and to study and analyze the Legalization of Village-Owned Enterprises Can Improve the People's Economy in Central Maluku Regency. The research method is sociolegal with a regulatory approach and observation as well as interviews with the Tananahu government and the Central Maluku Government. The results of the research show that Tananahu's Owned Enterprises have not yet had legality through village regulations, even though their businesses have been petrified in increasing village income. So it is necessary to legalize Tananahu -owned Enterprises and also in villages in Central Maluku Regency.

Abstract

This study examines the neutrality of the State Civil Apparatus (ASN) in the context of local elections (Pilkada) in Maluku, Indonesia. Article 2 of Law No. 5 of 2014 on ASN stipulates that the implementation of ASN policies and management should be based on the principle of neutrality. Bureaucratic neutrality is a system where the quality of public service delivery remains consistent regardless of changes in leadership. This research explores the critical role of ASN neutrality in maintaining the integrity of public services and democratic processes. The study emphasizes the importance of ASN remaining impartial and free from political interventions, particularly during local elections. In the context of Pilkada in Maluku, this research investigates how ASN maintains distance from all political forces and refrains from practices of intimidation or threats towards other ASN employees and the public. The findings highlight the challenges and strategies in upholding ASN neutrality, contributing to the broader discourse on bureaucratic professionalism and the quality of local democracy in Indonesia. This study provides valuable insights for policymakers and practitioners in enhancing the neutrality and integrity of civil servants in the political landscape of Maluku and beyond.

Abstract

Supervision of cigarette sales is one form of implementation of health policies in order to protect the public from the negative impacts of tobacco consumption. The Indonesian Constitution has emphasized that health is a human right as stated in Article 28H of the 1945 Constitution of the Republic of Indonesia. In addition, further regulations regarding the security of tobacco products have been outlined in Law Number 17 of 2023 concerning Health and Government Regulation Number 109 of 2012 and Government Regulation Number 28 of 2024. However, in reality, the supervision carried out by the Ambon City government has not been running well, the circulation of cigarette sales is increasing in Ambon City with the presence of more and more business actors, this indicates that the government's supervision has not been running optimally. The research used by the author is empirical juridical research. Procedures for collecting legal materials by conducting research in the form of interviews and observations as well as literature studies on legal materials, namely primary legal materials and secondary legal materials. Then the legal materials that have been obtained are analyzed descriptively-qualitatively. The results obtained are that the implementation of supervision by the regional government of cigarette sales places in Ambon City is still not running optimally. Although regulations have regulated cigarette control, weak implementation and lack of supervision have caused the regulations to be ineffective. Various violations of the provisions that have been set continue to occur without any significant action from the regional government so that the Legal Consequences of the Regional Government Not Supervising Cigarette Sales Places in Ambon City, increasing numbers of novice smokers, and decreasing the effectiveness of tobacco control policies in Ambon City.

Abstract

Indonesia is experiencing a transition period in criminal law from the Dutch colonial legacy to the new National Criminal Code (KUHP), namely Law No. 1 of 2023. However, information regarding this legal change has not been fully understood by people in rural areas, especially teenagers and youth. This community service aims to increase the legal understanding and awareness of the youth in Negeri Makariki regarding the theories, prohibitions, and sanctions in the new KUHP. The method used is a qualitative-descriptive approach through interactive counseling entitled Legal Talk, coupled with participatory observation of the participants' enthusiasm and responses. The results show that through the delivery of simple materials, participants can understand the fundamental differences between the old and new laws. The youth of Negeri Makariki understand the concept of restorative justice, the rules of limited complaint offenses in morality articles, and criminal threats against everyday problems such as alcohol, narcotics, and theft. This activity successfully straightened out various legal myths in the community and increased the younger generation's vigilance against criminal acts.

Abstract

This community service activity aims to improve the community’s legal understanding and awareness through outreach on the National Criminal Code (KUHP) in Waisarisa Village, West Kairatu Subdistrict, West Seram Regency. The issues identified include the community’s limited understanding of the provisions of the New Criminal Code and a lack of legal awareness in daily life. The method used in this activity was a quantitative descriptive approach with a one-group pre-test and post-test design. Data collection was conducted through pre-tests, post-tests, and observations of 46 respondents who participated in the dissemination activity. The results of the activity showed an increase in the community’s legal understanding and awareness after participating in the outreach. The average pre-test score of 68.48% increased to 100% on the post-test, representing a 46.03% increase. The most significant improvement occurred in the indicators of understanding of the new Criminal Code and community legal awareness, each of which increased by 96%. These results indicate that legal outreach activities using an educational and participatory approach are effective in improving the community’s legal literacy. It is hoped that this initiative will foster a culture of legal awareness and enhance the community’s compliance with legal regulations in social life.

Abstract

Introduction: Negeri merupakan satuan pemerintahan dari kesatuan masyarakat hukum adat di Kabupaten Maluku Tengah sebagai bentuk desa adat yang secara historis, sosiologis, telah ada jauh sebelum terbentuknya negara republic Indonesia dan masih eksis sampai sekarang. Namun sejak ditetapkan UU No. 6 Tahun 2014 mewajibkan pemerintah daerah untuk menetapkan desa adat. Akan tetapi pemerintah daerah Kabupaten Maluku Tengah belum melakukan penetapan terhadap kurang lebih 118 (seratus delepan belas) Negeri dikabupten Maluku Tengah. Purposes of the Research: Menganalisis tanggung jawab Pemerintah Daerah Kabupaten Maluku Tengah dalam penetapan negeri sebagai desa adat. Serta akibat hukum atas tidak ditetapkannya negeri sebagai desa adat oleh Pemerintah Daerah Kabupaten Maluku Tengah. Methods of the Research: Metode yang digunakan dalam penulisan ini adalah Yuridis normative. Results / Main Findings / Novelty/Originality of the Research: Undang-Undang Nomor 6 Tahun 2014 tentang Desa mewajibkan pemerintah daerah kabupaten/kota menetapkan desa adat melalui Peraturan Daerah sebagai bentuk pengakuan dan perlindungan terhadap kesatuan masyarakat hukum adat. Namun, Pemerintah Kabupaten Maluku Tengah hingga saat ini belum menetapkan negeri-negeri adat sebagai desa adat sebagaimana diamanatkan Pasal 96 dan Pasal 116 UU Desa. Ketiadaan penetapan tersebut menunjukkan belum dilaksanakannya penataan kesatuan masyarakat hukum adat sebagai dasar pembentukan desa adat. Kondisi ini berpotensi menimbulkan akibat hukum berupa tidak terpenuhinya pengakuan dan perlindungan terhadap hak-hak masyarakat hukum adat, termasuk hak dalam sistem pemerintahan adat, pengisian jabatan adat, serta pengelolaan sumber daya alam dan wilayah ulayat negeri.
