Abstract

Subak is a traditional Balinese agrarian system recognized by UNESCO as a World Cultural Heritage. However, its sustainability faces serious threats due to regulatory overlaps between regional and national legislation, particularly regarding the protection of agricultural land. This study aims to examine the normative conflict between regional regulations in Bali and Law Number 41 of 2009 on the Protection of Sustainable Agricultural Land. Using a normative juridical method and statutory approach, the research reveals substantial differences in the regulation of Subak land use. Several regional bylaws permit the conversion of agricultural land for development purposes, which contradicts national legal norms that emphasize the preservation of sustainable agriculture. The study recommends regulatory harmonization and policy revision at the regional level to align with the goals of Subak protection and national food sovereignty.

Abstract

Abstract

This study aims to examine the contradiction between the legal perspectives in Law No. 17/2003 concerning state finances and Law No. 19/2003 concerning State-Owned Enterprises (BUMN) regarding separate state assets, and to investigate the legal ramifications of these contradictions on the responsibility and transparency of information in BUMN governance. This study employs normative legal research methodology using statute approach, conceptual approach, and analytical approach. Legal materials consist of primary legal materials including relevant laws and regulations, and secondary legal materials from academic literature, legal books, and scientific journal articles. The research findings indicate fundamental legal perspective differences between the two laws regarding separated state assets. The State Finance Law adopts a broad conception that separated state assets remain part of state finance under public law regime, while the SOE Law adopts a strict separation principle where such assets are no longer part of state assets but become SOE assets under corporate accountability system. This normative conflict creates contradiction in terminis that weakens the application of lex specialis derogat legi generali principle. The legal implications include the creation of a dual accountability system that burdens SOE management, confusion regarding transparency standards between corporate and public transparency, and ambiguity in corporate governance authority and responsibilities that generates high regulatory risk for SOE managers.

Abstract

The purpose of this research was conducted to offer a new method in the preparation of academic texts on laws and regulations. Academic Manuscripts contain the results of research regarding the contents of the content or proposals submitted to be regulated in a provision of statutory regulations and or regional regulations. Provisions related to the preparation of academic manuscripts have been regulated in laws and regulations, but a special method is needed in preparing academic manuscripts so that they are in accordance with the needs of the community. In this study using normative legal research methods. The findings in this study are that there is a novelty method that can be used in the preparation of academic manuscripts, namely the Rule Identification Urgency Solution (RIUS). With the RIUS method, an academic text can be used as a basis or basis for argumentation in the formation of laws and regulations or regional regulations. In conclusion, the RIUS method is a method that can analyze the rule of law, identify problems, the urgency of why these regulations are needed, and the solutions that can be provided. The RIUS method was first applied by researchers in preparing academic texts for regional regulations in the Badung Regency Government and Jembrana Regency Government, in this case researchers as experts in preparing academic manuscripts. Suggestions that can be given are that in the preparation of academic papers it is best to focus on analyzing what problems occur in society so that a regulation is needed.
