Abstract

Tujuan penulisan ini untuk mengkaji penyebab kredit macet dan penyelesaian kredit macet debitur ditengah pandemi Covid-19. Penulisan jurnal ini memakai metode penelitian normatif dikarenakan data hukum utama yang dipergunakan untuk mengumpulkan data hukum yakni peraturan perundang-undangan yang berlaku serta mengikat, buku yang terpaut serta jurnal ilmiah. Pada Pasal 1 angka 11 UU No. 10 Tahun 1998 tentang Perubahan Atas UU No. 7 Tahun 1992 tentang Perbankan, “Kredit adalah penyediaan uang atau tagihan yang dapat dipersamakan dengan itu, berdasarkan persetujuan/kesepakatan pinjam-meminjam antara bank dengan pihak lain yang mewajibkan pihak peminjam melunasi hutangnya setelah jangka waktu tertentu dengan pemberian bunga”. Penyebab kredit macet adalah nasabah tidak bisa melunasi keseluruhan maupun setengah kewajibannya kepada kreditur sesuai yang diperjanjikan dan dikarena faktor keadaan memaksa. Penyelesain kredit bermasalah dilakukan dengan subrogasi, penjualan agunan kredit, lelang hak tanggungan, dan pengadilan negeri. Ditengah Covid-19 ini terkait dengan kredit bermasalah Otoritas Jasa Keuangan menerbitkan Peraturan Otoritas Jasa Keuangan No. 11 /POJK.03/2020 Tentang Stimulus Perekonomian Nasional Sebagai Kebijakan Countercyclical Dampak Penyebaran Covid-19. ABSTRACT This writing has the aims of examine the causes of bad credit and the settlement of bad credit from debtors in the midst of the Covid-19 pandemic. This journal writing uses the normative research method because the main legal data used to collect legal data are applicable and binding laws and regulations, related books and scientific journals. In Article 1 number 11 of Law No. 10 of 1998 concerning Amendments to Law no. 7 of 1992 concerning Banking, "Credit is the provision of money or an equivalent claim, based on a loan agreement between the bank and another party which requires the borrower to pay off its debt after a certain period of time with interest." The cause of bad credit is that the customer cannot pay half or all of his obligations to the creditor as agreed and due to compelling circumstances. Non-performing loans are resolved by subrogation, sale of credit collateral, auction of mortgage rights, and district courts. In the midst of the Covid-19 related to non-performing loans, the Financial Services Authority issued Financial Services Authority Regulation No. 11 /POJK.03/2020 Regarding National Economic Stimulus as a Countercyclical Policy Impact of the Spread of Covid-19.

Abstract

This article aims to explore the development of business law in the context of Pancasila during the era of the Industrial Revolution 4.0. The research methodology used is normative juridical, which examines the implementation of positive legal provisions in business law. The data used includes primary and secondary sources, obtained from legal products related to business and trade. The rapid globalization brought by the 21st century industrial revolution has resulted in significant changes in various aspects of law, politics, economics, technology, and culture. As the Industrial Revolution 4.0 relies heavily on telematics (telecommunications, media, and information), it is essential to adjust regulations in the field of business law to accommodate these changes. The Indonesian government must engage in legal development, legal harmonization, and legal reconstruction to update legal products in line with the global situation. This includes building a legal system that reflects Pancasila and the 1945 Constitution to adapt to the industrial era 4.0. As the development of business law in the Industrial 4.0 era must be consistent with Pancasila's values and the 1945 Constitution, it is crucial to prioritize these values in legal development.
