Abstract

Tujuan dari penulisan ini adalah untuk mempelajari terkait wanprestasi dalam hutang piutang serta cara meneyelesaikan wanprestasi tersebut dalam hukum positif di Indonesia. Metode risetyang dipakai adalah riset metode penelitian hukum normative jenis pendekatan analitical perundang-undangan dan konseptual. Hasil dari penulisan ini diketahui bahwa dalam hal penyelesaian wanprestasi seperti konteks penulisan yang dibahas adalah memberikan Somasi, Gugatan parate executie, Arbitrase atau Perwasitan, dan Gugatan rieele executie, hasil itulah yang terdapat pada kesimpulan didapatkan oleh penulis. Kata Kunci: Penyelesaian, Wanprestasi, Perubahan Tanggal Hutang Piutang. ABSTRACT The purpose of this writing is to study defaults in accounts payable and how to resolve these defaults in positive law in Indonesia. The research method used is normative legal research methods, legislative and conceptual analytical approaches. The results of this writing show that in terms of resolving breaches of contract, the context of the writing discussed is giving a summons, parate execution lawsuit, arbitration or refereeing, and rieele execution lawsuit, these are the results that are in the conclusions obtained by the author.
