Abstract

Indonesia continues to strive for laws that are implemented or lived for the community to be sourced from the values that live and develop in society, legal entities in Indonesia if applied then the community will not feel objections or unfamiliar with the legal model. Restorative justice is the resolution of criminal cases by involving perpetrators, victims, families of perpetrators / victims, and other related parties to jointly seek a fair solution by emphasizing recovery back to its original state, and not retaliation. Law Number 11 of 2021 concerning Amendments to Law Number 16 of 2004 concerning the Attorney General of the Republic of Indonesia states that one of the powers of the Attorney General is to set aside cases in the public interest. The AGO feels that there are many irregularities in the criminal law system that has been in effect, therefore in this case what is meant by "public interest" is the interest of the nation and state and / or the interests of the wider community. This research was conducted using a research method in the form of a Normative Juridical method. The data collection is done by means of literature study. The research specification used is descriptive qualitative. This study aims to determine how restorative justice against minor offenders in the form of theft at the prosecutor's level and how the implementation of restorative justice against minor offenders in the form of theft at the Pangkalpinang District Attorney's Office studies the case of Termination of Prosecution through the Decree of Termination of Prosecution of the Pangkalpinang Kajari Number 01/L.9.10.3/Eoh.2/01/2022 dated January 13, 2022. Abstract

The existence of Qanun Number 3 of 2013 concerning Regional Flags and symbols refers to the provisions of Article 246 and Article 247 of Law Number 11 of 2006 concerning the Government of Aceh, which stipulates that the Aceh government has the authority to stipulate the Aceh regional flag as a symbol of privilege and specificity. But recently published PP. No. 77/2007 concerning Regional Emblems, which in the provisions of Article 6 Paragraph (4) stipulates a prohibition for regions to make regional flags and symbols that resemble prohibited organizations and separatist movements. As a result, the existence of the Aceh flag as regulated in Qanun Number 3 of 2013, is considered contrary to the provisions of Article 6 Paragraph (4) PP. No. 77/2007 concerning Regional Coat of Arms. The use of the Aceh flag in the framework of implementing special autonomy in Aceh is a symbol of the community that shows the identity of the people and region of Aceh, and is not a symbol of sovereignty, this is in accordance with Article 246 paragraph (3) of Law no. 11/2006 concerning the Government of Aceh. Thus, the existence and use of the Aceh flag, seen from its sociological aspect, is a reflection of the Acehnese people themselves. Judging from the process of its formation, the process of forming Qanun Number 3 of 2013 concerning the Aceh Flag and Coat of Arms has met the requirements of legal certainty. When viewed from the legal substance contained therein, there is still a clash of norms between the Qanun on the Aceh Flag and the PP. No. 77/2007 concerning Regional Coat of Arms. Judging from the implementation aspect, until now the provisions of the Qanun have not been implemented, even though they have been ratified by the Aceh government together with the DPRA. Thus, the Qanun concerning the Aceh Flag has not obtained legal certainty in totality, because of the conflicting norms of the legal substance contained in it, so it cannot be implemented. Keywords:     Existence, Flag and Coat of Arms of Aceh, Perspective of Tiered Norm Theory.

Abstract

Fungsi Mahkamah Konstitusi (MK) dalam penegakan hukum di Indonesia sangat penting dan strategis. Sebagai lembaga yang bertugas menjaga kedaulatan konstitusi, MK memiliki beberapa fungsi utama, yaitu pengujian undang-undang, penyelesaian sengketa pemilu, dan perlindungan hak konstitusional warga negara. Melalui pengujian undang-undang, MK memastikan bahwa setiap regulasi yang dihasilkan oleh legislatif tidak bertentangan dengan prinsip-prinsip yang terkandung dalam Undang-Undang Dasar 1945. Penyelesaian sengketa pemilu oleh MK berkontribusi pada legitimasi proses demokrasi dengan memastikan bahwa hasil pemilu mencerminkan kehendak rakyat. Selain itu, MK juga berperan dalam melindungi hak-hak konstitusional individu, memberikan putusan yang memulihkan hak-hak yang dilanggar, serta meningkatkan kesadaran hukum di masyarakat. Dengan demikian, MK tidak hanya berfungsi sebagai pengawas terhadap tindakan lembaga negara, tetapi juga sebagai pendorong pengembangan hukum dan praktik demokrasi yang lebih baik. Penelitian ini bertujuan untuk mengkaji secara mendalam peran dan dampak Mahkamah Konstitusi dalam penegakan hukum di Indonesia, serta tantangan yang dihadapi dalam melaksanakan tugasnya. Diharapkan, hasil penelitian ini dapat memberikan wawasan yang lebih baik tentang pentingnya MK dalam sistem hukum dan tata negara di Indonesia.
